In contrast, classical or nomative democracy derives freedom and equality from the Torah’s conception of man’s creation in the image of God, which provides freedom and equality with ethical and rational constraints. Recall the American Declaration of Independence. Since the Declaration proclaims “all men are created equal,” and refers to God as the “Supreme Judge,” it follows that all are obligated to obey the laws of their Creator (say the Seven Noahide Laws of Morality).

If it be said that democracy is inconsistent with Judaism, no less than Spinoza would agree. Spinoza, the father of liberal democracy and of modern biblical criticism, deemed the Torah anything but democratic. Yet distinguished rabbis and jurists contend that the two are consistent. To resolve this contradiction, I shall distinguish between two types of democracy, “contemporary” or normless democracy and “classical” or normative democracy.

Democracy has two basic principles, freedom and equality. Whereas freedom, in contemporary democracy, means “living as you like,” equality legitimates all “life-styles.” This is why moral equivalence and hedonism now permeate democratic societies. Hence one may ask: “What is there about democratic freedom that would prompt youth to restrain their passions, to be kind, honest, and just? What is there about democratic equality that would prompt a person to defer to wisdom or show respect for teachers or parents?”

In contrast, classical or nomative democracy derives freedom and equality from the Torah’s (Talmud Bavli Mishnah Torah) conception of man’s creation in the image of God, (Tetragrammaton god of Talmudism who is no god) which provides freedom and equality with ethical and rational constraints. Recall the American Declaration of Independence. Since the Declaration proclaims “all men are created equal,” and refers to God as the “Supreme Judge,” it follows that all are obligated to obey the laws of their Creator (say the Seven Noahide Laws of Morality).

Admittedly, the Declaration emphasizes “rights,” whereas the Torah emphasizes “obligations.” Although the two are correlative—your rights are my obligations, and vice-versa—rights connote “taking,” while obligations denote “giving.” Still, if freedom is linked to obligation, and if equality is construed as an elevating and not a leveling principle, classical or normative democracy can be assimilated to Judaism.

Turning to Israel’s Declaration of Independence: while it proclaims “political equality” and “freedom,” these terms must be understood contextually. By acknowledging Israel’s raison d’être as a Jewish State, such that its being “Jewish” is the State’s paramount principle, the “political equality” mentioned in the Declaration must then be construed not as an absolute—the tendency of contemporary-normless democracy—but as a logically subordinate principle. Consider, too, the Declaration’s avowal that the Jewish State will be based on “freedom … as envisioned by the prophets of Israel.” Any intelligent and honest person, even if not religious, will admit that the prophets’ understanding of freedom differs from the permissive or normless freedom of contemporary democracy.

If we take the prophets seriously—recall how they admonish kings and denounce immorality—we may learn how to elevate democracy and render it compatible with a Jewish constitution.

Over the centuries, the human race has experimented with many forms of government. Imperialist monarchies and despotism once ruled the world, giving way to such political and economic extremes as fascism and democracy, Marxism and capitalism. The twentieth century has been a particularly turbulent one. After two World Wars and the rise - and unexpected fall - of communism, we now have the luxury of hindsight to assess and learn from these various systems.

In each case, mankind continues to be plagued by the same basic conflict: individual rights versus the greater good of the community. The role of government is to strike a balance between the two, and yet no political system has been able to perfect this balance.

Human beings are naturally diverse in their beliefs and ambitions. Such differences often produce conflict between individuals and throughout society.  Suppressing this diversity would infringe on individual liberties, and is therefore unacceptable; and yet allowing every person unbridled freedom is also unacceptable, for each person would then be free to do as he chose, including harming another person or society.

Jesus is the life giver, life more Abundant, written in the hearts of them who believe.

Most governments have reacted to this paradox by opting for one extreme or the other.

Totalitarianism argues for the good of the whole at the expense of the individual; it believes that the individual is inherently selfish, and that his needs will ultimately fragment a nation and undermine the common good.  Ironically, it is under such regimes that individuals -- that is, dictators -- assume unprecedented powers. We need no reminder of the untold misery that this form of government, in most cases, has caused the human race.

Democracy, on the other hand, nurtures the very individualism that totalitarianism squelches; it declares that all men were created equal and possess the right to pursue their beliefs without hindrance. Democracy contends that it is better to have motivated free people and risk excessive self-interest than to destroy their drive by suppressing individualism for the common good.

Democracy would appear to be a far superior form of government than totalitarianism. But democracy contains an inherent flaw, in that its essential motivating factor is self-interest.

Over time, the core values of a community can begin to crumble under the accumulated weight of millions of individual desires and needs. Ultimately, these conflicting interests can erode a society’s unified drive for meaningful achievement. Several democracies have struggled mightily with this dilemma, perhaps none more than the United States, the largest democracy in the history of the world. Consider the current battle in dozens of American cities where individuals’ freedom of expression have come in conflict with community standards of morality. 

Since people are bound to have vastly different beliefs, who should define the standards of morality and justice that must rule all the people?

The underlying flaw of all governments, whether fascistic or democratic, is that they are based on human rules. Any government built on human judgment is bound to revolve around the prejudice, subjectivity, and arbitrariness of individual humans or groups. But
G-d, who created all people equal, also gave them a system of absolute morality and justice.

A society that yearns to be righteous must be built on such ethical values.The very foundation of civilization rests upon the basic principles known as the Seven Noahide laws given at Sinai[1]:

            1. Belief in G-d.
            2. Respect for and praise of G-d.
            3. Respect for human life.
            4. Respect for the family.
            5. Respect for others’ rights and property.
            6. Creation of a judicial system.
            7. Respect for all creatures.

Without these laws as a bedrock of government, a society will either have despotism, where individuals’ lives are compromised and possibly abused, or anarchy, where every person pursues his or her own needs without regard for the law.

So how is it possible to balance individual freedom with the good of society?  By looking beyond self-interest and recognizing that we are all part of the same family and community; by recognizing that we are all bound by the same divine laws and entrusted with the same mission in life - to civilize the world in a meaningful and G-dly way.

What steps should government take to ensure the welfare of its citizens?

The key to balancing individual and communal needs is education.

 For a government to be truly dedicated to the welfare of its citizens – their physical, emotional, and, above all, spiritual welfare – it must make education its primary objective without which all the other points are moot. A government and its leaders not only must teach citizens how to pursue rational solutions to complex problems but must teach them how to live. It must educate them that human conduct must follow the divine laws given to us all by G-d. This is the only guarantee that individual rights will be preserved without compromising the common good.

When the founding fathers included  “freedom of religion” in the Bill of Rights, they were ensuring the freedom of every man to worship G-d according to his own conscience; there can be no doubt that the Constitution was meant to preserve religious freedom, not to wean the nation away from G-d.

The principle of separation of church and state should not be misconstrued as a denial of G-d and religion. This separation is necessary so that government cannot impose any one religion on all its citizens; but such vigilance must not be carried out at the expense of the belief in G-d, which is shared by all denominations.

Breuer emphasizes that although the idea of the human community is a Jewish concept, it is obviously not the sole concept or even the basis of Judaism. (As that penetrating literary critic Edward Alexander once wrote, “universalism is the parochialism of the Jews”!) The basis of Judaism is not the universalism it bestowed on mankind, but particularism.

It should be borne in mind that God created a world not only for diverse individuals but for nations with distinct ways of life. However, for these ways of life to be mutually reinforcing and not mutually obstructive, they require the rational constraints of the Seven Noahide Laws of Universal Morality.

Despite its moral decay, contemporary democracy is commonly regarded as the touchstone of what is good and bad. Democracy thus constitutes the idolatry of the modern era. Mankind desperately needs Israel—of course, an Israel dedicated to God.

Come See Our Brutal Democracy
Freedom rings in Iraq! Bush was right all along! American wins! Or, you know, not

Ah, the violent march of democracy.

Beautiful thing, really, seeing repressed and weary Iraqis vote for the first time, and dance in the bloody bombed-out streets, and avoid the suicide bombers and of course not be able to travel between provinces or drive anywhere in their locked-down nation and by the way watch out for the snipers on the roofs.

It really is amazing, watching the deeply flawed system of democracy take hold in a raw and decimated nation like a thorny weed cracking through shattered concrete. All people deserve to be free and now Iraqis have a tiny bloody taste of it and this is always, always a good thing. I am not kidding.

So, should we be proud? Is Bush's thuggish and illegal pre-emptive attack strategy justified? Are Iraq's first-ever elections a defining moment in American political history? Are we all righteous and good and holy, despite all the dead bodies and the hatred?

Well, sort of. But then again, not really. Should Bush get some credit for all the cheering Iraqis who are now breathing sort of free? Well, no. Not even close.

While it's always heartwarming to see a brutalized and disheartened people flex their newfound freedom for the first time, the costs of this teetering, fragile, force-fed, implode-at-any-moment democracy are nauseating and appalling. You already know the numbers: $300 billion, over 1,400 dead U.S. soldiers and over 10,000 permanently wounded and countless thousands of dead innocent Iraqi civilians -- and many, many more to come.

And let us not forget the biggest disclaimer of all: Not a single one of BushCo's alleged reasons for dragging our fractured and bankrupt nation into one of the most brutal wars since Vietnam has actually proved valid or justifiable. The disgusting array of WMD/nuclear/biotoxin lies and deceptions are not suddenly erased because we set up some polling places.

How quickly we forget: A democratic Iraq was never the reason Bush forced us into this war. Iraq's fledgling democracy is a pleasant side effect, a bonus PR move, a heartstring-tugging and patriotic patina of bogus humanitarianism BushCo is now trying to slather over one of the most disastrous and inept military efforts in recent history. It makes for terrific photo ops. It makes for miserable and debilitating foreign policy.

Look. Democracy is good. Treasonous BushCo dishonesty and misprision and an outright ignorance regarding exit strategies and the true costs of war are not. Republicans and Bush apologists are quick to ignore, in this momentary orgy of political spin and PR, how not a single one of the problems Iraq faced before the elections has been solved. The brutal insurgent violence is only increasing. U.S. soldiers are dying in record numbers. Iraq is a violent mess. And Bush just asked for $80 billion more from the broke U.S. economy to fund the occupation, with no end in sight.

Let's just say it outright: The ends do not justify the means. A barely democratic Iraq is fine and good, but you well know that if Bush had mumbled to the nation three years and $300 billion ago that we were going to start bombing this piss-poor country back to the Stone Age and gut the U.S. economy and put thousands of American soldiers and tens of thousands of innocent Iraqis in death's way to deliver it, all while sending the nastiest possible message to the world and actually increasing the threat of terrorism while turning our backs on every major U.S. ally, I doubt many Americans would have giddily waved the flag of support (except maybe Ann Coulter, who apparently loves anything involving guns and dead foreigners).

Let's put it another way: Here is your choice, America: $300 billion and massive international disrespect and a huge pile of dead American soldiers in an effort to force a fragile democracy onto a torn and fractured Iraq by ousting their useless dictator who was, let us repeat, no threat to us, or to anyone, and who was, in fact, our ally, until he dared to threaten our oil.

Or: $300 billion to assist struggling nations and battle AIDS and protect the planet, to evolve our international relationships and set up treaties and unifying alliances and maybe even have a little left over to help fix our own schools, maybe help all those destitute American city upgrade their hospitals and fix their homeless problems and even maybe launch a national health-care plan, spend that money on trying to solve a huge host of social ills plaguing this crumbling beautiful egomaniacal empire we call home.

Which do you choose? What cost democracy? Where do you draw your lines?

Bush does not get credit for Iraq's fleeting glimpse of democracy for the exact same reason you don't give the tsunami credit for cleansing the streets of Indonesia. His motives were never, repeat never, to bring democracy to Iraq. His motives were to oust a pip-squeak dictator who threatened our access to 10 percent of the world's oil. It was about power, and regional control, and ego, and petroleum. Period.

Does this matter anymore? Iraq gets a glimmer of democratic hope and all lies and broken international laws and oily policy shifts are forgiven? Hardly.

Because if this is our new agenda, if we are suddenly the Hammer of Democracy that slams our political system onto every country we feel deserves it and damn the fiscal, emotional, spiritual and human costs, well, let's get to it, already.

Let's right now start preparing for U.S. forces to march into that pesky repressive China. Let us look forward to BushCo declaring war on Iran, and then North Korea, and then huge parts of nondemocratic Africa. Any day now, yes? How about Egypt? And Pakistan? And Jordan? Dictatorships and monarchies and repressive, antidemocratic oligarchies, all. Man, we'll be at war until 2045! Whee!

What about poor, beautiful Nepal, where the king just shut down the government and closed all the airports and severed communication with the rest of the world, and over 10,000 people have died in rebel fighting and the military is patrolling the streets and citizens are terrified and repressed and democracy is dying on the vine? Shouldn't we be marching in there next week, Georgie? Saddle up, cowpokes!

Oh wait. Won't happen. Reason: Not convenient. Not strategically lucrative. No oil reserves. No real power gain, except for maybe Iran, which is why BushCo is already busy working with Israel to map out bombing strategies.

In fact, to prove we don't really give a crap for the lovely "march of democracy" Republicans so love to gloat over, let's note right here how the U.S. regularly gives billions in aid to those very same repressive, dictator-friendly burgs of Egypt and Jordan and Pakistan. Ah, flagrant hypocrisy, thy name is Bush.

Look. Does America have a responsibility to the world to promote peace and democratic ideals in the world whenever possible? Hell yes. Does the world's richest and most gluttonous superpower have an obligation to intervene when absolutely necessary and help repressed peoples taste freedom and emerge from the shadow of evil dictators? You're damn right.

But not this way. Not at this cost. Not via a staggering and soul-mauling string of lies and abuse of power and a brutish foreign policies that only alienate and aggravate and inflame. Not through torture tactics and economic plundering and fear stratagems designed to keep the exhausted American populace from asking too many questions about this administration's real motives.

And not by way of a thuggish pre-emptive attack-first policy that goes against everything America has stood for (i.e., defense, containment, peace) for the past 100 years.

Meanwhile, in related news, an international team of scientists and researchers announced that the world has roughly 10 years before the effects of global warming become permanent and irreversible. Before the Gulf Stream is permanently weakened and massive ice shelves melt and the world is plunged more deeply in danger than we could ever imagine.

You really want to protect democracy, Dubya? Ensure its survival? You really want to have a lasting legacy, one not tainted with blood and war and humiliating claims of "mission accomplished?" Here's a tiny reminder: that $80 bil you just asked for to kill more Iraqis is 17 times higher than the EPA's entire budget. Maybe, just maybe, something is just a little off in our nation's priorities? Just, you know, a thought. Go democracy!

      The inherent tension between emphasizing the value of citizenship and extending a kind hand to aliens has come to the fore in recent scholarly literature. Offering rights too easily to non-citizens minimizes the value of citizenship itself, a problem for those who wish to promote strong identification with one's country.2  The overriding desire to help aliens, many if not most of whom inhabit difficult lives in the lower socioeconomic classes of society, spurs others to argue for expanding the rights of lawful permanent residents (LPR's), even to where they are indistinguishable from those given to citizens.3

      Underlying the debate is a disagreement about the purpose and value of citizenship, especially when it is counterpoised to the sticky questions of when or whether it is proper to discriminate against or deny benefits to people based on their lack of membership in a certain club.  This article suggests reasons why, and a model for how, to distinguish between citizens and lawful permanent residents.

      We will see that even at their most universal, Jews were remarkably particularistic in their expectations of non-Jews.2  Resident aliens in a Jewish polity were required to accept fairly specific and fundamental aspects of the Jewish worldview; once they did so, they were welcomed into Jewish society.  Since, however, they did not fully attach themselves to the Jewish way of life, they also only received some of the benefits of citizenship.

      The idea of using Jewish law to reflect on American is not new, but has been cogently critiqued by Suzanne Last Stone.7  Responding to a trend started by the late Robert Cover and followed by others,8 Stone argued that such analyses often neglect features of Jewish law that make it less salient than it might seem.  Specifically, she saw the centrality of divine authority in Jewish law--Judaism's insistence that adherence to the law be grounded in the belief that God commanded it--as making this system too different from secular law to provide useful comparison.9

      Three Models of Applying One Legal System to Another

      Stone obliquely raises the question of how one system, with its particularistic assumptions and worldview, can offer meaningful insight for another, a question we obviously must address before embarking on our endeavor in comparative alienage.  Granting Professor Stone's point that systems of law are often so different as to prevent importing elements from one to another, we can still envision three circumstances where transfer is plausible and appropriate. 

      First, claims of one system may appeal to the members of the other because they are convincing within the second group's own ways of looking at the world.

 Theoretically, all or most Americans might decide that the Jewish (or Moslem or Russian or French) view of marriage, or self-defense, or contracts, made sense in an American context as well, and adjust their laws to incorporate that decision.

      I stress the importance of naturalizing the innovation into the host context because I do not want to be misunderstood as arguing in favor of allowing outside systems to shape that of the United States.

 To claim that the United States should act in a certain way because God commanded x (or whatever justifies that law for the external system) is to speak gibberish in the context of the public debate of the United States.  For a mixture of reasons political and principled, this country has long rejected the authority of any but the most general religious framework in structuring the country's laws and institutions.  Private belief is a matter of personal conscience, but to be heard in the public arena requires phrasing oneself in terms that stand independently of any particular religious belief.

      Even given the restrictions just posited, there will still be circumstances that allow for the reasonable claim that the United States should adopt another legal system's view of a topic.  Once we grant that American values and ideals must remain the frame of reference, we can easily imagine occasions where other systems' handling of  some national concern seems more effective than current American practice, in a way that does not diverge from any American values or ideals.  In such situations, we could feel free to adopt that practice in toto.

      Where that kind of cutting and pasting of law from one system to another is inappropriate, a second kind of transference would be to adapt the categories of one system to the other, with the details differing from system to system.  Nation building provides a good example, since the nation overseeing the building tries to apply broad categories--democracy, tolerance, pluralism-- while recognizing that they may be expressed in a vastly different manner than in the original country.10  The resulting laws reflect the home country, but their underlying categories come from the overseeing nation.

ISREALHELL

      The least intrusive model, the one that best fits our current discussion, argues only for applying the broad themes of one legal system to another.  If a religious law insisted that its members pray a certain number of times a day, a thematic application of that law could be to recognize its underlying assumption that repeated recitations of formulae help people deepen their connection to core values.  Picking up on the theme, although not its content, a secular legal system might decide to institute some kind of ritualized recitation, such as the Pledge of Allegiance or the National Anthem, to help its citizens retain their sense of connection to the goals of the larger society.

      We will here suggest that that last kind of transference would be helpful in shaping the American discourse about citizenship and alienage.  In order to do so, however, we need to unravel the tangle of claims that Judaism made about Noahide law.

      Characterizing Noahide Law

      Previous discussions of Noahide law saw it as a form of natural law, where natural was used as a synonym for intuitive, or a law aimed at developing a minimal political community.  We will show that despite some indications that Jews thought of Noahide law as rational and minimal, the system actually required non-Jews to understand and accept fundamental aspects of the Jewish worldview before they could reside in a Jewish commonwealth. 

      As listed in the Talmud, non-Jews must establish a court system,3 are prohibited from committing blasphemy (cursing the Name of God), idolatry, incest, murder, theft, and eating part of an animal that was removed before the animal died.  The details of those general requirements show that these laws were meant to inculcate a fairly Jewish view of four central topics: God, society, sexuality, and food.

      Previous academic discussions of the Noahide laws have tended to ignore or fail to recognize its particularism.  Hugo Grotius, one of the earliest non-Jewish writers to speak of Noahide law, characterized it as a Jewish version of ius gentium, the term used for Roman laws governing relationships between Romans and non-Romans.

11  Part of that characterization is the recognition that these laws evinced a Jewish strategy for how to deal with strangers in their midst.  Ius gentium was assumed to be a universal law, “an intercultural law known to all peoples, later portrayed as a universal law flowing from a natural reason common to all mankind.”12  Grotius saw Noahide law as an early universal law, the basis for international law.

by which they meant that the laws could be intuited even without any external or divine guidance.13  Some Talmudic sources also seem to take that view of the issue,4 leading writers such as Moses Mendelssohn, Martin Buber, and Hermann Cohen,14 as well as contemporary thinkers such as David Novak and Nahum Rakover,15 to assume that the Noahide laws were a Jewish vision of an intuitive universal law.

      Marvin Fox, however, argued against the concept of natural law in Judaism, in general and specifically regarding Noahide law.16  Faced with sources that identified some laws as intuitive, Fox claimed that the Talmud only meant that they were explicable, that after God had commanded them, they could be explained in a way that all people would accept as reasonable.

      To prove that Noahide laws were not supposed to be intuitive, Fox pointed to Maimonides' ruling that observance of these laws earned non-Jews a share in the World to Come (WTC)  only if they obeyed them as a response to God's command.17

 Someone who figures out Noahide law independently, Maimonides wrote, may qualify as wise, but not as one of the Righteous of the Nations, his term for non-Jews who properly fulfill God's wishes.5

Insisting on an awareness of divine command, Fox correctly argues, means that Jews were not satisfied with observance of Noahide law because of its appeal to reason.6

      Rather than argue further about whether Noahide laws were intuitive, it seems most correct to accept the middle position suggested by Rabbi Aharon Lichtenstein, among others.18  Explicitly avoiding expressing an opinion on the issue of natural law, Rabbi Lichtenstein noted that Jewish sources certainly assumed the existence of an intuitive and universally binding morality.19  That morality, however, is not coterminous with Noahide law, as Norman Lamm and Aaron Kirschenbaum also wrote.20

      The details of the Noahide laws we will discuss in a moment lead to that same conclusion.  Our analysis shows that regardless of whether the Noahide laws were intuitive, their details7 go far beyond any kind of intuitive or natural law.  Reviewing these particularistic pieces of Noahide law will reveal the nomos, the underlying vision of the kind of a world its adherents should inhabit, embedded within Noahide law.  To anticipate, we will find that Noahide laws obligate non-Jews to view themselves as members of a society dedicated to a joint set of beliefs rather than as individuals free of positive obligation to the society as a whole, to concede the existence of a single God and to refrain from rebelling against Him,21

 to adopt a radically strict respect for rights to property and life, to be aware of proper and improper forms of sexuality, and to recognize the seriousness of making use of animals as food.  After proving those generalizations, we can consider what that suggests about American law.

      Dinim--A Social System

      The commandment to establish courts has received too much attention for us to meaningfully summarize it here.22  Two aspects of the commandment, though, show that it was geared towards forming a sense of a cohesive society, not just one that headed off conflict among its inhabitants.8 

Not protectors of peace, but Enforcers of Terror

      The accuracy of that view of the law depends on which position we accept in a medieval disagreement about the scope of the obligation.  In his codification of the law, Maimonides added that this commandment explained why all the people of Shechem23 --in the Biblical story of the abduction and rape of Dinah-- deserved their deaths at the hands of Simeon and Levi.  In Maimonides' view, all those present were capitally obligated to protest and judge their prince's abduction of Dinah, the daughter of Jacob; their failure to do so made them liable for death.9  More than just solving the theological problem of how Simeon and Levi, generally admired in Jewish tradition, could commit mass murder, Maimonides here expresses a forceful view of non -Jews' responsibility to insure the observance of the Noahide laws.

      His assumption of extensive observer-responsibility is itself certainly not intuitive, as shown, at the very least, by Nahmanides' (a thirteenth century Catalonian Talmudist and Biblical commentator) rejecting it.24  Nahmanides instead sees the obligation of dinim as mandating the establishment of a system of civil law.10  He did not set clear parameters for what this system had to cover, but gave numerous examples, including “theft, overcharging, withholding wages, bailments, rape and seduction, torts, lending, business, and so on.”25

      Although Nahmanides does not fully define that civil law, the sixteenth-century R. Moses Isserles assumed that non-Jews had to adopt Jewish law in these areas.26  Jewish civil law, let us note, is certainly not intuitive; its laws are derived, analyzed, and elaborated in extensive and complex Biblical and Talmudic discussions, with debates at most stages of the process, indicating that even those who grew up in the system were not able to intuit the law in any simple manner.

 Isserles, too, would have to be placed on the list of those who see Noahide law as particularistic.

      Even if Nahmanides thought that dinin meant that non-Jews would make their own laws,27 he may still not have thought of those laws as intuitive.  Rather, he may have assumed that the types of laws were intuitive, but that there was a range of equally acceptable laws dealing with the issues raised by those areas of law.  In addition, his allowing non-Jews to write their own laws in this area implies that the rest of the system, where they did not have such power, was not accessible to intuitive rule-making.  Whether we follow Maimonides or Nahmanides in either of his versions, then, we have only a weak form of natural law, and much of Noahide law left unexplained.11

      Although these perspectives of the commandment differ sharply from each other, they nonetheless each envision non-Jews as obligated to create a cohesive society rather than just avoiding conflict among citizens.  This is most clear for Maimonides, who sees the Noahides as capitally responsible for the behavior of others in their society.  For Nahmanides and Isserles, the scope of laws they required still goes beyond the minimal needs of a working society.12

      One final aspect of dinin is the Talmud's assumption that each of the seven Noahide laws was punishable by death, including theft of a minimal amount of money.28  This severity of punishment gives the impression that adhering to the standards of the seven Noahides was the bare minimum that justified human existence; violating any of these laws, to any extent, meant that the person had forfeited the right to life.  That, too, is not only not intuitive, but makes a very Jewish assumption, that one's right to life depends on adhering to standards of behavior set by God rather than by man.

      God--Idolatry

      The commandments to forego all idolatry and to refrain from blasphemy obligate non-Jews in monotheistic belief29

 Considering that paganism was alive and well in the societies where Jews lived in the time of the Mishnah and the Talmud--Christianity did not conquer the Roman world until the fourth century, and Persia was a pagan society even beyond that time-- it is unreasonable to claim that Jews thought that these rules were intuitive.13  Talmudic references to the explicability of the prohibition of idol worship meant only that non-Jews could readily understand why Jews, who believed in one God, would see idol worship as violating their mores.14

      In particular, the rules about idol worship force non-Jews to learn and understand Jewish views of what it means to worship a deity.

 We can easily understand that non-Jews would be prohibited from worshipping any idol according to its ordinary manner of worship (ke-darkah); what becomes more surprising is the system's calling for the death penalty for a non-Jew who bows down, offers incense, sacrifices, or libates to an idol;30 in contrast, other acts of admiration and love for the idol--kissing, hugging, washing, dusting-- do not incur the death penalty. The included forms of worship make the list because they were the ones that could constitute an avodat penim, an act of worship that occurred within the sanctuary of the Temple itself.

      When a system asserts that particular acts count as worship regardless of the interpretation of those acts in the minds of the people performing them, it is privileging those acts, announcing that Temple forms of worship carry an objective weight not true of other forms of affection or obeisance.  To adhere to this law properly and avoid the death penalty, non-Jews would have to engage and understand Jewish rules for each of these kinds of worship.31

      Although non-Jews could obey the Noahide blasphemy regulation without any particularly Jewish knowledge--the law simply prohibits cursing God, using any term that clearly refers to Him32-- non-Jews are nonetheless being required to recognize and accept Judaism's views of the consequences of certain kind of behavior towards God.

      Murder

      Criminalizing murder is intuitive, but the particular rules codified by Noahide laws are not nearly as obvious.  The killing of either a fetus (abortion) or a person who will certainly die within a defined period of time, or bringing about someone's death indirectly but deliberately (such as by tying her up in a place where a train will run over her) all qualify as capital murder in the Noahide system.33  American society's raging debate about abortion and assisted suicide shows that these are not intuitive rules; more than that, these rules show that the Noahide system expected people to treat all human life, however underdeveloped or certain to end, as out of bounds to human decisions about when it should end.34

      Incest

      Incest laws as a class may be intuitive,35 but the Noahide version is certainly not.  Maimonides concluded that non-Jewish men were prohibited from engaging in intercourse with their mothers, father's wives, married women, maternal sisters, men, and animals,36 primarily based on the Talmudic parsing of the first verse in Scripture that discusses human marriage.

  The verse reads “therefore shall a man leave his mother and father and cleave to his wife and they shall be one flesh,”37 which allows the Talmud to assert that sexuality cannot be expressed with one's parents (since the man is supposed to leave his parents, with the father's wife standing in for the father himself), must create a physical cleaving of the sort that only men and women can create (not men and men),38 must be with one's own wife as opposed to somebody else's, and must be of the kind of union that could turn them into one flesh, which rules out bestiality.

      Sexuality, in this presentation, is an extension of marriage; only those relationships that could be marital are allowed.39  Marriage, and therefore sex, could only happen outside the original nuclear family and only with partners who could theoretically lead to offspring.40  Even without insisting that sex happen only within marriage, Noahide law was requiring that it take the form of a marital act, and that it not interfere in any preexisting marriage.15

      Theft

      Like murder, theft is intuitive, but the Noahide reaction to it goes beyond what intuition would urge.  Theft of even the most minimal amounts of money, even if the victim of the theft is himself not the rightful owner, incurs the death penalty.  In the most extreme example, if one non-Jew steals a minimal amount of money from a thief who himself stole that money, both would be liable for death.16  More than seeking to protect property, which could be done through less extreme measures, Noahide law was making clear that violating others' rights to their possessions forfeited one's own right to life in that society.

      Ever Min haHay--The Limbs of a Living Animal

      Those who see Noahide law as either a natural law or a minimal political law identify the prohibition of ever min hahay, eating the limb of an animal that was removed while it was still alive, as an issue of cruelty to animals.41  That would be true if the rule forbade cutting off the limb of an animal, but it only actually prohibits eating a limb that was cut off before the animal's death.  We need to focus on what the rule addresses in trying to understand its purpose in the code.

      Recalling that Jewish tradition thought that Adam was not allowed to eat meat at all42  suggests that ever min hahay (limb from a living animal) was a food prohibition, not a cruelty one. When, after the Flood, God allowed people to eat meat (in Judaism's reconstruction of early human history), He required them to insure that the meat was dead before they ate it.  Animals were now acceptable sources of food, but they only became so after they had died or been killed.  The seriousness of the prohibition was to stress how off limits animals were expected to be while they were still alive.

      Taken together, the seven Noahide laws thus obligate those who would live as resident aliens in a Jewish society to accept fundamental Jewish ideas in four areas of life--the relationship to God, to sex, to others' lives and property, and to food.  Resident aliens would not need to become Jews to be tolerated,43 but they would have to accept and adopt basic Jewish beliefs in realms that go to the core of human self-perception.

      Were this the entirety of Noahide law, it would already teach us a great deal about how Jews expected the non-Jews in their midst to live.44  To round out the picture of Noahide law, however, we need to consider two more aspects of that system, its codifying rules that emphasize the differences between Noahides and Jews and its expectation that Noahides would go beyond these rules and observe a set of unenforced obligations.

      Acknowledging Their Otherness

      Although the status of a ger toshav, the Jewish legal term for a lawful permanent resident of a Jewish commonwealth, earned the non-Jew equal support in the minimal social welfare network,45 several rules highlight the system's insistence that non-Jews remember, recognize, and respect their status as outsiders.

 First, the Sifre, an extra-Talmudic collection of authoritative Scriptural inferences, rules that even such non-Jews may not live in Jewish cities.46  The requirement to set up separate communities stresses that they are being accepted and tolerated, but only as outsiders; full inclusion requires conversion.

      Similar themes underlie Talmudic statements about the significance of a non-Jew striking a Jew, observing the Sabbath, and studying Torah.  In each case, the Talmudic rhetoric stresses that non-Jews need to accept that they are not part of the special community that Jews view themselves to be.

That phrasing emphasizes the Talmud's assumption of Jewish exceptionalism, that the Jews' more detailed legal system gives them a special status as God's representatives on earth.  As such, striking a Jew becomes more than a simple tort, it becomes an offense against God Himself.47

      The other two examples involve areas of Jewish life that were seen as so particular to Jews that non-Jews were not allowed to take part; the Talmud assumed, in fact, that God would treat non-Jews' trespassing these boundaries as a capital crime.  Study of Torah was seen as the vehicle of a unique bond between God and the Jewish people,48 so that a non-Jew who studied Torah was breaking into this bond, and deserving of death.49

The right to take a day a week to cease all productive activity--the Sabbath--  was also seen as a special gift to the Jewish people; humans in general had to devote every day to being productive, to contributing to the settlement of the world.17

      Part of being a resident alien in a Jewish land, (USA) then, was recognizing the limits that status placed on participating in the majority society.  Full participation was readily available, but only to those who actually converted to the culture, lifestyle, and, in this case, religion of the majority.

      Positive Aspects of Noahide Law

      Until now we have only reviewed the prohibitions of Noahide law, but several sources suggest that there were positive expectations as well.  A tantalizing Talmudic statement as well as non-Jews' right to voluntarily accept specific mitsvot highlight the system's assumption that codified Noahide law was just the minimum; non-Jews were expected to supplement the prohibitions of Noahide law with (self-initiated) practices that give positive content to their spiritual existence.50

      In Tractate Hullin,18 the Talmud mentions that non-Jews accepted thirty positive commandments, although it hastens to add that they only managed to stay faithful to three of those.19  Without trying to fully unpack the statement, it clearly shows the Talmud's approval of non-Jews' independently legislating obligations outside of the original Noahide corpus.

      That statement, somewhat off the beaten path of the Talmudic discussion of non-Jews,20 could not on its own support a claim that they were expected to develop a positive relationship with God as well.  In the midst of its discussion of the Noahide laws, however, the Talmud notes that its list includes only prohibitions, not requirements of action,51 suggesting that there might be an extensive set of positive obligations not clearly codified in the Talmud.  Indeed, the next sentence asserts that non-Jews must exercise justice,52 while other Talmudic statements assume that non-Jews were required to give charity and to bear children.53

      Taking that positive obligation seriously means that Jews saw non-Jews as obligated by a law that taught them basic propositions about life, but that also reminded them to expand that minimal law in positive ways.  Somewhat similar to Adam's original mandate to “work and preserve” God's garden, non-Jews were supposed to bear children, give charity, set up a just society, and live productive lives, with the exact definition of those later terms left open to the sincere judgment of the non-Jews involved.21

      Adopting Jewish Versions of Worship

      For those non-Jews uncomfortable with such an open-ended set of requirements, one more option was available, an option that is particularly surprising in light of our earlier discussion.  Jewish authorities generally assumed a non-Jew's right to observe any commandments of the Torah other than the Sabbath and Torah study and to be rewarded by God for that action.  Most surprisingly, Maimonides allows a Jew to circumcise a non-Jew, as long as the non-Jew intends the act to fulfill the Biblical commandment of circumcision.

      I note this in particular because the Bible and Talmud54 assume that circumcision, like the Sabbath, created a covenant between God and the Jewish people;55 letting non-Jews circumcise without any intention of converting allows them into a circle that might otherwise be clearly thought of as exclusive to the Jewish people.22

      The question of how open Judaism is to the performance of its commandments by non-Jews is vigorously debated,23 but it offers at least one option for fleshing out a non-Jew's obligations towards God.  That does not mean that non-Jews are supposed to undertake such obligations, or that these obligations are the only way for a non-Jew to have a successful relationship with God.  Jewish writers' raising that possibility, though, offers one final proof that Noahide law was not seen as the end of a non-Jew's road, but the minimum base from which to build a fulfilled relationship with God.

      Translating Jewish Law to American Immigration Concerns

      We have seen that a Jewish commonwealth would demand that any resident aliens in its midst adopt practices that inculcate and observe fundamental principles of the larger Jewish society.  Since Jewish law thought of this as the bare minimum of acceptable society, Jews might hope that any non-Jewish society would adopt those laws as well.  Fine for the traditionalist and believer,56 that model only works for those already convinced of the second system's greater rightness than the first.

      The second option does not concede nearly as much to Noahide law.  In a structural adaptation, we would note that Noahide law picked on God, society (meaning property and personal rights and safety), sexuality, and food as areas to legislate for resident aliens.  Taking the categories but not the content, we might then argue that resident aliens should be specifically regulated in those areas as well.  Here too, however, Professor Stone's complaint about trying to import what is essentially a religious system into what is essentially a secular one still rings true.

      What the Noahide system does suggest, however, is a general social principle that current U.S. law ignores.  That is, Noahide law stresses, inter alia, that Jewish society stands for different values than other societies.  Those who would join that society, even partially, must be introduced to, and accept upon themselves, at least fundamental aspects of that society's worldview.  Full citizens, of course, need to accept the whole picture; partial citizens--and anyone allowed to live in a society for the rest of his or her natural life is certainly a partial citizen--need to accept less, but at least the basic beliefs of that society and commit to promoting their continued welfare.

      That becomes relevant to this country when we remember that every society, no matter how universalist in its rhetoric, actually espouses a particular worldview, both in terms of definition of the good life and of how to get there.  Robert Cover noted twenty years ago that law always constitutes a nomos, a vision of an ideal world towards which that society strives.57 Stanley Fish repeatedly reminds his readers of how much every human being and every society is locked into its own assumptions about how the world does and should work.58

      Recognizing this necessary aspect of our-- and any-- culture can help us articulate a vision both of citizenship and of alienage.  Citizens are members of a society dedicated to a particular set of ideals and a worldview of how best to actualize those ideals in practice.  Of course, in countries like the U.S. where citizenship is granted by birth, an educational process has to occur to ready children to become proper adult citizens, but the goal of that education is to inculcate whatever the society sees as its central values and processes.

      In addition, that self-definition needs to be adjusted frequently, as societies change over time.  The United States today would not define itself exactly as the Founding Fathers would have, so that we could not simply expect prospective citizens to read their writings and declare them ready for citizenship.  But American society does differ from the rest of world, and the extent of a person's acceptance of and participation in those differences should determine his or her acceptance in that society.

      It is not my intent here to articulate or promote my own view of those defining ideals, since more qualified people have already done so, from many perspectives, and I have no reason to think that my own vision is more persuasive than that of others.  What seems unequivocal, though, is that the United States, as a society, stands for important and significant ideals, and that part of citizenship is embracing those ideals, certainly theoretically, and, where possible, actively.

      Two responses to this claim might be that a) the U.S. makes an ideal of giving its citizens the freedom not to care about the welfare of the society and b) that, empirically, Americans do not share any common set of ideals.  To the first, I concede that the freedom to be apathetic is part of our conception of freedom, but that does not mean that we promote it; part of our vision of a tolerant society is that we do not penalize action or inaction just because we find it distasteful.  Our allowing citizens to remain ignorant of this society's goals and welfare, then, does not indicate our condoning their so doing.

part of the goal of this article is to call for rearticulating the general principles around which we all can rally.  Whether those ideals are electoral democracy, individualism, libertarianism, equality of all peoples, or some combination of those and other ideals I have left off the list, a vigorous debate about how to properly articulate the fundamental beliefs of this country should go far to reminding Americans of how much they share in common, regardless of their beliefs about abortion, homosexuality, or other hot-button issues today.

      Coming to some consensus about what we mean by citizenship would inherently allow us to improve our education of our citizens towards that citizenship,59 and to make citizenship more than just membership in a club, or a set of rights and even of obligations.60  The full rights and responsibilities of being an American would devolve to those who accept and adhere to the American worldview, and to furthering the prosperity of the society that adopts that worldview.24

      My main concern here, though, is with aliens.  Recognizing the nomos aspect of law, we can better identify what separates Americans from non-citizens.  Resident aliens, who have been granted the right to live in this country for the rest of their lives, are not required to commit to such fundamental American ideals as rule of law, tolerance of others, individual rights, and so on.61

      This lacuna in the law becomes all the more remarkable when we recognize the truth of Alexander Aleinikoff's claim that once immigrants are accepted as LPR's, naturalization is relatively routine.62  If the biggest hurdle for a non-American to get to this country is securing a permanent visa, it should be at that point that we insure that the prospective immigrant in fact sympathizes with the American Project (or Creed or Dream).

      Of course, we cannot expect them to immediately accept all the facets of that project.  Luckily, as Michael Walzer points out, worldviews can be expressed in thicker and thinner forms.63  The Noahide laws, we have shown, were a thinner form of the thick Jewish worldview, dealing only with the most central issues and in a much more attenuated form than in the system as a whole.

      The requirement for citizens to demonstrate proficiency in English has come under attack in some articles, on the grounds that prospective citizens can understand and accept their responsibilities in other languages as well.  Remembering that a legal system represents a worldview strongly suggests including language proficiency in the citizenship requirement.  Language shapes how people think and express themselves;65 once we recognize that law inherently inculcates a worldview, it makes sense to require citizens to be able to think and express themselves in the language of the system.

      Rights, Noahide law points out, come in three versions.  There are the rights of human beings by virtue of their humanity, rights of partial members of society-- as recognition of partial common cause-- and rights of citizens, which express the fraternity and mutual fructification that comes with sharing a particular worldview.66

      Rights in America ought to work the same way.  Some minimal rights of welfare should be extended to all those present in society (regardless of citizenship status), simply because they are human beings in our midst.

Those who come to join society partially, by accepting permanent residence, would have access to a broader, but not complete, set of rights.67  The differentiation is not for its own sake, but as part of reminding ourselves and others that the nomos of America is what allows the society to flourish, and the full benefits of that flourishing properly devolve only to those who are sworn to promoting the country's continued welfare.

      The articulation of the American creed will also help answer dual citizenship questions.  There are numerous countries in the world which, while not holding to the same nomos as the United States, are nonetheless close enough to predict few times of conflict for citizens of both. Other countries' worldviews present much more significant problems for citizens' ability to serve both countries fully at the same time.  Rather than deciding on dual citizenship as a general policy, the Noahide example suggests that political decisions would need to be made about each country separately, to see whether its worldview corresponds well enough to the American one to expect that citizens could reasonably identify with both countries at the same time.

      Finally, the Noahide example suggests that Hiroshi Motomura's argument in favor of granting LPRs certain rights so as to foster their transition to citizenship68 should be encased in some other rubric.  When immigrants arrive in this country, they might be asked whether they intend to become citizens after the waiting period or not.  Those who assert their intent to naturalize could be given a wider basket of benefits immediately, to foster their transition, as Motomura suggested.  Of course, if they failed to naturalize after some set period of time, they would revert to ordinary LPRs, with the more limited rights and benefits involved.

      Noahide law in the Jewish system thus highlights one model of how to deal with outsiders who wish to come into a nation's midst.  To the extent that they intend to remain outsiders, the host society nonetheless has to insure that they understand and respect the central and crucial values of that society.  In doing so, the aliens become partial members with access to some of the benefits of membership.

      Putting such a system into place--the practical lesson I would recommend drawing from our study of the Noahide system-- requires clearly articulating our central values, or at least engaging in a political process to decide what form those values take at the present historical moment.  That statement of values can strengthen citizenship, both birthright and naturalized, making it more than a set of rights or membership in a club, turning it into a commitment and an obligation to participate in fostering the good health of the society that articulates this particular view of the world. 

      Aside from the thick creed to be used by citizens, adapting the ideas of the Noahide system would call for developing a thinner version of that creed as well.  Outsiders would be expected to commit to that thinner version, as the price of entry into a society whose workings differ--greatly or minimally--from the workings of their home society.

      The point of demanding this of permanent residents is not to set up a barrier to their entry into American society.  Indeed, I see no reason why those who hope to naturalize need to be made to wait a full five years from entry.  To the extent that they understand what America is and means, and can present reasonable evidence of the sincerity of their attachment to this country, there is no reason that five years should be the magic time period.69  The point of demanding this is so that we all, citizens and not, understand what it means to be an American, and take seriously membership in that society, whether as a citizen or as an LPR, in order, as our founding phrase goes, to form a more perfect Union.

Complications, however, arise when transposing from the individual to the state and society. To put it into modern terms, a state that does not abide by the Noahide (that is, universal) covenant is not a civilized state, for that covenant implies the security of its citizens and their fundamental human rights.

The Mosaic covenant addresses not only laws but the spirit as well, and because it requires will as well as conduct, it is primarily addressed to individuals.

Individuals may or may not accept upon themselves this third covenant, but to insist that the collectivity do so regardless of the will of the majority of its citizens implies a degree of coercion that contradicts the fundamentally voluntaristic nature of the Mosaic covenant (based, as it is, upon freedom of the will) and is inconsistent with the democratic nature of the modern state. Note that this limitation issues not primarily form any political theory, whether that of democracy or any other, but is imminent in the nature of the Mosaic covenant, which addresses the heart and mind and will of individuals: "I have set before you life and death, blessing and curse; therefore choose life, that both you and your seed shall live." (Deuteronomy 30:19) 

Isa:28:15: Because ye have said, We have made a covenant with death, and with hell are we at agreement; when the overflowing scourge shall pass through, it shall not come unto us: for we have made lies our refuge, and under falsehood have we hid ourselves:16: Therefore thus saith the Lord GOD, Behold, I lay in Sion for a foundation a stone, a tried stone, a precious corner stone, a sure foundation: he that believeth shall not make haste.

 

To choose means that I must choose, out of freedom, and without any external compulsion. It is only when the great majority of the society accepts upon itself the obligations of this covenant that it applies in large measure to the state as well. Until such time, the state must refrain from imposing any transcendent or metaphysical vision upon its citizens.

The United States has developed a non-lethal microwave weapon for use in Iraq.

The ADS system would be downgraded for Iraqi deployment in urban areas, officials said. The ADS causes the skin to burn, causing the people to run away.

The Pentagon plans to install the non-lethal, high-powered microwave weapon on a military vehicle. The deployment of the first platforms in Iraq would take place in September 2005.

The project is designed to give U.S. troops options to battle hostile crowds without the use of lethal weapons. Officials said in many cases Sunni insurgents fire weapons and rocket-propelled grenades from crowds to prevent U.S. retaliation.

The Sheriff would be deployed by the U.S. Army and Marines. The two services will receive up to six platforms, equipped with a system to intercept rocket-propelled grenades.

Officials said the military would not design a new vehicle for the Sheriff. Instead, the Army will probably use a Striker or M117 armored security vehicle while the Marines would obtain a Light Armored Vehicle.

The ADS could be expanded to autonomous vehicles or platforms, officials said. This would include the use of the Sheriff at Air Force bases and other military facilities.

Iran Tests Nuclear Trigger Mechanism - Opposition

PARIS (Reuters) - Iran has conducted successful experiments on a crucial triggering mechanism for a nuclear weapon, an exiled opposition group said on Thursday.

President Bush on Wednesday renewed his accusation that Iran was seeking to develop atomic weapons and called it the "world's primary state sponsor of terror."

Tehran dismisses the accusations and says its atomic ambitions are limited to the peaceful generation of electricity.

The National Council of Resistance of Iran (NCRI), which wants to oust Iran's clerical rulers and has given accurate information on its nuclear sites in the past, said Iran was close to producing the 'neutron initiators' that spark the chain reaction in a bomb.

"Tehran has already succeeded in using beryllium in conjunction with polonium-210 for large scale laboratory testing purposes, and it is getting very close to the point of industrial production," Mohammad Mohaddessin of the NCRI told a news conference in Paris.

Diplomats have already said there is evidence that Iran has bought small quantities of beryllium and tried to buy much more, and that the International Atomic Energy Agency's (IAEA) is examining this as part of a two-year investigation of Tehran's nuclear program.

Beryllium also has many innocent uses, but Mohaddessin said Iran had not only secured significant quantities but also tried to conceal its purchases from the IAEA.

"Tehran currently has enough beryllium to produce initiators for a dozen nuclear bombs," he said.

He said the laboratory tests had been conducted at the Lavizan II site close to Tehran by experts from the Malek-Ashtar Industrial university, which is run by the Defense Ministry.

Germany, France and Britain, acting for the European Union, have been urging Iran to permanently scrap the uranium enrichment that could give it the potential to make nuclear explosives in return for political and economic incentives.

Washington takes a harder line and wants Iran to be reported to the U.N. Security Council for possible sanctions.

The NCRI is a coalition of exiled opposition groups. The State Department lists it and its armed wing, the People's Mujahideen, as terrorist organizations.

Gambling with History: Bringing Democracy to the Middle East

Is the Arab world ready for democracy? National security adviser Condoleezza Rice says the Bush administration both seeks and expects to transform the Middle East into a democratic region. Although the goal is laudable, the administration will be disappointed with its effort to establish a stable democracy in any Arab nation home to a large Muslim population. That's the verdict rendered by history, the contemporary reality of the region, and our own government experts.

 

Over the last three decades, a global expansion of democracy took place, most notably in Latin America, East Asia, and much of Europe. However, According to Freedom House President Adrian Karatnycky, "Since the early 1970s...the Islamic world, and in particular its Arabic core, have seen little significant evidence of improvements in political openness, respect for human rights, and transparency."

The existing "democratic deficit" in the Middle East is a massive obstacle to overcome. According to Freedom House, of the 14 Middle Eastern countries, only Israel and Turkey are electoral democracies. Not a single Arab Muslim country qualifies as an electoral democracy. The Arab Human Development Report 2002 constitutes a further, devastating critique of the Middle East. In this study, 30 Arab scholars dissect a region that trails in economic development, civil liberties and gender equality.

Most recently, political scientist Ronald Inglehart studied 21 years of responses to the "World Values Surveys," which measure the values and beliefs of people in 70 countries, including 10 Islamic nations. Inglehart concludes that the prospects for democracy in any Islamic country seem particularly poor. Freedom House quantifies such pessimism and calculates that a non-Islamic country is three times more likely than an Islamic country to be democratic.

In order that the entire world should be orderly, it is essential that each and every one of the "seventy nations" should be influenced so that they will work on settling the world. It is insufficient for only one nation to be acting properly.

Why are Islamic countries' democratic prospects so poor? It is true that, in most Muslim countries, a high level of popular support exists for the concept of democracy. Eighty-seven percent of those in Muslim countries agree with Winston Churchill that democracy may have its problems but it is better than any other form of government. In practice, however, overt support for democracy is a necessary, but not a sufficient condition for democratic institutions to emerge. Other factors are necessary.

A liberal democracy requires three things: a system of representative government;

a framework of liberal political norms and values; and social and institutional pluralism. Hypothetical support for representative government, absent tangible support for liberal political norms and values, and without the foundation of a pluralistic civil society, provides neither sufficient stimulus nor staying power for democracy to take root.

Today, the Middle East lacks the conditions, such as a democratic political history, high standards of living, and high literacy rates, which stimulated democratic change in, for example, central Europe and East Asia. Newsweek International Editor Fareed Zakaria recently noted that many Arab and Muslim countries are ruled by authoritarian leaders who, ironically, are more liberal than the citizenry they lead.

A classified Feb. 26, 2003, State Department report expressed doubt that installing a new regime in Iraq will foster the spread of democracy in the Middle East. Written by the State Department's Bureau of Intelligence and Research, the report argues that "even if some version of democracy took root...anti-American sentiment is so pervasive that Iraqi elections in the short term could lead to the rise of Islamic-controlled governments hostile to the United States."

The ingredients for successful democracy are found in domestic political kitchens. Revealingly, the United States spent $250 million on democracy programs in the Middle East during the 1990s with no noticeable impact. Larry Diamond, co-editor of the Journal of Democracy, says: "We must constantly bear in mind that democracy is not a gift we as Americans can bestow on...any other people. It is an opportunity that each people must discover, grasp, and craft for themselves."

Neither its inhospitable history nor contemporary reality guarantees that the Middle East will never democratize. Both, however, strongly suggest that the democratic journey, when it begins, will be slow, treacherous, and littered with setbacks.

Defender of the Jews, wherever they may be

In the current tense discussions both in Israel and in the Jewish Diaspora concerning the new wave of anti-Semitism, politicians and commentators alike have overlooked the legal dimension of kinship responsibility (in the sense of kol Yisrael arevim ze laze) that exists in the Israeli penal code. Section 13 of this code, enacted in 1994, enshrines in law an express Israeli commitment to the Diaspora-homeland security nexus.

Section 13, part of a wider reform of the code, granted Israeli courts jurisdiction over what is termed "extra-territorial crimes," that is, crimes committed outside
Israel. Section 13 is unique in the way it relates to what is defined in its title as "crimes against the state or against the Jewish People."

Section 13 states that: "Israeli criminal law will also apply to offenses committed outside Israeli territory against: 1. The life of an Israeli citizen, Israeli resident or public servant, his body, his health, his freedom, or his property, because he is one of the above. 2. The life of a Jew, his body, his health, or his property, because he is a Jew, or the property of a Jewish institution, because it is Jewish."

In this section, Israel defined in explicit terms the connection between the Diaspora and the State of Israel as the state of the Jewish people. Clearly, this connection was already affirmed and defined in the Law of Return, which establishes that "every Jew is entitled to make aliyah [immigrate] to Israel." It is also clear that the Law of Return and the Israeli commitment to the Jewish people that flows from it are the elements that often defined the Israeli national interest as a "Jewish interest." Indeed, over the years, this interest compelled state action to save Jewish communities in distress and bring them to Israel. Israel's military ties and arms transfer policies were also influenced, among other things, by the desire to guarantee the well-being and civil rights of Diaspora communities and were used "as quid pro-quo for permission to emigrate." Aharon Kleiman called this phenomenon "guns-for-Jews."

By enacting the section on the "Security of the Jews," the State of Israel expressed its commitment to protect all Jews regardless of their citizenship and their countries of domicile, as if they were citizens of the state and as if the crimes committed against them were committed within Israel's state borders.

In order to assess the far-reaching significance of the inclusion of the "Security of the Jews" clause in the penal code, we must understand the territorial principle of the law prior to the amendment of the penal code. In principle, criminal law is applied territorially. This means that the authority of a state to implement criminal sanctions is applied to a geographic/physical space over which the state has sovereignty. Within its sovereign domain, the state should exercise, in principle, a monopoly over the means of violence, and only its official institutions should determine criminal behavior.

`Extraterritorial' connections

The scope of the law is based therefore on the fundamental requirements of state's sovereignty. Obviously, criminal law derives from the right of the sovereign to use force in order to enforce these laws. Since the sovereignty of other states also derives from their own claim to legitimate monopoly over the means of violence and inheres in their enforcement within their own borders, it is not possible to implement criminal sanctions established by one country in another's territory.

This territorial limitation to the application of criminal law has a number of "extraterritorial" exceptions, which are based on different linkages or connections arising from the special character of a specific crime or from the personal links of the perpetrator or the victim of the crime:

The universal connection: This is a connection that gives every state, qua state, judicial jurisdiction over crimes committed against international law. A grave violation of international law is by definition extraterritorial and constitutes a violation of the sovereignty of all states as one, harming as it does the very basis of civil society, as it exists. The most classic example is genocide. In the past, piracy was the prime example of a crime that was granted universal jurisdiction due to its extraterritorial character. The universal connection in essence provides authority to every state to apply its own criminal laws against an offender, while he/she is in that state's domain.

The protective connection: When a crime endangers the very existence of states' sovereignty, their security or economic well-being, states are entitled to protect themselves. This means that when a certain violation jeopardizes the very basis of the state's fighting capability or its regular administration, the state is entitled to apply its criminal norms in order to protect itself, even though the violation occurred outside the state's borders. The justification for this application of criminal norms outside state boundaries lies in the great danger to the state's authority and order. This danger can be so severe that it sometimes justifies violation of another state's sovereignty.

The passive personal connection: According to this (weaker) principle, a state may apply its criminal laws to those who harm its citizens or residents when they are outside its territorial bounds. This principle rests on the state's obligation to protect its citizens, even when they are outside its sovereign domain. It is also based on the personal (kin) connection to the state. This connection is termed passive because it relates to victims who are "passive" relative to the damage caused to them.

The active personal connection: According to this principle, a state is allowed to invoke extraterritorial jurisdiction and apply its own criminal norms to crimes committed outside the country in proceedings against a state citizen who actively violated criminal law while outside the country, and who then chose to return to his/her country of citizenship. This connection in essence prevents the state from becoming a sanctuary for its citizens who are accused of committing offenses while abroad - since the state puts them on trial. This jurisdiction can also be used as an alternative to extradition of the offender to the state where the crime was committed.

It is in the light of this understanding of the territorial jurisdiction principle and of the connection that allows deviation from it, that one must see the special significance of the "Security of the Jews" clause that exists in the Israeli penal code.

In 1994, when the Knesset added the "Security of the Jews" clause, it established a new extraterritorial principle, an additional connection that makes possible the application of Israeli criminal norms outside the borders of the state. The significance of the clause is that the State of Israel sees the protection of all Jews as one of its supreme responsibilities and considers every Jew, wherever he/she may reside, to be covered by its legal protection.

The legislators' intent, to create a new and special extraterritorial connection, can be evaluated through the reading of the explanatory remarks offered on the bill, and the remarks made by then justice minister, Dan Meridor, in the Knesset plenum, when the bill was going through its first reading.

The explanatory remarks said:



"Likewise it should be emphasized that special protection is granted in Section 13(b)(2) to the life, health, freedom or property of a Jew, because he is a Jew, and that this is without any other connection to the State of Israel. The point of this is that just as when such an injury is directed against an Israeli, or an Israeli public servant because he holds such a position, the real injured party - according to the motive and object of the crime - is the state and the physically injured party is apprehended as someone who represents it or who is part of it, so, too, a similar rationale lies behind the protective application regarding injuries to a Jew or to Jewish institutions because they are such. This is an expression of the State of Israel's existence as the State of the Jewish people."



In his remarks to the Knesset during the bill's first reading, Meridor said:



"We accept in the bill Professor Feller's proposal to take upon ourselves as a Jewish state the responsibility to protect the life of a Jew, if he is harmed because he is Jewish. One may ask, of course, if there is a convention like this in other countries, and perhaps there is not. But there is no state that has written in another Basic Law, as in our Basic Law: The Knesset, Section 7a, the definition of Israel as the `state of the Jewish people.' When a Jew is persecuted anywhere because he is a Jew, not because he committed a criminal act, I think that it has to be made possible for us to apply the criminal laws of the State of Israel against the party who injures him, according to our judgment."



Significance and application

The practical significance of the "Security of the Jews" clause is that Israeli courts have jurisdiction over acts committed by foreigners against Jews because of their Jewishness. This means that from the point of view of the State of Israel, there is no substantive difference whether anti-Semitic offenses are committed inside or outside of Israel. In other words, in contrast to every other offense committed against Israeli citizens or Jews outside of Israel, and for which the court is not ordinarily empowered to judge, when an offense is motivated by anti-Semitism, the court has full jurisdiction.

In addition, the conferment of judicial jurisdiction on an Israeli court, and the treatment of the offense as if it was committed within the borders of Israel, provides the State of Israel the authority to demand the extradition of the offender.

Presumably, an extradition request would, in this case, run up against the commonly known roadblock of "dual criminality" - the requirement that necessitates that the offense prompting the extradition request exist in both the petitioning state and the state being petitioned. Since this clause in the Israeli penal code is unique and does not exist in the laws of other states, it appears that such an extradition request will not be heeded in practice. Nevertheless, much depends on the rules and laws of extradition, and situations may exist wherein the country where a crime was committed would be prepared to find a way to facilitate the extradition of a suspect to Israel.

To the best of our knowledge, the "Security of the Jews" clause has yet to be activated. This in no way diminishes the declarative and ideological importance of this law. It cannot be seen as beyond the realm of possibility that in the future, in certain circumstances, the law will cease to be merely words and will become a living and breathing reality.

At this time when a foul wave of attacks is raging against Jews, their property, their symbols and their institutions, attacks that have reached such worrisome dimensions, it seems to us proper to create awareness of this unique clause in the Israeli penal code and to encourage public debate, both in Israel and in the Diaspora, regarding it.
