Despite gasping for breath and feeling as though he was suffocating, he twice refused to go to hospital, medical staff told Catholic magazine Inside the Vatican.

“We caught him by a whisker,” one said. “If he had come in 10 minutes later, he would have been gone.”

Pope John Paul II’s top adviser first encouraged him to go to hospital when he began having trouble breathing, but the 84-year-old pontiff “decisively shook his head”, the magazine reports.

He sat down for dinner as normal and soon suffered a coughing attack and was gasping for breath.

But despite the best efforts of his closest aides, it was not until two hours later that the Pope finally relented, it is claimed.

He was rushed to hospital in the same ambulance that rescued him after an assassination attempt in May 1981.

The 10th floor of Rome’s Gemelli Polyclinic is permanently reserved for the Pope in case of emergency, but in this case he was probably taken down to a basement intensive care unit with advanced life support equipment, medical staff suggest.

The reports contradict the official word from the Vatican, where spokesmen have maintained the frail Pope simply suffered a bout of the flu.

A day after he appeared at his hospital window, the Vatican has announced he will remain in hospital for a few more days as a precaution.

Papal spokesman Joaquin Navarro-Valls said the Pope had no fever, was eating regularly and has been sitting in a chair every day for several hours. Officials said his sixth night at the clinic had passed calmly.

“His doctors have advised him to stay a few more days,” Mr Navarro-Valls said. He has also been reading the newspapers, “just to follow in the papers the evolution of my health”.

The 10-minute appearance at an open window yesterday gave the public its first glimpse of the pontiff since his hospitalisation.

But the delivery of his blessing created some controversy. A piece of paper covering his face raised suspicion that the voice heard via loud-speaker was actually a recording of the Pope, a suggestion passed off as “nonsense” by the Vatican.

“In this hospital, in the middle of other sick people to whom my affectionate thoughts go out, I can continue to serve the church and the whole of humanity,” the message said.

The Pope, who has Parkinson’s disease and hip and knee conditions, was taken to hospital on February 1. The illness forced him to cancel his first meetings in 16 months.

The next medical bulletin will be issued by the Vatican at noon (local time) on Thursday.

On 16 September 2000 the Holy Father appointed him Prefect of the Congregation for Bishops and President of the Pontifical Commission for Latin America.

Sharon, Abbas announce end to four years of fighting

"We must all announce here today that violence will not win, that violence will not be allowed to murder hope," Prime Minister Ariel Sharon announced, in an emotional speech closing Tuesday's summit at Sharm e-Sheikh. "We hope that today we are starting a new period of tranquility and hope...Only actions and not words – this is the only way to attain the vision of two states living side-by-side in peace and tranquility."

The landmark four-way summit, hosted by Egyptian President Hosni Mubarak, was also attended by Palestinian Authority Chairman Mahmoud Abbas and Jordanian King Abdullah II.

There is a "new wind" blowing, Sharon said, "and we should not let it pass, leaving us empty handed. Fears of attack to derail summit

Israeli security officials have expressed concern that terror groups - particularly Hizbullah - might try and launch terror attacks inside Israel ahead of and during Tuesday's regional summit in Sharm e-Sheikh in an attempt to derail the fragile peace process.

"All it needs is one major suicide bombing and Israeli casualties to bring an end to the entire process," one security official said – this with an average of 50 warnings registered by the security establishment each day.

"We have intelligence information that at this moment until after the summit, they would do everything to try to harm its success," Defense Minister Shaul Mofaz told Israel Radio on Monday.

He said an attempt to assassinate Abbas could not be ruled out, but said they had no concrete intelligence on this sort of plot.

Placed on high alert Sunday, police and IDF forces reinforced their presence in major cities, on highways and along the security fence that borders parts of the West Bank. Additional troops were deployed around Jerusalem.

Meanwhile, Palestinian security officials claimed Monday that the Hizbullah has greatly increased funds it is offering for carrying out terror attacks and Kassam rocket attacks in the Gaza Strip.

The organization, according to Palestinian security sources, is willing to pledge some 20,000 dollars to those who recruit terrorists or orchestrate or commit suicide bombings, Israel Radio reported. The sum is an enormous increase over the 1,000 dollars it has offered up until now.

For a filmed Kassam rocket attack, Hizbullah would pay 10,000 dollars.

The Palestinian Authority is familiar with many members of terror organizations who trained in Syria and Lebanon under the auspices of the Hizbullah, after which they returned to the Palestinian territories.

The PA has in the past demanded that they halt all terror-oriented activities, but their response has been that they would concede only in return for well-salaried employment

The Pitfall of Secular Zionism

Jewish sources are replete with stories about the downfalls of the Jewish people. The one common denominator to all these stories is the mindset of the Jewish people that preceded the tragedy. These stories revolve around communities with a thriving economy, a beautiful diplomatic relationship and a large Torah-learning crowd.

In some cases, we had a well-trained army, and in others, we had people high in government, whispering in the monarch's ears. We had great rabbis, generals and leaders.

But we had one more thing that came with most of these downfalls. We had pride.


This shall they have for their pride, because they have reproached and magnified themselves against the people of the LORD of hosts.

When I speak of pride, I'm not talking about holding our heads up high and saying, "Look I'm a Jew." There's nothing wrong with being a Jew, and by G-d, we should be proud of it.

Recently, I heard our prime minister speaking in the Knesset at a ceremony commemorating sixty years since the liberation of Auschwitz. He said: "Many times nations have tried to destroy us, and we don't have anyone to depend on but ourselves."

I don't know whether I was the only person in the country who heard our prime minister's words, or just the only one who put significance to what he said. Either way, what I heard convinced me that Prime Minister Ariel Sharon, and the people he represents, are on the way to another downfall.

Downfalls always began with the declaration of "kochi ve'otzem yadi..." - my strength and the power of my hand created all this for me. Whenever the Jewish nation managed to create for itself a nice stronghold with the help of G-d, the next step was usually to forget that it was actually G-d who got us there.

Prime Minister Sharon was misquoting a Gemara that lists things that will go wrong at the end of days. The Gemara concludes with the quote: "And we don't have anyone to depend on but our Father in Heaven." I believe the prime minister purposely changed the end of the quote from "our Father in Heaven" to "ourselves", rendering it a statement of "kochi ve'otzem yadi...."

I haven't been a great supporter of the prime minister since his expulsion plan was announced. However, I was not among those who believed that it would necessarily bring about the destruction of the state, mostly because of the miracles that have brought us this far. Even though I knew that the secular world was not the greatest advocate of the will of G-d, but using our Jewish sources in such cynical fashion completely earned my distrust. Even if a miraculous change occurs and the prime minister drops the expulsion plan, there is no way that I would be able to consider him and myself on the same side.

Since I doubt that the prime minister will ever read these words, and even if he does I don't think they that will have any impact on him, I do have a message to the people who I hope will be reading this. The prime minister is not the only one making this major mistake. We must continue working on the practical level, but we must not forget - no matter what we do, none of it will matter if we don't have Hashem right there with us, in every aspect and at all times

April 27, 2002. Washington -- The San Francisco Superior Court has awarded former Congressman Pete McCloskey, R-California, a $150,000 court judgment against the Anti-Defamation League (ADL).
McCloskey, the attorney in the case, represented one of three civil lawsuits filed in San Francisco against the ADL in 1993. The lawsuit came after raids were made by the San Francisco Police Department and the FBI on offices of the ADL in both San Francisco and Los Angeles, which found that the ADL was engaged in extensive domestic spying operations on a vast number of individuals and institutions around the country.
During the course of the inquiry in San Francisco, the SFPD and FBI determined the ADL had computerized files on nearly 10,000 people across the country, and that more than 75 percent of the information had been illegally obtained from police, FBI files and state drivers, license data banks. [.

Retired English teacher, grandmother, widow and fearless Christian, Mrs Olga Scully, 59, has taken on the might of the Executive Council of Australian Jewry (ECAJ) by disputing in the Federal Court of Australia various aspects of conventional history. Not only does she deny that there were homicidal gas chambers at Auschwitz, and anywhere else in then Nazi-occupied Europe during World War Two, she also vehemently lashes out at Talmudic teachings contained in passages offensive to Christians. Having as a child trekked from Soviet Russia to Germany during the war, Mrs Scully is well-versed with the facts of the Jewish-Bolshevik Holocaust that traditional historians call the 1917 Russian Revolution. She is doing everything in her power to spread the truth of this historical event, i.e. that most individuals involved in engineering the 1917 social upheaval in Tsarist Russia had a Jewish background.
Mrs Scully's life,s work began more than 30 years ago when she started to expose historical lies taught in Tasmanian schools. Ironically, it was only when her school principal husband died that the president of the ECAJ, Mr Jeremy Jones, in 1996 began hounding her into Australia,s politically correct Human Rights and Equal Opportunity Commission (HREOC).Before this tribunal, where truth is no defence, Mrs Scully did not while for long. She walked out of the hearing because she considered its procedures to be "immoral".
Matters progressed slowly but when, in her absence, the HREOC commissioner handed down his findings, Mrs Scully was found in breach of the Racial Discrimination Act. The material that she had been letter boxing and selling at her market stall, was judged to be offensive to a few Jewish individuals in Hobart and Launceston. She was asked to stop her activity, and to sign an apology for causing hurt, pain and suffering to Australia's Jewish community. Mrs Scully ignored the finding and now the matter is being re-litigated de novo, in the Federal Court of Australia before Justice Peter Hely. Mrs Scully is conducting her own defence.
Mrs Scully's interests range far and wide, as is reflected in the material she distributes, from exposing the money trick to fluoridization and related problems, from the evils of sex education in our schools, the problems of vaccination to the destruction of our family farms. It is interesting that during the cross examination of a witness, Mrs Scully could not get a clear answer as to why a specific leaflet was complained of that dealt with the teaching of "licking the anus". It appears that informing the community of such things was objected to by Mr Jones, and hence he appeared to condone such matters.
Mrs Scully is not interested in offending Jews as a group and she stated that she would name the group on her leaflet, be they Jews or Hottentots. She claimed the current crop of snuff movies seems to be controlled by the Russian and Italian Jews.

Mrs Scully is a concerned citizen with a mission: to do what responsible citizens and governments are not doing, to protest at outrages that are offending our human delicacies, our social environment. At one point in the proceedings, counsel for Mr Jones wished to have Mrs Scully's 111-page affidavit dismissed almost in total on account of it being "irrelevant". Counsel objected to Mrs Scully calling herself a Holocaust survivor. Justice Hely said that this seemed to him relevant because Mrs Scully was merely putting "a different point-of-view" across. He continued that this went to the heart of the issue he has to decide, whether Mrs Scully genuinely holds such a view. The second matter the judge has to consider is whether Mrs Scully,s statements are on a matter in the public interest and for a genuine purpose. Counsel for Mr Jones claimed that Mrs Scully did not have a genuine subjective belief. The story continues...

Rove Gets Bigger Role at White House

DETROIT (Reuters) - President Bush's senior adviser, Karl Rove, will take on a wider role in developing and coordinating policy in the president's second term, the White House announced on Tuesday.

Rove, who was Bush's top political strategist during his 2000 and 2004 presidential campaigns, will become a deputy White House chief of staff in charge of coordinating policy between the White House Domestic Policy Council, National Economic Council, National Security Council and Homeland Security Council.

Rove will continue to oversee White House strategy to advance Bush's agenda and will "make sure we have an open and fair process for the development of policy and to make sure the policy is complementary and consistent with the various councils," White House spokesman Scott McClellan said.

"He is one of the president's most trusted advisers who has played an integral role in strategy and policy development for a long time," McClellan said.

Deputy White House chief of staff Joe Hagin will take on a bigger role, deputizing for White House chief of staff Andrew Card at meetings concerning intelligence, counter-terrorism, counter-proliferation and Defense Department and the Homeland Security Council.

Bush's former chief speech writer, Michael Gerson, will become assistant to the president for policy and strategic planning and will have a lead role in advancing Bush's "compassionate agenda," such as his faith-based initiative. He will oversee the writing of Bush's major speeches as well.

A long-time deputy White House press secretary, Claire Buchan, will become chief of staff to new Commerce Secretary Carlos Gutierrez.

She will be replaced by the communications director at the White House Council on Environmental Quality, Dana Perino, McClellan said.

JUNE , 2004- On September 15, 2001, just four days after the 9-11 attacks, CIA Director George Tenet provided President [sic] Bush with a Top Secret 

"Worldwide Attack Matrix"

-a virtual license to kill targets deemed to be a threat to the United States in some 80 countries around the world. The Tenet plan, which was subsequently approved by Bush, essentially reversed the executive orders of four previous U.S. administrations that expressly prohibited political assassinations. 

According to high level European intelligence officials, Bush's counselor, Karl Rove, used the new presidential authority to silence a popular Lebanese Christian politician who was planning to offer irrefutable evidence that Israeli Prime Minister Ariel Sharon authorized the massacre of hundreds of Palestinian men, women, and children in the Beirut refugee camps of Sabra and Shatilla in 1982. 

In addition, Sharon provided the Lebanese forces who carried out the grisly task. At the time of the massacres, Elie Hobeika was intelligence chief of Lebanese Christian forces in Lebanon who were battling Palestinians and other Muslim groups in a bloody civil war.

 He was also the chief liaison to Israeli Defense Force (IDF) personnel in Lebanon. An official Israeli inquiry into the massacre at the camps, the Kahan Commission, merely found Sharon "indirectly" responsible for the slaughter and fingered Hobeika as the chief instigator. 

The Kahan (Kohan's) Commission never called on Hobeika to offer testimony in his defense. However, in response to charges brought against Sharon before a special war crimes court in Belgium, Hobeika was urged to testify against Sharon, according to well-informed Lebanese sources. 

Hobeika was prepared to offer a different version of events than what was contained in the Kahan report. A 1993 Belgian law permitting human rights prosecutions was unusual in that non-Belgians could be tried for violations against other non-Belgians in a Belgian court. Under pressure from the Bush administration, the law was severely amended and the extra territoriality provisions were curtailed. Hobeika headed the Lebanese forces intelligence agency since the mid- 1970s and he soon developed close ties to the CIA. He was a frequent visitor to the CIA's headquarters at Langley, Virginia. After the Syrian invasion of Lebanon in 1990, Hobeika held a number of cabinet positions in the Lebanese government, a proxy for the Syrian occupation authorities. He also served in the parliament. In July 2001, Hobeika called a press conference and announced he was prepared to testify against Sharon in Belgium and revealed that he had evidence of what actually occurred in Sabra and Shatilla. 

Hobeika also indicated that Israel had flown members of the South Lebanon Army (SLA) into Beirut International Airport in an Israeli Air Force C130 transport plane. In full view of dozens of witnesses, including members of the Lebanese army and others, SLA troops under the command of Major Saad Haddad were slipped into the camps to commit the massacres. The SLA troops were under the direct command of Ariel Sharon and an Israeli Mossad agent provocateur named Rafi Eitan.

 Hobeika offered evidence that a former U.S. ambassador to Lebanon was aware of the Israeli plot. In addition, the IDF had placed a camera in a strategic position to film the Sabra and Shatilla massacres. Hobeika was going to ask that the footage be released as part of the investigation of Sharon. 

After announcing he was willing to testify against Sharon, Hobeika became fearful for his safety and began moves to leave Lebanon. Hobeika was not aware that his threats to testify against Sharon had triggered a series of fateful events that reached well into the White House and Sharon's office. 

On January 24, 2002, Hobeika's car was blown up by a remote controlled bomb placed in a parked Mercedes along a street in the Hazmieh section of Beirut. The bomb exploded when Hobeika and his three associates, Fares Souweidan, Mitri Ajram, and Waleed Zein, were driving their Range Rover past the TNT-laden Mercedes at 9:40 am Beirut time. The Range Rover's four passengers were killed in the explosion. In case Hobeika's car had taken another route through the neighborhood, two additional parked cars, located at two other choke points, were also rigged with TNT. The powerful bomb wounded a number of other people on the street. Other parked cars were destroyed and buildings and homes were damaged. The Lebanese president, prime minister, and interior minister all claimed that Israeli agents were behind the attack.

 It is noteworthy that the State Department's list of global terrorist incidents for 2002 worldwide failed to list the car bombing attack on Hobeika and his party. 

The White House wanted to ensure the attack was censored from the report. The reason was simple: the attack ultimately had Washington's fingerprints on it. High level European intelligence sources now report that Karl Rove personally coordinated Hobeika's assassination. 


The hit on Hobeika employed Syrian intelligence agents. Syrian President Bashar Assad was trying to curry favor with the Bush administration in the aftermath of 9-11 and was more than willing to help the White House. In addition, Assad's father, Hafez Assad, had been an ally of Bush's father during Desert Storm, a period that saw Washington give a "wink and a nod" to Syria's occupation of Lebanon. 

Rove wanted to help Sharon avoid any political embarrassment from an in absentia trial in Brussels where Hobeika would be a star witness.

 Rove and Sharon agreed on the plan to use Syrian Military Intelligence agents to assassinate Hobeika. 

Rove saw Sharon as an indispensable ally of Bush in ensuring the loyalty of the Christian evangelical and Jewish voting blocs in the United States. 

Sharon saw the plan to have the United States coordinate the hit as a way to mask all connections to Jerusalem.

 The Syrian hit team was ordered by Assef Shawkat, the number two man in Syrian military intelligence and a good friend and brother in law of Syrian President Bashar Assad. Assad's intelligence services had already cooperated with U.S. intelligence in resorting to unconventional methods to extract information from al Qaeda detainees deported to Syria from the United States and other countries in the wake of 9-11. 

The order to take out Hobeika was transmitted by Shawkat to Roustom Ghazali, the head of Syrian military intelligence in Beirut. Ghazali arranged for the three remote controlled cars to be parked along Hobeika's route in Hazmieh; only few hundred yards from the Barracks of Syrian Special Forces which are stationed in the area near the Presidential palace , the ministry of Defense and various Government and officers quarters . This particular area is covered 24/7 by a very sophisticated USA multi-agency surveillance system to monitor Syrian and Lebanese security activities and is a " Choice " area to live in for its perceived high security .

 The plan to kill Hobeika had all the necessary caveats and built-in denial mechanisms. If the Syrians were discovered beforehand or afterwards, Karl Rove and his associates in the Pentagon's Office of Special Plans would be ensured plausible deniability.

 Hobeika's CIA intermediary in Beirut, a man only referred to as "Jason" by Hobeika, was a frequent companion of the Lebanese politician during official and off-duty hours. During Hobeika's election campaigns for his parliamentary seat, Jason was often in Hobeika's office offering support and advice. After Hobeika's assassination, Jason became despondent over the death of his colleague. Eventually, Jason disappeared abruptly from Lebanon and reportedly later emerged in Pakistan. 

Karl Rove's involvement in the assassination of Hobeika may not have been the last "hit" he ordered to help out Sharon.

 In March 2002, a few months after Hobeika's assassination, another Lebanese Christian with knowledge of Sharon's involvement in the Sabra and Shatilla massacres was gunned down along with his wife in Sao Paulo, Brazil. A bullet fired at Michael Nassar's car flattened one of his tires. Nassar pulled into a gasoline station for repairs. A professional assassin, firing a gun with a silencer, shot Nassar and his wife in the head, killing them both instantly. The assailant fled and was never captured. Nassar was also involved with the Phalange militia at Sabra and Shatilla. Nassar was also reportedly willing to testify against Sharon in Belgium and, as a nephew of SLA Commander General Antoine Lahd, may have had important evidence to bolster Hobeika's charge that Sharon ordered SLA forces into the camps to wipe out the Palestinians. Based on what European intelligence claims is concrete intelligence on Rove's involvement in the assassination of Hobeika, the Bush administration can now add political assassination to its laundry list of other misdeeds, from lying about the reasons to go to war to the torture tactics in violation of the Geneva Conventions that have been employed by the Pentagon and "third country" nationals at prisons in Iraq and Guantanamo Bay

Former CBSNEWS anchorman Walter Cronkite believes Bush adviser Karl Rove is possibly behind the new Bin Laden tape.

Cronkite made the startling comments late Friday during an interview on CNN.

Cronkite said he is "inclined to think that Karl Rove, the political manager at the White House, who is a very clever man, he probably set up bin Laden to this thing."

Interviewer Larry King did not ask Cronkite to elaborate on the provocative election eve accusation.

Chabad's lost son

Very few among Chabad-Lubavitch Hasidim know this story, and those who do go to great lengths to deny it. After all, it is not easy for the Hasidim to accept that Rabbi Moshe, the youngest son of the founder of their movement, Rabbi Shneur Zalman of Liadi (1902-1994) - better known in Jewish history as the Ba'al Hatanya and the author of the Likutei Amarim Tanya, a basic book on Hasidic philosophy - converted to Christianity.

In Eastern Europe of the last 200 years, conversion to Christianity was certainly not unheard of, and was most often motivated by a desire to alleviate the conditions of life - to find a job or be accepted to studies - or romance - falling in love with a non-Jew. But the conversion of a major Hasidic rabbi's son is certainly the most celebrated case.

The story was first made public by Professor David Assaf, a lecturer in Jewish history at Tel Aviv University, in an article he published some two-and-a-half years ago in a journal called "Zion." According to Assaf's research, involving the study of a wide variety of Hasidic sources related to Christianity, Moshe converted at the age of 36, when he was already married and had children. Moshe was his father's favorite son and viewed as his father's successor. Despite Moshe's young age, he was appointed to the prestigious position of hozer - the one who repeats the rabbi's sermons for the Hasidim.

Assaf examines the various possible motives, as discussed by others, and rules most of them out. Thus, for example, he mentions the claim made by a number of maskilim (secular or modern, observant Jews) that Moshe converted to Christianity because he was angry that his older brother, Dov Ber, whom he held in contempt, was ultimately chosen to succeed his father (mainly due to intervention by their mother, who supported Dov Ber's appointment).

Assaf maintains that Moshe's conversion to Christianity occurred many years after the decision concerning the succession and that there is no proof of any link between the two events.

The romantic motive - that he fell in love with a Christian woman - had already been ruled out as an unfounded and unreasonable rumor.

Assaf also rejects the possibility that Moshe became convinced of the justice of Christianity, or that he became a Christian so as to land a respectable job, along with the possibility raised in the past that he converted after befriending a Russian officer.

Assaf takes the view that Moshe's conversion to Christianity occurred as a result of mental illness. As he puts it: "He lost his mind and then his religion."

He finds a hint of this in a letter written in 1817 to one of the Hasidim by Moshe's mother, Rebbitzin Shterna, in which she relates that her son Moshe had "returned to his previous healthy state." Assaf entertains the possibility that she was hinting of the illness in the letter and that Moshe's recovery was only temporary.

Assaf notes in his article that among the Hasidim, in the first generations after Moshe's conversion when the story was still well known, the story circulated that many years later, Moshe renounced his Christianity, returned to the fold and sought to atone for his sin by wandering about the villages and towns unknown and alone, and that on one of these journeys he died.

Assaf says that the sixth Lubavitcher rebbe, Rabbi Yosef Yitzhak Schneerson (1880-1950), was the first of the Hasidic movement's leaders who tried to contend with the story of the conversion by means of total denial. In his view, according to the version presented by Rabbi Yosef Yitzhak, Moshe, who had a general education and was familiar with the ideas of Christianity, became embroiled in religious debates with Christians and was consequently forced to flee. In this way, Rabbi Yosef Yitzhak hoped to gain two dividends by both denying the story of the conversion and at the same time warning others of the dangers of too broad a general education.

In his article, Assaf also mentions the book by the converted Jew, George Lazarus. In his memoirs, published in 1841, Lazarus relates that in his youth, when he was still Jewish, he took a great interest in Hasidic customs, in particular because of his background as part of the Mitnaged movement (a movement that vehemently opposed Hasidism, which, it claimed, attributed greater importance to prayer and social values at the expense of Torah study and halakhic meticulousness).

In a footnote, especially interesting in view of the developments of recent years in the Chabad-Lubavitch movement, Lazarus writes that the proximity between Hasidism and Christian principles was very great: "The fuel is ready and all that is needed is a tiny spark to ignite the fire."

In a new twist, Boaz Eppelbaum, bureau chief for former prime minister Shimon Peres and now a businessman, has recently written a novel based on the story of the conversion - "The Christian Son of the Lubavitcher Rebbe" (Bitan Publishing). The Hebrew name and what appears to be the cleverest part of the book, "Chabad's Goy" - a play on the expression, "Shabbes Goy" - was suggested by sculptor Yigal Tumarkin entirely by chance.

Eppelbaum relates that he went to a Tel Aviv cafe to show the manuscript to singer and producer Dudu Elharar, and Tumarkin, who happened to be sitting there, took a look at the material, became excited about it and a few moments later came back with three ideas for a name. This was one of them.

The book is a sensationalist amplification of the account of Moshe's conversion to Christianity. Eppelbaum inserts a high-class call girl into the plot, Anna-Marie Schlagelbach, who is presented as Moshe's lover, and another lover, Countess Yelena Obarova, the daughter of the governor of the Ukraine and Lithuania, characters that figure nowhere in Assaf's study. He does not mention any independent source that led him to these people.

The book portrays the background for Moshe's conversion as an act of revenge by Baron Karl Schulmeister, the chief of Napoleon's espionage service who proposes to Moshe that he serve as a spy for the French forces invading Russia. Moshe refuses. In retaliation, according to Eppelbaum's version of events, the general decides, in council with Moshe's older brother Rabbi Dov Ber (the second Lubavitcher rebbe), to abduct Moshe and spread rumors about him that he has lost his mind. Ultimately, Moshe himself decides to convert because of his love for the Christian countess.

Eppelbaum added another interesting detail - that in 1943, Rabbi Yosef Yitzhak ordered his Hasidim to remove the cross from the grave of Moshe. Eppelbaum says that this fact and others were reported to him by two Lubavitcher Hasidim who prefer to remain anonymous. He adds that he has been conducting negotiations with the Cameri Theater concerning the possibility of a play based on his book and with Channel 8 on a film about a search for Moshe's grave.

Assaf, who has already read the book, says, "It is not a historical novel. It is not a novel because it is simply inarticulate and poorly written; and it is not historical because there is nothing real in it except for the fact of Moshe's conversion to Christianity."

He rejects the account of the removal of the cross from Moshe's grave, saying, "According to all the sources that I have studied, no one even knows where Rabbi Moshe is buried, although a Hasidic tradition attributes it to the village of Radomyshl."

Eppelbaum, on the other hand, does not deny that he added liberally to the plot, drawing on his own imagination, but insists on his right to do so. "I approached the subject as a writer, not a researcher. Because there are so many conflicting versions and lacunae in the story, and because I wanted to bring the story to the attention of as many readers as possible, I deliberately chose the format of a historical novel, taking the license to lean in the direction of a particular view or fabricate parts of the plot. I leave it to the reader to decide where reality ends and fiction begins. I will not contribute to any clarification of the picture."

Arguments with Christians

It is interesting to note that Eppelbaum himself admits that he happened on to the subject after having read Assaf's article. ("So why didn't he talk to me at any time while working on the book?" wonders Assaf.) But, says Eppelbaum, the article only served as the catalyst to deal with subjects that troubled him about the Chabad-Lubavitch movement even earlier.

"The first was in 1984, when I served as then prime minister Shimon Peres' bureau chief. The Lubavitcher rebbe appealed at that time to Peres to use his ties with the Italian foreign minister at the time, Giulio Andreotti, to ask his friend Mikhail Gorbachev to release the Hasidic writings kept at the time in the Leningrad Library. When Stalin allowed the sixth rebbe, Rabbi Yosef Yitzhak, the Lubavitcher rebbe's father-in-law, to leave the Soviet Union, he refused to allow him to take the larger part of the Hasidic movement's most important writings.

"A few weeks later, Andreotti returned with Gorbachev's response, which was a definite no. He explained that the Lubavitcher rebbe and the entire Chabad movement were viewed by them as CIA agents that dispatch spies all over the world, including to the Soviet Union, under the pretense of a religious mission."

The second case, Eppelbaum relates, was a year later, "when Peres wanted to find out what the position of Rabbi Schach, the leader of the Lithuanian ultra-Orthodox movement, would be were he to dismantle the unity government that existed at the time to establish a narrow government in its stead. Emissaries that spoke with Rabbi Schach reported that he refused to even meet with Peres, explaining that the rabbi refused to even speak with a `murderer of fetuses,' referring to the Labor Party's support four years earlier for the amendment to the Abortion Law, making it more liberal.

"In order to appease Rabbi Schach, emissaries were sent to him, of which I was one. In the discussion between us that ensued, I asked him why he opposed a narrow government headed by Labor, when the Lubavitcher rebbe was sending positive signals [The Lubavitcher rebbe is considered a far more extreme hawk, but according to Eppelbaum, because of his desire that Peres serve as an intermediary for the books, he was willing to support a narrow Labor government headed by Peres - Y.S.]. He responded with contempt for Chabad, saying among other things that `Chabad is the religion closest to Judaism,' meaning that it is not really Jewish at all."

Chabad spokesman Menachem Brod vehemently denies the story of the conversion. "It never happened; it's a fairy tale. Eppelbaum's book is not worthy of comment, but Assaf's article is also based on unproven hypotheses. As far as we know, Rabbi Moshe became embroiled in disputations with Christians, and after it was claimed that he lost one such debate, he was indeed ordered to convert, but refused to do so. Consequently, he was forced to flee and live his life out anonymously."

Brod also rejects the quote from Rabbi Schach describing Chabad as "the religion closest to Judaism." Brod says, "It is too witty for Rabbi Schach. The quip was made by Uri Zohar, who himself regretted it later on."

New information on the affair has surfaced in recent months. A historian from Hebrew University who prefers to remain nameless to avoid pressure from Hasidim collected documents relating to the story from both Jewish and non-Jewish sources in Eastern Europe, primarily Belorussia. The historian says it will take a very long time before the documents are deciphered because the 100 or so papers are written in a variety of languages, most of which will have to be translated by an independent translator. Therefore, he explains, he cannot discuss the new details that the papers reveal. "But it is already clear that they deal with the conversion of Rabbi Moshe."

In other words, they provide additional testimony to authenticate the story.

Early in his book, Eppelbaum discusses Chabad during the lifetime of the last rebbe, Rabbi Menachem-Mendel Schneerson. He writes that not only did the rebbe receive a general education, having attended a polytechnic institute in Paris, but that while he was there (before he was appointed Lubavitcher rebbe), he and his wife, Rebbitzin Chaya Mushka, led a bohemian and somewhat hedonistic lifestyle.

According to the book, the rebbitzin remained a very modern woman ("She was a very beautiful woman, who bore a strong resemblance to actress Marlene Dietrich") even after her husband was appointed rebbe. He describes her as refusing for many years to wear a wig, that she wore trousers and smoked cigarettes with a cigarette holder in public, in the style of Western women at that time.

"She had a restraining influence on her husband and only after his death did he begin to develop his messianic direction," the book says.

Professor Menachem Friedman, a scholar of ultra-Orthodox society in the Department of Sociology and Anthropology at Bar Ilan University who has been involved in the study of the life of the Lubavitcher rebbe for a number of years says that this claim too is an amalgam of fact and fantasy.

"The relationship between the Lubavitcher rebbe and his wife was very complex. They shared a great love, even in light of the fact that they lived alone and never had any children. But it is not true that only after her death did he discover Messianism. Rabbi Shalom Yosef Elyashiv endorsed Bush. Responding to queries from Americans residing in Israel Rabbi Elyashiv has decided that Bush is better for Israel than his competitor, John Kerry, said an assistant to the rabbi, Haim Cohen.

The endorsement followed an agreement to built a tri-state water filtration facility in Lakewood NJ and an undisclosed amount of subsidies for a 21st century state of art wig and human hair harvesting center on the border of Pakistan and Afghanistan, the stronghold of monotheistic religion.

Under the plan the wig production will replace opium as a main source of income for the Pakistani and Afghani farmers, financially depleting the al-Qaida. Sources close to the Bush campaign indicated that they are pleased with the outcome of negotiations and extremely grateful for the endorsement, they praised Rabbi Elishav’s strategic vision.

everything they can to prevent the Israeli public from voicing their opinion on this critical issue.

The "Jewish Alternative Disengagement Plan" is the name of the new young
competition that has arisen to challenge the Prime Minister's disengagement plan
. While The Prime Minister’s plan speaks of separation from the Palestinians by way of a phased withdrawal from the territories of Judea, Samaria and Gaza, the new plan, that is backed by "Mishalot Yisrael", speaks, in reality, about the transfer of the Arabs.

The registered organization (Mishalot Yisrael), commissioned a survey, already launched, known as the "Sderot Referendum". The organizers represent themselves as those who will try "to bring a smile to the Jews in Israel and to permit them to voice their opinion".

On the Mishalot Yisrael website appear declarations requesting to propose the "Biblical Plan" as an alternative plan to the one known as "the Disengagement Plan". According to the alternative plan, "the territories" will be annexed to Israel and the Arabs who live there will be removed. According to the
organizers of the referendum, Sderot is the starting point. 6,500 referendum ballots (to every household in Sderot) have already been distributed, in which the citizens have been asked to vote their conscience.

Yekutiel ben Yaakov, one of the leaders of the organization, explains, "We have started in Sderot because those who are the first to be affected by the disengagement should be the first to be polled, however we want every Jew in the world to vote and to express their view on the subject."

Ben Yaakov rejects the type of referendum that Yesha is lobbying on behalf of for several reasons. "Firstly, they offer no alternative to the Sharon/Peres proposal. Second, we have no time to wait for Sharon to agree to make a referendum. If Sharon should agree to such a referendum, he will have the advantage as the one who words the referendum, wins the referendum. And according to every national poll that has been taken in Israel, Sharon has a firm majority if the question will be a Yes / No referendum on Sharon's disengagement plan. The reason for this is that the average Israel wishes to be as far away as possible from the 'Palestinians.'

There is an old joke that asks how a chassid and a mitnagid know about the existence of God. According to the punchline, the chassid knows because his Rebbe told him; the mitnagid knows because he thinks he saw it in the Rashba.

While the joke successfully serves as a double punch against both chassidim and their opponents, underlying its humour is the serious issue of how we, as Jews, relate to God. In the general Jewish world, God is a strange figure; His Presence is powerfully felt and not felt. If someone accepts another faith, we bar that person from involvement within the Jewish world. 

Jews for Jesus do not occupy a place within our Federation round tables regardless of their identification or birth as Jews

and correctly so. Brother Daniel was not admitted as a Jew under the Law of Return; the Israeli courts deemed his Christian beliefs to be a bar to his Jewishness as understood by Israeli law - and the "gut feeling" of the average Israeli and Jew. (See further, on the issue of Brother Daniel, Encyclopedia Judaica 8:63 

and, specifically in regard to the halachic definition of Jewish identity - which would declare Brother Daniel a Jew - and in theological explanation thereof, my Crisis in Jewish Identity, Nishma IV - VII.) Judaism is deemed, by the average Jew whether observant or not, to be a religion; foreign views of God cannot be tolerated within our Jewish consciousness. God's Presence in even our colloquial Jewishness is, indeed, felt.

Yet, it is a Presence that is somewhat felt in the negative. If you have the wrong idea of God, than there is a bar to Jewishness; but if you have no idea or don't care about God, in the general Jewish world, there is no such bar.

 The atheist can become president of Federation; Secular Judaism which bluntly removes God from its Jewishness is part of our general Jewish community.

 What does this say about our view of God - His significance, our understanding of and our relationship to Him, within our general Jewish consciousness and perspective? Bluntly, the community does not assert in the positive - a Jewish perception of God

There is no discussion of God within our Federations; we are more comfortable with promoting our peoplehood or ethnicity than professing our religion. We, in fact, feel uncomfortable when God is mentioned - not just in our Federation buildings but also in our synagogues

A rabbi whom I consider a mentor told me that after his first few months in his present pulpit (a membership that is mostly non-observant), a committee of the Board approached him in regard to his sermons. They felt that they sounded too Protestant, different then what they expected from the Rabbi on Shabbat morning. The difficulty, when he questioned them for more clarification, was his constant reference to God. In Jewish education - formal and informal, for children and for adults - how much emphasis is placed on God? What is the place of theology in our Federation buildings, our Jewish schools, even our synagogues? God's Presence is, indeed, not felt.

There are those who would maintain that this approach to God is, in fact, the Jewish way. Theologically, they argue, Judaism only states the negative; it does not assert the positive

The parameters of Judaism, they say, are defined by what one does not believe, not by what one does believe. 

We can declare what views of God are not Jewish but, they contend, we cannot and need not declare in the positive, what the Jewish view of God is. This view is based on an incorrect understanding of the famous words of Rambam, Moreh Nevuchim I:58 which contend that we can only describe God through the negative, what He is not. 

We can not describe God through the positive, stating what He is. 

People argue that this is why Judaism can only be defined by what one does not believe, not through the assertion of a positive Jewish perception of God. Rambam, though, was referring to our attempt to understand God through an understanding of His attributes. The Perfect Unity cannot have attributes as we understand this word; we can only use negative attributes, what he is not, to describe Him. Implicit, actually, in the words of Rambam is a powerful perception of God - and a powerful perception of the expected affect on our life because of His Existence. 

The essence of Rambam's Jewishness, in fact, is the philosophical contemplation of Hashem. See Moreh Nevuchim III:54 and Mishneh Torah, Hilchot Yesodei HaTorah, chap. 1. To use Rambam's words referring to the use of the negative when describing God to imply that Judaism is only concerned about what you do not believe and not what you do believe, is a gross misuse of his words. He, in fact, had definite ideas about God according to Torah, as evidenced by his concrete presentation of the principles of Judaism, emphatically denouncing deviations and those who deviated from the true belief in Hashem. See Rambam, Commentary to the Mishna, Sanhedrin, chap. 10 (Introduction to Chelek). Rambam would never accept the laxity of God's Presence in colloquial Jewishness. Yet, we must still wonder how the Rambam's words could be so mis-applied. What exists in Jewishness that allows for such an attitude to take hold?

A similar question can be asked about the notion that Judaism has no dogmas. Rabbi J. David Bleich, With Perfect Faith, General Introduction opens with the mention of this "widespread misconception" and summarily dismisses it as "even a superficial acquaintance with the classical works of Jewish philosophy is sufficient to dispel this misconceived notion." Then how did this attitude develop? What within Judaism allowed for this mis-conception to take hold? The question is a legitimate one for whenever there is a deviation from the traditional Torah path, we are obligated to find the point of departure and correct any weakness (if found) that allowed for this mis-understanding to occur.

 Rashi, Mishna Avot 1:3 informs us of the source from which the heresy of the Sadducees arose - Tzaddok's misunderstanding of the words of Antigonus Ish Socho. We have a similar obligation. Where did this concept of "dogmaless Judaism", which, as Rabbi Bleich indicates, is totally without foundation, arise? (On the Rashi's substantive issue see, also, Mishneh Avot 1:11 which tells us to be careful of our words for people may mis-interpret what is said, and Rashi, Bereishit 1;26 which points out that sometimes one must say what is correct even if it will be misused and misapplied.)

Rabbi Bleich points to a work of Moses Mendelssohn as the source for this viewpoint. Yet Moses Mendelssohn could not have meant what colloquial Judaism understands from his words. The modern, as Rabbi Bleich calls it, dogma of dogmalessness basically states that Judaism has no beliefs, supporting, in a way, the above mentioned attitude that Judaism limits what you may not believe but does not state what you must believe. While I do not have access to the Rabbi Bleich's exact source, in the same work, Moses Mendelssohn (Jerusalem and Other Jewish Writings, translated and edited by Alfred Jospe, p.154) does write:

"Essentially, the religion of the Israelites encompasses only three central principles: God, Providence, and legislation. These principles were expanded by our religious leaders along the following lines:

"(a) God, the Author and absolute Sovereign of all things, is one and simple [single] (in His person as well as His nature).

"(b) This God is aware of all that happens in His creation. He rewards good and punishes evil by natural and, at times, supra-natural means.

"(c) This God has made known His laws to the children of Israel through Moses, the son of Amram. We still possess these laws in writing."

No doubt, Moses Mendelssohn was of the opinion that there was a great spectrum of halachically acceptable views within Jewish thought, yet a perusal of Rabbi Bleich's work would also support such an assertion. This is not to say that the views Moses Mendelssohn would consider halachically acceptable, would also so be accepted by Rabbi Bleich. There, perhaps, also seems to be in the words of Moses Mendelssohn a greater intimation of freedom for a person to choose as he/she may wish from this spectrum - a matter which Rabbi Bleich also discusses with sources for the indication of stricter parameters. Yet, clearly, without entering into a discussion of the merits of Moses Mendelssohn's views, this is not a dogma of dogmalessness. What existed in Jewishness that allowed for these words to be mis-applied? What exists in our traditional view of Hashem that allowed for colloquial Jewishness' ignoring of Him?

We can point to the lack of God's Presence in the general Jewish world and answer: what do you expect?, they are not religious. How, though, did a Jewishness without God arise? Once a deity is removed from a religion, the identification is removed. Can we imagine atheist Christians or atheist Moslems? Perhaps there are atheists who celebrate Christmas but we cannot imagine a lack of belief in the mainstream of a faith. Yet, the essence of colloquial Jewishness, although perhaps not atheistic, is God limited. Our major institutions of the general community do not consider God or think about Him.





Israel and the Peace Treaty:

Framing the Halachic Question

The present situation in Israel is obviously one of the most significant issues facing the Jewish people today. The question must be asked: what is the halachic directive in this regard? Differing opinions are actually heard from various poskim and Torah scholars; there are those that favour the peace initiative and those against it

What, though, is the nature of this disagreement? Do they differ in matters of Halacha or is the disagreement in mitzi'ut? Those who favour the peace treaty declare the woe, lo aleinu, that will ensue if it fails; those who oppose it declare similar misfortune, again lo aleinu, if it continues. Clearly the determination of the halachic directive is necessary, yet, the argument over the peace treaty seems to be an argument of what will happen, how to correctly assess reality. This seems to be a matter of mitzi'ut - for determination by experts in the fields of military science, diplomacy or politics. While a posek must ultimately render a decision based upon his determination of facts, based even upon conflicting expert opinions in these variant fields, the discussion is not for the beit midrash. While there is passionate disagreement over the peace treaty, this matter does not seem to be a disagreement in Torah theory - or is it? Is there a halachic issue in regard to the peace initiative?

The underlying assumption in declaring the argument regarding the peace treaty a machloket b'mitzi'ut is that the halachic directive is clear. In this matter, that directive would be that in the interest of peace, guaranteed peace, it would be permissible, even mandatory, to trade land for peace. The question is whether this agreement will bring peace - a question of fact. In discussing this matter with many opposed to the present initiative, they admit that if peace was guaranteed, they would, albeit reluctantly, trade land. It is, however, not universally accepted that, halachically, land can indeed be traded for even a guaranteed peace. Rabbi Herschel Schachter, Journal of Halacha and Contemporary Society, Number 16, "Land for Peace: A Halachic Perspective" expresses the opinion that, in certain circumstances, it may even be forbidden to trade land for peace.

We are clearly more comfortable in approaching the present argument over the peace initiative as a machloket b'mitzi'ut. Even Rabbi Aaron M. Schreiber, The Journal of Halacha and Contemporary Society, Number 18, "Relinquishing Yehudah and Shomron: A Response to Rabbi Bleich", in response to the article of Rabbi J. David Bleich, The Journal of Halacha and Contemporary Society, Number 16, "Of Land, Peace and Divine Command" which argues that land can indeed be traded for peace (although Rabbi Bleich, writing actually before the present peace initiative, does also present the concerns about the possibility of genuine peace - see, further, Rabbi J. David Bleich, The Journal of Halacha and Contemporary Society, Number 18, "Withdrawal From Liberated Territories" in response to Rabbi Schreiber), falls back on the mitzi'ut issue that relinquishing territory would only be suicidal. Bluntly, Judaism values human life. This is a powerful halachic concept. Piku'ach nefesh, even safek piku'ach nefesh, the threat to life, even the possibility of threat to life, overrides most commandments, even Shabbat. See Rambam, Mishneh Torah, Hilchot Shabbat 2:1. We are less troubled perceiving the issue to be one of protecting human life with our disagreement centring on the reality that will best assure this outcome. Rabbi Schachter's assertion that even at the expense of peace - even at the cost of Jewish lives - we may be forbidden to trade land, is one that forces us to truly confront our understanding of Israel and political sovereignty in the realm of halachic values.

They speak only of jewish life, for the goyim are lesser than animal souls

Each individual human life is of great importance within the world of Torah values. There is the famous Mishneh Sanhedrin 4:5 that compares a life to a universe. There is also the famous law that even at the expense of the entire community, we are prohibited to hand over one person to attackers to be killed. Each life is qualitatively unique and not to be part of a quantified entity. See, further, Rambam, Mishneh Torah, Hilchot Yesodei HaTorah 5:5. Yet, human life is not always halachically paramount. There are values that override as evidenced by the three categories of Torah law which we must not violate even at the cost of our lives: avodah zarah (idolatry), shefichat damim (murder), gilu'i arayot (the major sexual violations). The concept of kiddush haShem, sanctifying God's Name calls upon us to place demonstration of belief above even life. See Rambam, Mishneh Torah, Hilchot Yesodei HaTorah, chap. 5 and Shulchan Aruch, Yoreh De'ah, chap. 157. The halachic question that we must face in considering this peace initiative is whether Jewish sovereignty in Israel is also a value that overrides life? and if so, to what extent?

It is most interesting that we, as a community, did not confront this very question when Israel was first established. The reality was that even the establishment of the State and subsequent war was perceived also as an issue of human life. After the horror of the Holocaust, the establishment of a safe haven for our people was a clear necessity. The cost of war was framed as a question of risking one's life to save other lives. (See, further, Rabbi J. David Bleich, Contemporary Halakhic Problems, Volume 2, Chapter 10 for a brief introduction to this issue.) This may, in fact, have been the truth and may still, based on one's perception of the mitzi'ut today, be the truth. Yet, it is perhaps time for us to recognize the significant underlying halachic issue of the value of political sovereignty - of a Jewish State - in relation to the value of life. And this is not just an issue in regard to Yehudah and Shomron but involves the very nature of the State. Halachically, when does the value of Jewish sovereignty override the value of life, if ever, and when does the value of life override the value of Jewish sovereignty, if ever? Trading land for peace is but one issue within a broader halachic concern that touches the very essence of our connection to Israel.

Minchat Chinuch, mitzvah 425 states that whenever the Torah demands war, implicit in the command is the assumption of danger. The Torah, by definition, is commanding with the recognition that there is loss of human life on both sides of a conflict. If the mitzvah of kivush eretz Yisrael, conquering the land of Israel, applies today, then the command to achieve political sovereignty would apply even when there is sakana, danger. A significant question for our discussion is, thus, whether this command applies today? If one argues there is no command to conquer, would a command not to relinquish even at the expense of war, though, still apply? Is there another reason for declaring war mandatory? Interestingly,

 Rabbi Schachter argues that since war is part of the process of geula, redemption, stopping the war (i.e. the present hostilities between Israel and the Arabs) prematurely would not be allowed; as it is the war leading to the geula, halting it will only delay the coming of the redemption.

 Such an assertion can only be based on a supernatural understanding of these events which, according to Rabbi Schachter, would have halachic validity.

 Yet, the Minchat Chinuch's very argument that a mitzvah dealing with war must allow for sakana was based on the premise that Halacha always works within the natural realm. Notwithstanding this and other possible questions on Rabbi Schachter's position, (including challenges to the necessity of war as a prelude to geula - see also Rambam, Mishneh Torah, Hilchot Melachim 12:2), the emphatic point is made. The question is not just human life and the machloket b'mitzi'ut of which process, maintaining the land or trading land for peace, will ensure the greatest protection of life. While this question of reality still remains a most important matter for resolution, we now see that there are other issues that necessitate discussion - in the beit midrash. Israel represents, or may represent, other values - national sovereignty, Jewish presence in the land of our forefathers, hitchalta d'geula, the beginning of the redemption - and there is the need to halachically clarify the clash of these values with the value of human life.

The formulation of the Minchat Chinuch, especially in light of the comments of Chinuch, mitzvah 425 himself, must be further reviewed. The specific mitzvah under discussion concerned the command to destroy the "Seven Nations". The Chinuch writes that if one finds a member of these nations and can kill this person without sakana, then one is commanded to kill this member of the "Seven Nations". It is to this that the Minchat Chinuch responds that, by definition, since this mitzvah involved war, the command had to exist even in the face of sakana. He concludes his remarks with a question on the Chinuch. A possible way of understanding the Chinuch, though, would be to postulate that war is a unique category of sakana. On a private, personal level, piku'ach nefesh, life overrides even this command. On the communal level, a sakana known as war is to be tolerated. This is further evidenced by the very fact that the Jewish nation is permitted to enter war at their own initiative (given the meeting of certain requirements) while on a individual level we could not contemplate a similar level of sakana (and aggression) to meet our personal demands. See, further, on the unique category of war, Ntziv, HaEmek Davar, Bereishit 9:5 and Devarim 20:8. In this perspective, it may not be that political sovereignty overrides life per se but that in regard to this value, the unique communal danger of war is to be tolerated or even mandated. But then war, in its own strange way, has its own rules. What is a tolerable war? When does victory become too costly? T.B. Shevuot 35b states that a monarchy (i.e. government) that only kills one in six is not punished. Tosfot, d.h. D'katla clearly applies this statement to a nation's right to wage war. Is this gemara introducing some standard of acceptable war? Would this be a standard for toleration or, also, obligation, in evaluating a war situation?

Yet, we must also ask if we as a Jewish nation, at the present time, can be in a halachically defined and acceptable situation of war where these unique conditions would apply? See for background information on the halachic definitions and attitude in regard to war, Rambam, Mishneh Torah, Hilchot Melachim, chapters 5-8. For further discussion of the issue, see also Rabbi J. David Bleich, Contemporary Halachic Problems, Volume 2, Chapter 7 and Volume 3, Chapter 11. The question of whether we are to halachically approach the situation in Israel solely within the realm of personal individual law, allowing only the rights as individuals to defend self and property, or within the realm of public national law, allowing the unique right as a nation to wage war, is significant. It is not surprising that the authors, noted above, that discuss the issue of land for peace, while perhaps not explicitly, implicitly include within their discussion this important point. (Interestingly, a consequential factor in this entire discussion is the role of the urim v'tumim in war and whether it is, at one extreme, necessary even in waging an obligated war or not even necessary in a discretionary war?)

Other questions also have to be addressed. One is our responsibility to Torah belief ideals within the land (see Rambam, Mishneh Torah, Hilchot Avodat Kochavim, chapter 10) and the necessary clarification of our relationship to Islam and Christianity. Paradoxically, one of the arguments for the heter shemittah, the halachic method used to bypass the agricultural restrictions of the Seventh Year, was the enhanced status of the Muslim as a non-idolator. See Rabbi M.Z. Neriya, "The History of the Heter for Shemittah" in The Shemittah Year. Could this status now also affect, in favour of a treaty, the matter at hand ? (On the specific question of the status of non-Jews today, see, also Nishma: Issues, Numbers 1 and 3.)

Truthfully, we should also mention that in the machloket b'mitzi'ut issue itself, there are also halachic questions for investigation regarding how we are to respond given conflicting facts - and even in regard to our, or the posek's, right to resolve factual disagreements given that we are not experts in the field. Doubt as to the reality is also a mitzi'ut case to which Halacha responds. This matter is even more pronounced when the issue concerns life. Safek peku'ach nefesh, even the chance of danger, is deemed to override Shabbat. But what does one do when either choice could be life-saving or life-threatening? This question arises to a great extent in regard to experimental medical therapy and I direct you to the many works on medical ethics that investigate this issue. It should also be noted that a further mitzi'ut issue that may need resolution could be the cost of continued war.

We must also turn to historical precedent. Rabbi Yochanan ben Zakkai's surrender to Rome obviously indicates that at some point relinquishing political sovereignty for peace is acceptable. See T.B. Gittin 56a,b. Was this only because he saw defeat as inevitable? Was he also concerned about the possibility of a pyrrhic victory? Was the sovereignty of Yavneh enough to justify not continuing the war? It must be remembered that Rabbi Yochanan ben Zakkai, at first, it would seem, supported the rebellion. Rabbi Akiva's challenge of Rabbi Yochanan can also not be forgotten, yet, Rabbi Akiva did not challenge the very concept of surrendering but rather, in his mind, the limited concessions for which Rabbi Yochanan settled. It must further be remembered that Rabbi Yochanan's action is considered to have saved Torah l'dorot, for the generations. In any event, in their application to our modern situation, the conditions for Rabbi Yochanan's choice of peace over war must be analyzed - just as the decision to support Bar Kochba and the choice of war over peace in that case must also be analyzed. Of specific significance in the latter case, though, may be the religious persecution of that period, although there is always the question of which came first, and the Messianic perception of Bar Kochba. See Rambam, Mishneh Torah, Hilchot Melachim 11:3.

In conclusion, in all the debate about Israel, it is the subtle halachic issue of sovereignty at the expense of human life that we often ignore. Both those who favour and those who oppose the present initiative must clarify their positions within this spectrum before tackling the specific matter of the treaty. If one deems life to be simply paramount, then would that not theoretically entail even the foregoing of political sovereignty over Tel Aviv if life could thus be spared? If one deems sovereignty to be simply paramount, then would that not entail foregoing any concessions even at the expense of continued hostilities and the loss of perhaps many lives? If the halachic answer lies somewhere between these two extremes, where is that position to be drawn? The question of whether this position of maintaining sovereignty at the expense of war is one that is allowed or mandated must also be considered. Yet it is in this realm - a world that we as Jews approach hesitantly because of our very concern for life - that we must embark for a halachic clarification, not only of this specific matter but, of the very essence of our commitment to Israel.

And when they shall say Peace, sudden destruction shall fall upon them


Bush administration keeping wary eye on Iran

WASHINGTON (AP) — President Bush refuses to rule out war with Iran. Iranian President Mohammad Khatami says his country is ready to defend itself against a U.S. attack. The United States is pushing for a peaceful solution to its nuclear impasse with Iran but, with mistrust on both sides running high, encouraging signs are hard to find.

Iran 'is at the top of the list' of world trouble spots, Vice President Cheney said earlier this week.

"You look around the world at potential trouble spots, Iran is right at the top of the list," Vice President Cheney said Thursday in an interview with radio host Don Imus, hours before being sworn in to a second term.

Asked hypothetically whether the United States would yield to Israel in a scenario in which an attack against Tehran was being considered, he said, "One of the concerns people have is that Israel might do it without being asked, that if in fact the Israelis became convinced the Iranians had a significant nuclear capability, given the fact that Iran has a stated policy that their objective is the destruction of the state of Israel, that the Israelis might well decide to act first and let the rest of the world worry about cleaning up the diplomatic mess afterward."

Rice said U.S. differences with Iran go well beyond its nuclear program.

"It's really hard to find common ground with a government that thinks Israel should be extinguished," she told senators. "It's difficult to find common ground with a government that is supporting Hezbollah and terrorist organizations that are determined to undermine the Middle East peace that we seek."
