With respect to countries such as the United States, one must look at the imposition of capital punishment under Noahide law, which applies to non-Jewish people, or the power of a king or a state legislature to impose capital punishment, based upon the principle of dina de'malchuta dina, literally, "the law of the state is the law." The authorization for the imposition of capital punishment and the relevant evidentiary and procedural rules under Noahide law or the principle of dina de'malchuta dina are entirely different from those under Jewish law.

The question of capital punishment under the Noahide code was discussed in the Talmud. See B. Talmud, Sanhedrin 57a-b. It was decided that all seven Noahide laws are capital crimes. (Maimonides, Mishneh Torah, Judges, the Laws of Kings 9:14) Under Noahide law one may be executed based on the testimony of one witness or a confession, and without a prior warning. (Maimonides, ibid, 9:14; Chinuch ch. 26) According to one opinion, a criminal might be executed under Noahide law based upon circumstantial evidence (Rabbi Z.H. Chayoth, Ma'aritz Chayot, Vol. 1 ch. 49). According to Maimonides, non-Jews are required to establish a judicial system and apply the Noahide law, including the imposition of capital punishment (Maimonides, ibid, 9:14). It would appear, then, that American courts might be required under Noahide law to impose capital punishment for the violation of any one of the seven Noahide laws based upon one-witness testimony, circumstantial evidence or a defendant's confession.

4.10 Heavenly Jerusalem and Marxism

Trying to associate Marx with the Heavenly Jerusalem or with Zionism may seem sacrilegious to the orthodox on both sides of the dialectic between materialism and religion, yet a useful retrospective insight may be drawn from viewing Marx as a (Jewish) Messianic prophet.

AGADAH: The Gemara cites the verse in Shir ha'Shirim (3:7-8) that states, "Behold, it is the bed of Shlomo, surrounded by sixty Giborim (mighty men) of the mighty men of Israel. They all grasp the sword and are trained in warfare; each man with his sword upon his thigh, [protecting] against the dread of the nights." The Chachamim derive from this verse that a Dayan, when issuing a ruling, should be as fearful as though a sword is placed beneath him between his legs and Gehinom is below him.

According to the Gemara's Derashah, who are the "sixty" men mentioned in the verse?

(a) RASHI explains that the mighty men are the Talmidei Chachamim who comprise the Sanhedrin, who are fearful as though a sword is placed beneath them etc. However, we know that the Sanhedrin was comprised of *seventy* Dayanim, and not just sixty. Where are the other ten?

(c) The VILNA GA'ON supports Rashi's interpretation. He explains that when Sanhedrin sat, ten of its most important members sat in the middle of the group, and they were surrounded by the other sixty.         The Megilla refers to the most inner chamber of the king's palace as the 'chatzer ha-pnimit' (5:1), where entry to anyone is forbidden under threat of death - unless called to enter (as Esther feared in 4:11).  Here we find an obvious parallel to the kodesh ha-kodashim in the mikdash (Purim - kippurim!).

4) THE SIGNIFICANCE OF USING THREE, FIVE, AND SEVEN JUDGES FOR INSTITUTING A LEAP YEAR QUESTION: Rebbi Meir and Raban Shimon ben Gamliel argue in the Mishnah (2a) with regard to how many judges are required to institute a leap year (i.e. to add an extra month of Adar to the year). Rebbi Meir says that a Beis Din of three judges suffices, while Raban Shimon ben Gamliel says that the case begins with three judges, it is then discussed by five, and it is finalized by seven. The Gemara asks why Raban Shimon ben Gamliel specifically holds that a series of three, five, and seven judges is to judge a case of a leap year. One opinion says that it corresponds to the number of words in the three verses of Birkas Kohanim, which contain three, five, and seven words respectively. Another opinion says that it corresponds to the three royal guards at the gate ("Shomrei ha'Saf"), five of the royal servants who see the king ("Ro'ei P'nei ha'Melech"), and the seven royal servants who see the king ("Ro'ei P'nei ha'Melech"), as depicted in Sefer Melachim and Megilas Esther.


        The 'waiting area' outside the inner chamber is called the 'chatzer ha-chitzona' (6:4).  Here 'ro'ei pnei ha-melech' (1:14) like Haman himself are allowed to enter freely.  This is parallel to the kodesh where kohanim are permitted to enter.

Vatican Says Jews' Wait for Messiah Is Validated by the Old Testament

VATICAN CITY, Jan. 17 — The Vatican has issued what some Jewish scholars are calling an important document that explicitly says, "The Jewish wait for the Messiah is not in vain." The scholarly work, effectively a rejection of and apology for the way some Christians have viewed the Old Testament, was signed by the pope's theologian, Cardinal Joseph Ratzinger.

The document says Jews and Christians in fact share the wait for the Messiah, though Jews are waiting for the first coming, and Christians for the second. "The difference consists in the fact that for us, he who will come will have the same traits of that Jesus who has already come," wrote Cardinal Ratzinger, the prefect of the Congregation for the Doctrine of the Faith.

        Is the Megilla a satire?  It certainly contains many strange details that beg interpretation.  But if so, why would a satire be included in the Tanach.  In the following shiur, we attempt to 'unmask' Megillat Esther by considering its historical and prophetic setting. 


        We begin our study with one of the most well known psukim of the Megilla:  

"Ish yehudi haya be-Shushan ha-bira - u-shmo Mordechai"  (Esther 2:5). 

        Even though this pasuk is proudly read aloud by the entire congregation, most people do not appreciate its prophetic 'sting'.  However, an ear tuned to the prophecies of Zecharya and familiar with Tanach immediately catches its irony:

        ish yehudi - implies more than simply someone who is Jewish;

        ha-bira - implies more than just 'the capital city'; and

        Mordechai - is not a Jewish name! 

* The phrase ish yehudi is mentioned only one other time in the entire Tanach - in Sefer Zecharya 8:23.  There it describes a devout Jew in the city of Jerusalem - leading a group of non-Jewish followers in search of God. 

* the word ha-bira in Divrei Ha-yamim (see 29:1 & 29:19) is used by King David to describe specifically the bet ha-mikdash (the Temple).  Prior to the time period of Megillat Esther, the Hebrew word bira finds no other mention in Tanach. 

* The name Mordechai is probably the most provocative word in the entire Megilla for it stems from the name of the Babylonian deity -Marduk (see II Kings 25:27 & Yeshayahu 39:1!).  Prior to the Babylonian exile, no one would have dared give his son such a 'goyish' name.

[This does not imply that Mordechai was assimilated, rather his name may reflect the assimilation of his generation.] 

        And this may be only one of many psukim of the Megilla that are filled with irony and possibly satire.  Yet, if this conclusion is correct, we must explain why the Megilla would employ satire to deliver its prophetic message.  Furthermore, we must also determine more precisely what that prophetic message is, and how it relates to our celebration of Purim.

        To answer these questions, our shiur will take the following steps:

I. Base our above assumption that the Megilla should contain a prophetic message, related to its historical setting.

II. Review both the historical and prophetic setting of the time period of the Megilla.

III Search for a thematic connection between this setting and the story in the Megilla, and support it with both textual and thematic parallels from other books in Tanach.

IV. Explain why the Megilla employs this unique style.

V. Explain how the celebration of Purim, as defined in the Megilla, relates to this theme. 


        As every book of the Tanach contains a prophetic message, Megillat Esther should be no different.  It is commonly understood that the Megilla teaches us how to see the 'hidden hand' of God behind the events that ultimately lead to Bnei Yisrael's salvation from Haman.  Some even suggest that the Megilla's use of the name Esther (from the Hebrew verb 'lehastir' - to hide) instead of her real name - Hadassa (see 2:7) teaches us this very lesson.

        However, if the Megilla wants to show us how God saved His people, why isn't this message explicit?  Furthermore, why isn't God's Name ever mentioned?  Most every other sefer in Tanach expresses this point explicitly.  Why is Megillat Esther different?

        Furthermore, most all other seforim in Tanach explain not only how God saves Am Yisrael, but also why they are being punished.  This theme of divine retribution is explicit in the Torah in the tochachot (Vayikra 26:3-46, Devarim 11:13-17, 28:1-69, etc.) and reiterated over and over again by all of the prophets.  In fact Chazal's explanation of the name Esther reflects this very same concept:

        "Esther min ha-Torah minayin?"

         "ve-Anochi haster aster panai ba-yom ha-hu"

           [I will surely hide my face from you on that day.]

                                 (Devarim 31:18 / See Chullin 139b). 

        However, if we take a closer look at that pasuk in Devarim, we find that its message is significantly different.  Rather than explaining how God 'saves' Am Yisrael in a 'hidden manner', it explains how God 'punishes' them:

"And God told Moshe, after you die... this nation will leave Me and break My covenant...And My anger will be kindled against them on that day and I will forsake them, ["ve-histarti panai"] and I will hide My face from them... and many evils and troubles shall befall them - & they will say on that day, these evils are because God is not among us.

and I will hide My face from them on that day because of all the bad that they have done... [Therefore,]

- Write down this song and teach it to Bnei Yisrael, so that it will be My witness..." (Devarim 31:16-18). 

        In these psukim, God warns Bnei Yisrael that should they betray His covenant, great evil will befall them.  Even though it may appear to Bnei Yisrael that God has left them, these psukim teach them that God only appears to be 'hiding His face' ['hester panim"] from them.  Nonetheless, Bnei Yisrael are expected to realize that their punishment is from God.  Therefore, Moshe is to teach Bnei Yisrael Shirat Ha'azinu in order that they recognize this. The shira will teach Am Yisrael to contemplate their predicament and relate their punishment to their wayward behavior.  To verify this point, simply read Shirat Ha'azinu [note especially 31:19-20.]

        Above all, Shirat Ha'azinu explains how we are to determine why we are being punished.  In that song, we are told:

        "Zechor yemot olam, binu shnot dor va-dor..." (Devarim 32:7).

         [Remember the days of old; consider the years of ages past.] 

        The shira teaches us to contemplate our history, especially how and why we were chosen (see 32:8-9), in order to realize why we are being punished.  It reminds us that when something does go wrong, it is our fault, not God's (see 32:4-6!).

        Even though God may hide His face, Shirat Ha'azinu does promise that God will ultimately redeem His people, however, not necessarily because they deserve redemption.  Rather, God will have mercy on our pitiful predicament (see 32:26-27, also 32:37-38) and save us at the 'last minute'.

        Most all of the prophets deliver a very similar message.  They explain to Bnei Yisrael what they have done wrong, and hence why they are being punished.  Prophecy teaches man not only to thank God for salvation, but also to recognize his faults and correct his mistakes.

        Therefore, the Megilla should be no different, and especially because its name alludes to the pasuk in Chumash that commands us to search for a reason why we are punished.

[This supports the Gemara's question in Masechet Megilla 12a (middle) "sha'alu talmidav et Rashb"i: mipnei ma nitchayvu..."] 

        Even though the Megilla does not provide an explicit reason for this impending punishment, this background and its name suggest that we search for a 'hidden' (or implicit) one.  To find that reason, we must consider prophetic and historical setting of that time period.



        The opening psukim of the Megilla immediately point us to its time period (see 1:1-3).  Achashverosh is a Persian king who reigns from India to Ethiopia in the city of Shushan.  Considering that Cyrus (=Koresh) was the first Persian king, the story in Megillat Esther takes place during the Persian time period and thus after the time period when the Jews had an opportunity to return to Jerusalem.

President Bush says the diplomatic track to disarm Iraq's Saddam Hussein is ending, and "crucial days lie ahead" for the world.

"Tomorrow is the day that we will determine whether or not diplomacy can work," Bush said at a joint press conference March 16 in the Azores, following an hour-long summit on Iraq with the Prime Ministers of Britain, Spain and Portugal.

A draft resolution before the United Nations Security Council -- co-sponsored by the United States, the United Kingdom and Spain -- would give Iraq's Saddam Hussein one final opportunity to completely disarm by March 17. That resolution has been on the table for ten days. It refers back to November's Resolution 1441 that says Saddam Hussein is in material breach of Gulf War Security Council resolutions and must disarm or face serious consequences.

Bush noted that the Security Council unanimously approved Resolution 1441. That resolution, he said, declared Iraq in material breach of its longstanding obligations, and demanded "once again Iraq's full and immediate disarmament, and promised serious consequences if the regime refused to comply." The logic of that resolution, Bush said, "is inescapable; the Iraqi regime will disarm itself, or the Iraqi regime will be disarmed by force."

"And we sat and visited about this issue, about how best to spend our time between now and tomorrow. ... [W]e'll be working the phones and talking to our partners and talking to those who may now clearly understand the objective, and we'll see how it goes tomorrow," the president said.

"Saddam Hussein can leave the country, if he's interested in peace. ... [T]he decision is his to make. And it's been his to make all along as to whether or not there's the use of the military," Bush said.

"[W]e concluded that tomorrow is a moment of truth for the world. Many nations have voiced a commitment to peace and security, and now they must demonstrate that commitment to peace and security in the only effective way: by supporting the immediate and unconditional disarmament of Saddam Hussein," the president said.

Military action would liberate Iraq and "would be the beginning, not the end, of our commitment to its people," Bush said. "We will supply humanitarian relief, bring economic sanctions to a swift close, and work for the long-term recovery of Iraq's economy. We'll make sure that Iraq's natural resources are used for the benefit of their owners, the Iraqi people.

"Iraq has the potential to be a great nation," he said. "Iraq's people are skilled and educated. We'll push as quickly as possible for an Iraqi interim authority to draw upon the talents of Iraq's people to rebuild their nation. We're committed to the goal of a unified Iraq, with democratic institutions of which members of all ethnic and religious groups are treated with dignity and respect.

"To achieve this vision, we will work closely with the international community, including the United Nations and our coalition partners. If military force is required, we'll quickly seek new Security Council resolutions to encourage broad participation in the process of helping the Iraqi people to build a free Iraq."

Britain's Prime Minister Tony Blair said "we have reached the point of decision, and we make a final appeal for there to be that strong, unified message on behalf of the international community that lays down a clear ultimatum to Saddam that authorizes force if he continues to defy the will of the whole of the international community set out in 1441."

Blair said "there's not a single person on the Security Council that doubts the fact he is not fully cooperating today. Nobody, even those who disagree with the position that we have outlined, is prepared to say there is full cooperation, as 1441 demanded."

Blair said he and the other three leaders at the Azores summit "will do all we can in the short time that remains to make a final round of contacts, to see whether there is a way through this impasse. But we are in the final stages, because after 12 years of failing to disarm him, now is the time when we have to decide."

Blair said "Europe and America should stand together on the big issues of the day. I think it is a tragedy when we don't. And that transatlantic alliance is strong and we need to strengthen it still further."

Spain's Prime Minister Jose Maria Aznar said "I would like to remind you that we all said before we came here that we were not coming to the Azores to make a declaration of war, that we were coming after having made every possible effort, after having made this effort, continuing to make this effort, to working to achieve the greatest possible agreement, and for international law to be respected and for U.N. resolutions to be respected."

Aznar said it up to Saddam Hussein whether he wants to disarm and avoid the serious consequences of which he has been warned about by the United Nations.

Portugal's Prime Minister Jose Manuel Durao Barroso, who hosted the summit, said "We have joined this initiative and we organized it here in the Azores because we thought this was the last opportunity for a political solution -- and this is how we see it, this is the last possibility for a political solution to the problem. Maybe it's a small chance, a small possibility, but even if it's one in one million, it's always worthwhile fighting for a political solution. And I think this is the message that we can get from this Atlantic summit."

President Bush: We just had a great church service. Like thousands of our fellow citizens, we celebrated Easter. We celebrated with our family, but we also celebrated with members of the 4th Infantry Division military families. The 4th Infantry Division is in Iraq.

We are also here with two of -- brave Americans, two warrant officers, chopper pilots who were captured in Iraq and recently returned to their families. They were celebrating Easter with their loved ones: moms, dads, wives, brothers and sisters from around our country. So it was a glorious day.

We prayed for peace and for strength, for the many blessings. I am particularly grateful that these two men were with us today. I thank God for their lives. I hope all our fellow Americans realize that we live in a great country, full of great people. And today is a day to give blessings for America, as well as an Almighty and gracious God.

Spewing Anti-Semitism

So suggests Abraham Foxman, national director of the Anti-Defamation League, following a series of published and oral comments made by the award-winning Hollywood actor and director concerning his controversial upcoming movie about the death of Jesus of Nazareth.
"Recent statements by Mel Gibson paint the portrait of an anti-Semite," Foxman told The Jewish Week Tuesday.
While the debate has been raging for months over 'The Passion' and its negative portrayal of Jews, no mainstream Christian or Jewish community leader has until now made such a direct charge against Gibson, who is directing and financing his $30 million labor of love.
Interfaith critics instead have focused on the bloody movie, saying that by promoting the 2,000-year-old charge of Christ killers against Jews, the film would fuel anti-Semitism around the world.
It would come, they say, from people who were never taught that the Vatican officially repudiated the deicide charge against Jews nearly 40 years ago at the Vatican II conference called Nostra Aetate.
But Foxman says it is clear now that the 47-year-old Gibson, an ultra-conservative Catholic who does not accept the Vatican reforms, is spouting "classic anti-Semitism."
Foxman adds that it is clear the actor doesn't fall far from the tree. Gibson's 85-year-old father, Hutton, has been quoted as saying far fewer Jews died in the Holocaust than 6 million, and is a conspiracist who says Jews are behind recent Vatican reforms.
"There's no longer a debate where [Mel Gibson] is coming from," Foxman said Tuesday. "He is a true believer that the true story of the suffering [of Jesus] is that the Jews made him suffer."
Foxman cited Gibson's statements at an interfaith screening of 'The Passion' in Houston last month, and in the Sept. 15 issue of The New Yorker magazine. In the latter, the Oscar-winning director of 'Braveheart' portrays himself as being persecuted like Jesus for making the film, and as a victim of a murderous cabal who forced him to make changes in the film that could end his career.
Foxman notes that in the magazine, Gibson regrets excising a scene in which the high priest recites the curse from the Gospel of Matthew proclaiming that the blood of Jesus is upon him and his children.
Said Gibson: "But, man, if I included that in there, they'd be coming after me at my house, they'd come kill me," referring to the ADL and the Simon Wiesenthal Center, among other critics, correspondent Peter J. Boyer writes.
Later, Boyer reports that Gibson accuses "modern secular Judaism" of blaming "the Holocaust on the Catholic Church. And it's a lie. And it's revisionism. And they've been working on that one for a while."
"When you put those things together," said Foxman, "that is a portrait of an anti-Semite. To me this is classic anti-Semitism."
Gibson's spokesman Alan Nierob said this is the first time he's heard a charge of anti-Semitism directed at Gibson.
"It's an irresponsible statement," Nierob said. "I won't even dignify it with a response."
Foxman's declaration comes on the heels of several significant developments about the movie, slated for release next spring. Two senior Vatican officials publicly endorsed the film and made ominous statements about its critics.
The praise sheds new light on a major theological battle within the Catholic Church between progressives and conservatives over Church doctrine during the waning reign of Pope John Paul II.
Progressive Catholic scholars are criticizing the film for violating Vatican teachings about how to accurately and responsibly tell the story of Jesus' death, known as the Passion, and the Jewish role in it.
But last week Cardinal Dario Castrillon Hoyos, the top Vatican official in charge of the Congregation for the Clergy, a Vatican subcommittee charged with implementing religious decrees, hailed the movie as a "triumph of art and faith" after seeing it in Rome.
"I would like all our Catholic priests throughout the world to see this film," he told an Italian television reporter. "I hope all Christians will be able to see it and all people everywhere." He disputed the notion that the film is in any way anti-Semitic.
Further, Archbishop John Foley, an American serving in the Vatican communications office, told the Associated Press he thought the film was excellent based on trailers he saw. (Trailers can be accessed on the Internet). He doubted the validity of criticism.
"I don't think they would be well-founded criticisms because all the material in the film comes directly from the Gospel accounts. So if they're critical of the film, they would be critical of the Gospel," Archbishop Foley said.
But Rev. John Pawlikowki, director of the Catholic-Jewish Studies Program at Chicago's Catholic Theological Union, who criticized the script as being anti-Jewish and violating Church teachings last April with an ad hoc group of Catholic and Jewish scholars, said the Church officials are ignoring the real issue.
"I regret that none of the Catholic leaders Ö have addressed the substance of our critique," he told The Jewish Week Monday. "That substance is that the main story line puts the primary responsibility for the death of Jesus on the Jewish cabal led by Caiphas [the Jewish high priest]. This is contrary to the recent Catholic documents and modern biblical scholarship. Until they show in a concrete way how the script squares with these documents and with modern biblical scholarship their endorsements ring hollow."
Rev. Pawlikowski noted that neither Cardinal Hoyos nor Archbishop Foley are Vatican spokesmen on Catholic-Jewish relations. He called on Cardinal Walter Kasper, president of the Vatican's commission on Religious Relations with Jews, to address the issue.
Foxman also called on Cardinal William Keeler of Baltimore, the Church's top liaison in America to Jews , to speak out in light of the praise from the two Vatican clerics.
Foxman and ADL interfaith director Rabbi Eugene Korn met privately with Cardinal Keeler last month, when the cleric declined to publicly enter the fray over the movie.
(Catholic scholars including Sister Mary Boys of Manhattan's Union Theological Seminary and Dr. Philip Cunningham of Boston College's Center for Christian Jewish Learning met with Cardinal Keeler last week, sources told The Jewish Week.)
Foxman sent a letter Tuesday asking Cardinal Keeler to speak out now because if the public only hears the voices of Church officials supporting the movie, "people will assume the Church in fact is endorsing this film."
A spokesman for Cardinal Keeler told The Jewish Week Tuesday that he has not seen the movie nor read the script and would not comment.
However, Rabbi Korn said that Keeler privately has agreed "in principle to begin a broad educational campaign for the Catholic community to teach the correct Catholic teaching" about the Crucifixion and Judaism.
"Many people are unaware of this, and some are either knowingly or unknowingly are reverting back to old pre-Vatican II understandings.
"We have ridden into the middle of ideological war between conservative Catholics and Vatican II progressive Catholics," Rabbi Korn said. "The Catholic Church in America has to speak out very clearly about the issues this movie raises."
"One of the problems is people are going to see this film and are going to conclude that's the way it is because they don't know anything different, it's part of the religious illiteracy in our country," Sister Boys said. "We really have to find ways to educate them about interpreting Scripture more thoughtfully."

We can say that moral concepts and rules are closely related to the structure of society and morality is therefore relative, in the sense that, as the ends of each society vary, so do the standards of right or wrong. The first Ethical Laws, known to us from antiquity, are those of Hammurabi, Moses, and the Greek philosophers. In this paper, I will deal with these ethical laws in a very sketchy way, although they deserve extensive study and thorough examination. The great Code of Hammurabi (18th Century BCE) is the most complete and perfect monument of Babylonian Law. The existing text is in Akkadian (a Semitic Language). The Code was meant to be applied not to a single country, but to a wider realm. Despite a few primitive remains, relating to family solidarity, district responsibility, trial by ordeal, and the "lex talionis" or law of retaliation, the code was advanced far beyond tribal custom and recognized no blood feud, private retribution, or marriage by capture. The Code has provisions that regulate the laws concerning social classes, property, family, and Criminal Law. The Decalogue, the Ten Commandments, delivered to the Jewish people by Moses (13th Century BCE) represent the Ethical Principles of the Jewish people, which were later accepted by the civilized world. Basic to them is the interdependence of morality and religion. They forbid the deification of Nature, as well as the making of graven images, and enjoin the observance of a day of rest, to honor one's parents, respect for property, life and a woman's honor, and eschewing any deed or thought potentially inimical to one's fellow man. The Decalogue can be regarded as the text of a Covenant between G-d and Israel. Moses' impact on the Jewish faith was to communicate a revelation of G-d as a redeeming Power, who makes exclusive Ethical demands on man's will and at the same time, to build a community around that revelation.

What of R. Yehoshua Ben Perachiah? 

When John [Hyrcanus] the king killed the rabbis, R. Yehoshua Ben Perachiah [and Yeshu] went to Alexandria of Egypt.  When there was peace, Shimon Ben Shetach sent to him "From me [Jerusalem] the holy city to you Alexandria of Egypt.  My husband remains in your midst and I sit forsaken." 

[R. Yehoshua Ben Perachiah] left and arrived at a particular inn and they showed him great respect.  He said: How beautiful is this inn [Achsania, which also means innkeeper]. 

[Yeshu] said: Rabbi, she has narrow eyes. 

[R. Yehoshua Ben Perachiah] said to him: Wicked one, this is how you engage yourself? 

[R. Yehoshua Ben Perachiah] sent out four hundred trumpets and excommunicated him. 

[Yeshu] came before [R. Yehoshua Ben Perachiah] many times and said: Accept me.  But [R. Yehoshua Ben Perachiah] paid him no attention. 

One day [R. Yehoshua Ben Perachiah] was reciting Shema [during which one may not be interrupted].  [Yeshu] came before him.  He was going to accept [Yeshu] and signalled to [Yeshu] with his hand.  [Yeshu]  thought that [R. Yehoshua Ben Perachiah] was repelling him.  He went, hung a brick, and bowed down to it. 

[Yeshu] said to [R. Yehoshua Ben Perachiah]: You taught me that anyone who sins and causes others to sin is not given the opportunity to repent. 

And the master said: Yeshu {the Notzri} practiced magic and deceive and led Israel astray.

While returning, Yeshu misunderstood one of his teacher's remarks and said something that demonstrated that he was interested in and looking at married women.  As sexual promiscuity was a sign of many of the Hellenist sects, R. Yehoshua Ben Perachiah suspected his student of being yet another leader influenced by Hellenism and had him excommunicated [this hasty conclusion was condemned by the Talmud a few lines before our passage].  After many attempts by Yeshu to reconcile with his mentor, R. Yehoshua Ben Perachiah was finally ready.  However, Yeshu approached him while he was reciting Shema, the most important part of the morning prayer during which he could not stop to speak.  He motioned to Yeshu with his hand which was misinterpreted as a signal to go away.  Yeshu finally gave up and fulfilled his teacher's suspicion.  He adopted a pagan religion and went on to create his own sect of Judaism and lead many Jews astray.



Talmud Sanhedrin 43a 

It is taught: On the eve of Passover they hung Yeshu and the crier went forth for forty days beforehand declaring that "[Yeshu] is going to be stoned for practicing witchcraft, for enticing and leading Israel astray.  Anyone who knows something to clear him should come forth and exonerate him."  But no one had anything exonerating for him and they hung him on the eve of Passover. 

Ulla said: Would one think that we should look for exonerating evidence for him?  He was an enticer and G-d said (Deuteronomy 13:9) "Show him no pity or compassion, and do not shield him." 

Yeshu was different because he was close to the government.

During Yeshu's time, the reign of Alexander Janneus, the Jewish courts had the power to execute but had to be careful because the courts were ruled by the Pharisees while the king was a Sadducee.

In Sentence and Execution (Part 1 of "Death Penalty and Talmud Law") we watched the US Supreme Court create a precedent by accepting for consideration a brief based wholly on Talmud law. We watched as Israeli and American legal experts recommended that, on the issue of humanitarianism and the death penalty, that the US should use Talmud law as the exemplar.

What was missing from this presentation? The Orthodox Jewish advocates failed to mention that US and Talmud law are fundamentally incompatible.

In contrast, Talmud law insists on unequal justice under law. Talmudic law holds there is one law for Jews, and one for Gentiles. This is not inconsistent with the Old Testament, in which LORD God decrees that Jews should not enslave other Jews: Gentiles are the proper slaves of Jews.

  1. Both thy bondmen, and thy bondmaids, which thou shalt have, shall be of the heathen that are round about you; of them shall ye buy bondmen and bondmaids.
  2. Moreover of the children of the strangers that do sojourn among you, of them shall ye buy, and of their families that are with you, which they begat in your land: and they shall be your possession.
  3. And ye shall take them as an inheritance for your children after you, to inherit them for a possession; they shall be your bondmen for ever: but over your brethren the children of Israel, ye shall not rule one over another with rigour.

Leviticus 25:44-46

Laws concerning slaves — bondmen, bondmaid, bondwomen, handmaids, etc. — are found throughout the Talmud in almost every tractate. A sampling of such laws is included in the Appendix: Talmud Slavery Laws.

Gentiles Easy To Convict

Under Jewish law, Gentiles are easy to convict for capital crimes; but it is difficult to convict Jews. The standards of proof are different.

For a Jew to be convicted by a Jewish court, two eyewitnesses must have seen the perpetrator about to commit the crime and warned him of the potential penalty. The murderer must verbally answer that he chooses to proceed anyway. (For a non-Jew, only one witness is required and no verbal warning.)

Rabbi Adlerstein's statement is also confirmed by Talmud scholar and translator, Rabbi Dr. H. Freedman. In the following quotes, "Noahide" means a non-Jew. Rabbi Dr. Freedman tells us twenty-three judges must sit on a court that hears a capital case against a Jew; when a Gentile is tried on a capital charge, one (Jewish) judge is required.

  1. A Noachide is tried by one judge, and on the testimony of one witness only, and is executed even if no formal admonition preceded his offence; a Jew is tried by a court of twenty-three, on the testimony of at least two, and only after formal admonition. Moreover, a gentile is decapitated, whereas a Jew is stoned.

Laws Different for Jew and Gentile

Not only are the court procedures and the standards of evidence different from one class to the other, the very laws are different. For example, if a Jew murders a Gentile, there is no death penalty.

No Jury of Peers under Talmud Law

Talmud law does not provide for the accused to be tried by a jury of his peers. In Talmud law, the accused is tried by rabbis.

Ox Gets 23 Judges

In case there were any doubt about the place of the Gentile in Talmud law, the following excerpt from Sanhedrin 2a settles the question. Recall that a capital case against a Gentile is heard by one judge. According to Sanhedrin 2a, a capital case against an ox, a hyena, or a serpent is tried by 23 judges.

Perspective on Gentiles

A further perspective in traditional Jewish laws and attitudes concerning Gentiles is contained in What About Gentiles? (18) Of particular interest is the modern study by Rabbi David Bar-Chayim, the head of the Makhon Ben Yishai Institute for Torah Research. Israel National Radio calls Rabbi Bar-Chayim "one of Israel's Leading Torah Scholars." (19) Rabbi Bar-Chayim's essay, The Jews Are Called "Man," offers a definitive statement of the doctrines concerning Gentiles, with extensive references to many Jewish Scriptures. (20)

US Supreme Court Warms to the Talmud

Approximately three years after Nathan and Alyza Lewin filed the Bryan v. Moore amicus curiae brief — a notable event in itself — another notable event took place. A kosher dinner was held to honor the establishment of the National Institute for Judaic Law (NIJL). The dinner was attended by 200 people, including Supreme Court Justices Ruth Bader Ginsberg, Stephen Breyer, Antonin Scalia. Nathan and Alyza Lewin also attended.

The site of the dinner? The United States Supreme Court Building in Washington, DC. The Jewish Week reported the event in this manner:

What does the Talmud have to say about legal and moral controversies in modern America?
Plenty, according to the creators of the new Washington-based National Institute for Judaic Law, which opened with a lavish Supreme Court dinner last month.
Some Orthodox activists say they can't figure out exactly the point of the whole thing. But Noson Gurary, a Lubavitch rabbi who came up with the idea and won backing from some top Jewish legal experts, harbors no doubts.

Noson Gurary is an ordained rabbi of the Chabad Lubavitch sect, and follower of late Rabbi Menachem Mendel Schneerson. Chabad Lubavitch is a movement within the Hasidic (sometimes spelled "Chasidic") branch of Judaism. Rabbi Gurary is the executive director of Chabad of Buffalo, New York. (3) He is co-author of several books on Hasidic and Chabad Lubavitch philosophy. (7) Hasidism embraces a Kabbalistic concept of God, the Ein-Sof, (8), a power reminiscent of "The Force" in George Lucas' Star Wars.

Coming from Where We've Never Been

The Jewish Week explains more of the NIJL project. In the following paragraph, macher is a Yiddish word meaning "big shot," a person with access to authorities. (10)

According to Gurary, the group, which has hired two researchers to compile reports, will focus initially on the issue of business ethics. Eventually, the goal is to compile a library and database in Washington that will offer Jewish law insights into a host of contemporary issues and to help create courses on the subject at law schools nationwide. The institute will also inaugurate a monthly lunch series for legal machers in Washington.

The Jewish Week continues:

"It will be an eye opener for judges, scholars and law students," he told The Jewish Week. "Before you know where you're going, you have to know where you came from. And Jewish law is the basis of our legal system in America." …
Gurary, who teaches at the University of Buffalo law school, said his target audience includes judges around the country and law students, not politicians and lawmakers.
"And as a teacher of Judaic studies, I began to see the excitement of students who were being exposed to Jewish law for the first time, who now had a better understanding of where Western law come from," Gurary said.

It is a safe bet that all of Rabbi Gurary's students had been exposed to the Ten Commandments before, and none were encountering them "for the first time" in his classroom. Hence, Rabbi Gurary's term "Jewish law" must refer to Talmud law rather than Biblical law. Thus, Rabbi Gurary's statement reads that Western law "came from" Talmud law — and that is patently false. The sources for law in Europe and America include Roman law, Anglo-Saxon law, and the Western philosophers of Liberty. Neither American nor European law has ever institutionalized legal superiority of Jew over Gentile.

Bush Approves Talmudization of America

The Jerusalem Post reported the November 2002 kosher dinner as follows:

Jewish legal experts have created a new institute that will educate jurists and others about 2,000 years of Jewish law and promote the application of the teachings to contemporary legal disputes and other modern- day issues …
US President George W. Bush sent greetings and applauded the institute for promoting an "understanding of Judaism's rich tradition of legal thought."
"As we face new challenges and welcome new opportunities, our society must continue to promote good character and strong values. Through the study and teaching of Jewish law and philosophy you are contributing to a growing culture of service, citizenship, and responsibility in America," Bush wrote.

Justice Scalia Is a Key Player

The Jerusalem Post reports that Justice Antonin Scalia has high praise Jewish law.

Scalia, in a letter to the institute's founder, Noson Gurary, wrote that "Jewish law is certainly one of the oldest and most highly developed systems" and explained why the comparative study of legal traditions was beneficial.

In fact, Rabbi Gurary came up with the idea of the Institute as a result of correspondence with Justice Scalia:

Gurary said that the idea for the institute came in an exchange of letters in which Supreme Court Justice Antonin Scalia, one of the most conservative Justices, expressed his "fascination with Jewish law."

Justice Scalia has sworn an oath to uphold the Constitution and its Bill of Rights. Yet, by his attendance at this dinner he clearly indicated his support for an antithetical system: Talmud law. How does he reconcile the two? We are not told.

Talmud vs. Old Testament

Some non-Jews take the position that the Talmud perverted the Old Testament teachings. See, for example, Chapter I of Elizabeth Dilling's The Jewish Religion: It's Influence Today. The question then becomes: If the Talmud perverted Jewish law, what is real, un-perverted Jewish law — the Jewish law of the Old Testament? What was the quality of justice that pervaded the mind-set of the ancient Jews? Should we in America emulate that Old Testament sense of justice?

We have prepared a sampling of Old Testament passages in a compendium called In His Own Image. (21) Let us examine an incident described in Genesis 34.

Shechem is a Gentile, a Hivite. Jacob's daughter, Dinah, catches his eye. Under circumstances not fully described, Shechem seduces Dinah. Shechem loves Dinah tenderly and wants her as his wife. He offers to give any dowry asked for her, and suggests to Jacob's family that their two tribes be joined. While harboring vengeance in their hearts, Jacob's sons (the progenitors of the Tribes of Israel) deceitfully agree to the merger, but insist that the Hivite men be circumcised. The Hivites agree. While the Hivite men are recovering from the operation and still in pain, the Hebrews attack the city, kill all the men, and take the women and children as captives — slaves.

  1. And Dinah the daughter of Leah, which she bare unto Jacob, went out to see the daughters of the land.
  2. And when Shechem the son of Hamor the Hivite, prince of the country, saw her, he took her, and lay with her, and defiled her.
  3. And his soul clave unto Dinah the daughter of Jacob, and he loved the damsel, and spake kindly unto the damsel.
  4. And Shechem spake unto his father Hamor, saying, Get me this damsel to wife.
  5. And Jacob heard that he had defiled Dinah his daughter: now his sons were with his cattle in the field: and Jacob held his peace until they were come.
  6. And Hamor the father of Shechem went out unto Jacob to commune with him.

Genesis 34:1-18, 24-31

While many religions frown on sex before marriage, most of us understand that unmarried sex happens. If a man — or even the son of the prince — slept with our sister before marriage, few of us would think it appropriate to murder all the other men in the city, loot the fields and buildings, and take the women and children into slavery. Nor is it likely, having done such a thing, that we would find a sympathetic judge or jury to hear our case. In short, what we have here is a very different concept of justice — so different that many of us could not agree it should be called "justice." The Bible passage shows that:

  1. Shechem, a Gentile, is not accused of using force or violence on Dinah
  2. Shechem declared his love for Dinah, and pleaded for her as his bride
  3. Shechem asked Jacob to name any dowry he would like
  4. Shechem expressed his good will toward Jacob's tribe, offering a merger of wealth and fortunes
  5. Jacob's sons responded deceitfully, pretending friendship and planning murder
  6. Jacob's sons slew other men who were not implicated in the seduction
  7. The women and children taken in slavery were blameless victims — of Jacob's sons
  8. Between the time that Shechem came to Jacob and the time that Dinah was taken from Shechem's house, there were approximately three days. During that time, Jacob and his sons knowingly permitted Dinah to be "defiled" without protest. In consideration of the treasure and slaves looted from the city, did not Jacob and his sons "deal with [their] sister as with an harlot?"


Jacob's final statement on the issue is particularly telling: He complained to his sons that they had put him at odds with the local tribes, and they might retaliate. In no other way did Jacob find fault with their actions.

We have examined each of the Soncino Scriptural index entries for Genesis Chapter 34: there are no comments from the Sages on the injustice in this incident. All apparently approve of the actions of their ancestors.

This is the Old Testament tradition, repeated over and over again through many narratives, as cited in In His Own Image. In particular, note the fate of those who do not follow the Hebrew religion — they are put to death. Is this the tradition of law and justice for which we should trade our Bill of Rights?

A Little Beacon of Light

Many defend the Old Testament because, they say, it contains commandments that regulate human interaction and produce an ordered society. But earlier civilizations had codes of law regulating human society. See, for example, the Code of Hammurabi, who reigned in Babylon between 1795 and 1750 BC. (12) Moses received the Tablets of Stone in 1275 BC. (13) Hammurabi's Code was on public display approximately 500 years before LORD God's conversation with Moses on Mt. Sinai.

In its report of the November, 2002 kosher dinner at the Supreme Court, The Jerusalem Post quotes Rabbi Gurary thus:

By demonstrating the philosophy of Jewish law and its moral values, we can bring a little beacon of light to this world.

Warned 2 Hours Before 911

Odigo, the instant messaging service, says that two of its workers received messages two hours before the Twin Towers attack on September 11 predicting the attack would happen, and the company has been cooperating with Israeli and American law enforcement, including the FBI, in trying to find the original sender of the message predicting the attack.
Micha Macover, CEO of the company, said the two workers received the messages and immediately after the terror attack informed the company's management, which immediately contacted the Israeli security services, which brought in the FBI.
"I have no idea why the message was sent to these two workers, who don't know the sender. It may just have been someone who was joking and turned out they accidentally got it right. And I don't know if our information was useful in any of the arrests the FBI has made," said Macover. Odigo is a U.S.-based company whose headquarters are in New York, with offices in Herzliya.

U.S. Concerned by Syria's WMD Capabilities, Support for Terror

Bolton cites "hostile actions" toward Coalition forces in Iraq

The United States views with "serious concern" Syria's expanding weapons of mass destruction (WMD) capabilities and its continued state sponsorship of terrorism, the State Department's top arms control official says.

Testifying September 16 before a House International Relations subcommittee, Under Secretary of State for Arms Control and International Security John Bolton said Syria also has taken "a series of hostile actions" toward Coalition forces in Iraq.

He said Syria allowed military equipment to flow into Iraq on the eve of and during the war, and has "permitted volunteers to pass into Iraq to attack and kill our service members during the war, and is still doing so."

"Although Damascus has increased its cooperation regarding Iraq since the fall of the Iraqi regime," the under secretary said, "its behavior during Operation Iraqi Freedom underscores the importance of taking seriously reports and information on Syria's WMD capabilities."

Referring to press reports that Iraq covertly transferred weapons of mass destruction to Syria in an attempt to hide them from U.N. inspectors, Bolton said the United States sees the reports "as cause for concern," but has thus far been unable to confirm them. "We are continuing ... to seek conclusive evidence," he said, and have raised the issue with the Syrians "on numerous occasions."

Bolton said the United States is concerned about Syria's nuclear research and development program and continues to watch for any signs of nuclear weapons activity. He noted that Syria has not yet signed the International Atomic Energy Agency's Additional Protocol, which strengthens the IAEA's investigative powers to verify compliance with nuclear safeguards, adding: "We believe the Additional Protocol should be a new minimal standard for countries to demonstrate their nonproliferation bona fides."

He said Syria has "one of the most advanced Arab state chemical weapons capabilities" and is continuing to develop an offensive biological weapons capability. In addition, Syria has "a combined total of several hundred Scud and SS-21 SRBMs [short-range ballistic missiles], and is believed to have chemical warheads available for a portion of its Scud missile force."

Commenting on the Syria Accountability Act -- legislation proposed by members of Congress to impose restrictions on the export of U.S. goods to Syria, Bolton said that existing sanctions laws and an Executive Order promulgated in 1994 already provide "a broad mandate" for the administration to use sanctions to deter proliferation activity by rogue states and serial proliferators.

He stressed that nonproliferation standards "are all too often ignored and flagrantly violated" by governments seeking WMD as a means of enhancing their security and international influence, and "many of these governments are resistant to conventional diplomatic dialogue."

"While we pursue the diplomatic track whenever possible, the United States and its allies must be willing to deploy more robust techniques, such as economic sanctions, as well as interdiction and seizure, or other means," he said. "The pursuit of WMD and ballistic missile delivery systems, especially by state sponsors of terrorism, must be neither cost-free nor successful."

Bolton called interdiction efforts "key to a comprehensive nonproliferation strategy." He cited in particular the Proliferation Security Initiative (PSI) announced by President Bush in May -- "a global multilateral arrangement to seize sensitive cargoes that may be in transit to and from states and non-state actors of proliferation concern."

He said the United States and 10 other countries reached agreement in Paris September 4 on a Statement of Interdiction Principles, which "represents the shared political commitment of these countries to strengthen efforts to combat the proliferation threat.

"The United States welcomes support for the PSI Principles of all states that share our concerns about proliferation and our resolve to take new and active measures to defeat this threat."

Thank you, Madame Chairwoman and members of the Committee, for the opportunity to appear before you today to discuss Syria's weapons of mass destruction [WMD] and missile development programs. I understand that we will have a brief open hearing now and a closed session later today.

Syria remains a security concern on two important counts: terrorism and weapons of mass destruction. I will focus on the latter, although the potential linkages are obvious. Specifically, our Coalition's operations in Iraq showed that this administration and the international community take the link between terrorism and WMD most seriously. There is no graver threat to our country today than states that both sponsor terrorism and possess or aspire to possess weapons of mass destruction. Syria, which offers physical sanctuary and political protection to groups such as Hizballah, HAMAS, and Palestinian Islamic Jihad, and whose terrorist operations have killed hundreds of innocent people -- including Americans -- falls into this category of states of potential dual threat. While there is currently no information indicating that the Syrian government has transferred WMD to terrorist organizations or would permit such groups to acquire them, Syria's ties to numerous terrorist groups underlie the reasons for our continued anxiety.

Without question, among rogue states, those most aggressively seeking to acquire or develop WMD and their means of delivery, and which are therefore threats to our national security, are Iran and North Korea, followed by Libya and Syria. It is also the case that these states are among those we identify as state sponsors of terrorism. We aim not just to prevent the spread of WMD, but also to "roll back" and ultimately eliminate such weapons from the arsenals of rogue states and ensure that the terrorist groups they sponsor do not acquire weapons of mass destruction. As President Bush has said repeatedly, we will stress peaceful and diplomatic solutions to the proliferation threat. However, in order to roll back proliferation and protect innocent American citizens, as well as our friends and allies, we must allow ourselves the option to use every tool in our nonproliferation toolbox.

Obviously, many of you share these concerns. Members of this committee have sponsored the Syria Accountability Act, which would impose restrictions on the export of U.S. goods to Syria, as well as other measures. However, we already possess a broad mandate to sanction countries like Syria for proliferation activities under Executive Order 12938. This Executive Order, promulgated in 1994, requires the imposition of sanctions against foreign countries that have used chemical or biological weapons in violation of international law or have developed, produced, stockpiled or otherwise acquired chemical or biological weapons in violation of international law. The Executive Order requires denial of foreign assistance; denial of credit or financial assistance from U.S. government agencies; U.S. opposition to multilateral development bank assistance; denial of defense exports and national security-sensitive exports; restrictions on imports into the U.S.; and a termination of aircraft landing rights. Many of these same penalties are duplicated in the proposed Syria Accountability Act.

Additionally, Section 4 of E.O. 12938, as amended in 1998, authorizes penalties against entities that have "materially contributed or attempted to contribute materially to the efforts of any foreign country, project, or entity of proliferation concern to use, acquire, design, develop, produce, or stockpile weapons of mass destruction or missiles capable of delivering such weapons...." Penalties can include a ban on imports into the U.S. of goods, technology, or services produced by the sanctioned entity; a ban on U.S. procurement from these entities; and a ban on U.S. assistance. In addition, we have frequently augmented these penalties with a ban on defense exports to the entity in question.

The standard for acts triggering these measures under the Executive Order is very broad, and gives the decision-maker wide scope in punishing entities that choose to engage in proliferant behavior. Just in this year, we have imposed E.O. 12938 sanctions five times, including on the Chinese entity, North China Industries Corporation (NORINCO), and the Iranian entity, Shahid Hemmat Industrial Group. This administration views sanctions as a useful tool for furthering our nonproliferation objectives and is determined to enforce existing sanctions laws to the fullest extent. The existing sanctions laws and the Executive Order, when properly applied, give the administration the authority and flexibility to use sanctions to deter proliferation activity by rogue states and serial proliferators. Since I began serving in my present position, I have insisted on using the mandatory sanctions laws in the manner Congress intended.

Nonproliferation standards are all too often ignored and flagrantly violated by governments that view WMD as a means of enhancing their security and international influence. Many of these governments are resistant to conventional diplomatic dialogue. While we pursue the diplomatic track whenever possible, the United States and its allies must be willing to deploy more robust techniques, such as economic sanctions, as well as interdiction and seizure, or other means. The pursuit of WMD and ballistic missile delivery systems, especially by state sponsors of terrorism, must be neither cost-free nor successful. Proliferators -- and especially states still deliberating whether to seek WMD -- must understand that they will pay a steep price for their efforts. In short, if the language of persuasion fails, these states must see and feel the logic of adverse consequences. Moreover, adverse consequences must not only fall on the states aspiring to possess these weapons, but also on the states supplying them.

In situations where we cannot convince a state to stop proliferant behavior, we also have the option of interdicting shipments to ensure the technology does not fall in to the wrong hands. These interdiction efforts are key to a comprehensive nonproliferation strategy. Interdiction involves identifying an imminent shipment or transfer and working to impede the shipment. As the president noted in his National Strategy to Combat Weapons of Mass Destruction, we must enhance the capabilities of our military, intelligence, technical, and law enforcement communities to prevent the movement of WMD materials, technology, and expertise to hostile states and terrorist organizations.

On May 31, President Bush announced the Proliferation Security Initiative (PSI), a global multilateral arrangement to seize sensitive cargoes that may be in transit to and from states and non-state actors of proliferation concern. Since then, we have been working with 10 other countries -- Australia, France, Germany, Italy, Japan, The Netherlands, Poland, Portugal, Spain, and the UK -- to develop a set of "principles" that identify practical steps necessary to interdict shipments of weapons of mass destruction, their delivery systems, and related materials at sea, in the air, or on land. The 11 countries met in Madrid in June, and in Brisbane in July. On September 4 in Paris, we reached agreement and announced a Statement of Interdiction Principles. This represents the shared political commitment of these countries to strengthen efforts to combat the proliferation threat. The United States welcomes support for the PSI Principles of all states that share our concerns about proliferation and our resolve to take new and active measures to defeat this threat. Proliferators are using increasingly sophisticated and aggressive measures to defeat export controls and obtain technologies for their WMD or missile programs; we need to enhance our ability to prevent them from making these acquisitions. There exists a widespread consensus that this menace, together with terrorism, constitutes the greatest challenge to international security generally and to our national security in particular.

It is important to stress that all interdiction activities conducted by PSI partners will be consistent with relevant national and international authorities. Importantly, substantial national and international authorities for interdiction already exist. In the event that a proliferator succeeds in circumventing export controls and a shipment of WMD or missile-related technology is discovered to be en route, PSI participants will explore how best to use the full range of counterproliferation tools -- from diplomatic, to intelligence, to operational -- to stop proliferation at sea, in the air, and on land. Properly planned and executed, interception of critical technologies while en route can prevent hostile states and non-state actors from acquiring these dangerous capabilities. At a minimum, interdiction can lengthen the time that proliferators will need to acquire new weapons capabilities, increase the cost, and demonstrate our resolve to combat proliferation.

The Paris meeting also continued work on the modalities for interdiction, in particular effective information sharing and operational capabilities for interdictions. Efforts to enhance our collective operational capabilities for action are essential. In support of this goal, PSI participants have agreed on a series of 10 sea, air, and ground interdiction training exercises to occur into 2004. Australia just organized and executed one such exercise a few days ago in the Coral Sea, called "Pacific Protector," that involved both military and law enforcement assets. Four PSI partners, including the United States, sent vessels to the exercise, and all PSI partners were involved in some capacity.

Our long-term objective with the Proliferation Security Initiative is to create a web of counterproliferation partnerships that will impede trade in WMD, delivery systems, and related materials. To do so, we seek eventually to broaden participation in the PSI to include all like-minded countries that want to cooperate and can contribute actively to interdiction efforts. WMD and missile proliferation is a global problem that requires a global effort, and this initiative is not directed at any one country or region. It is global in scope. A robust interdiction effort requires cooperation with all like-minded countries -- those who are leaders in nonproliferation as well as those who may have a direct relationship with proliferation activities. We want to ensure that countries make full use of their capabilities and authorities to interdict shipments. By working together, the combined sum of our efforts will be greater than the individual parts. I am encouraged by our progress on the PSI, and know that the PSI will be an important tool that we can use to counter the efforts of countries such as Syria that are often dependent on foreign suppliers in their quest to possess WMD.

Before I address the specifics of Syria's WMD programs, let me first discuss press reports that Iraq covertly transferred weapons of mass destruction to Syria in an attempt to hide them from U.N. inspectors and Coalition forces. We have seen these reports, reviewed them carefully, and see them as cause for concern. Thus far, we have been unable to confirm that such transfers occurred. We are continuing with the full breadth of resources at our command to seek conclusive evidence that any such transfer has taken place. We have raised with the Syrians on numerous occasions, even before military action against Iraq, the seriousness with which we would view any transfer of Iraqi dual-use or military related items into Syria.

We have seen Syria take a series of hostile actions toward Coalition forces in Iraq. Syria allowed military equipment to flow into Iraq on the eve of and during the war. Syria permitted volunteers to pass into Iraq to attack and kill our service members during the war, and is still doing so. Syria continues to provide safe haven and political cover to Hizballah in Lebanon, which has killed hundreds of Americans in the past. Statements from many of Syria's public officials during this time vilified the Coalition's motives in seeking to overthrow Saddam Hussein. Indeed, the United States portrayed as an enemy is a consistent theme found in newspapers and public statements in Syria, as it is in other states in the region. Although Damascus has increased its cooperation regarding Iraq since the fall of the Iraqi regime, its behavior during Operation Iraqi Freedom underscores the importance of taking seriously reports and information on Syria's WMD capabilities.


As I informed Congress last fall, we are concerned about Syria's nuclear R&D [research and development] program and continue to watch for any signs of nuclear weapons activity or foreign assistance that could facilitate a Syrian nuclear weapons capability. We are aware of Syrian efforts to acquire dual-use technologies -- some, through the International Atomic Energy Agency (IAEA) Technical Cooperation program -- that could be applied to a nuclear weapons program. In addition, Russia and Syria have approved a draft program on cooperation on civil nuclear power. Broader access to Russian expertise could provide opportunities for Syria to expand its indigenous capabilities, should it decide to pursue nuclear weapons. The Syrians have a Chinese-supplied "miniature" research reactor under IAEA safeguards at Dayr Al Hajar.

Syria is a party to the Non-Proliferation Treaty, and has a standard safeguards agreement with the IAEA but, like Iran, has not yet signed or, to our knowledge, even begun negotiations on the IAEA Additional Protocol. The Additional Protocol is an important tool that, if fully implemented, could strengthen the IAEA's investigative powers to verify compliance with NPT safeguards obligations and provides the IAEA with the ability to act quickly on any indicators of undeclared nuclear materials, facilities and activities. We believe the Additional Protocol should be a new minimal standard for countries to demonstrate their nonproliferation bona fides.


Since the 1970s Syria has pursued what is now one of the most advanced Arab state chemical weapons (CW) capabilities. It has a stockpile of the nerve agent sarin that can be delivered by aircraft or ballistic missiles, and has engaged in the research and development of more toxic and persistent nerve agents such as VX.

Syria is fully committed to expanding and improving its CW program, which it believes serves as a deterrent to regional adversaries. Syria continues active chemical munitions testing, although it has not used chemical agents in any conflicts. Although Syria is more self-sufficient than most other third-world CW capable states, foreign assistance has been a key element in the establishment and operation of Syria's CW program. In particular, Syria remains heavily dependent on foreign sources for key elements of its chemical warfare program, including precursor chemicals and key production equipment. As a result Syria will need to continue foreign procurement activities -- something the PSI is designed to counter -- in order to continue its CW program. Syria is not a party to the Chemical Weapons Convention.


We believe that Syria is continuing to develop an offensive biological weapons capability. Syria has signed, but not ratified, the Biological Weapons Convention. These "poor man's nuclear weapons" do not require a large production capability, and depending on the agent and dissemination method, can be extremely lethal.


Syria has a combined total of several hundred Scud and SS-21 SRBMs [short-range ballistic missiles], and is believed to have chemical warheads available for a portion of its Scud missile force. Syria has also developed a longer-range missile -- the Scud D -- with assistance from North Korea. Syria's missiles are mobile and can reach much of Israel from positions near their peacetime garrisons and portions of Iraq, Jordan, and Turkey from launch sites well within the country. Damascus is pursuing both solid- and liquid-propellant missile programs and relies extensively on foreign assistance in these endeavors. North Korean and Iranian entities have been most prominent in aiding Syria's recent ballistic missile development. Syrian regional concerns may lead Damascus to seek a longer-range ballistic missile capability such as North Korea's No Dong MRBM [medium-range ballistic missile].

Advanced Conventional Weapons

Damascus has sought to acquire Russian SA-10 and SA-11 air defense systems, MiG-29 and Su-27 fighters, and T-80 or T-90 main battle tanks, as well as upgrades for the aircraft, armored weapons, or air defense systems already in its inventory. But its inability to fund large purchases and its outstanding debt to Russia have curbed substantial upgrades and acquisitions.


Of course, I will have much more to say on all of these subjects during the closed hearing, and I look forward to a more specific and detailed discussion than we can have in an open hearing. As we all recognize, the importance of protecting and preserving vital intelligence sources and methods necessarily and properly restricts what we can say publicly. Nonetheless, the conduct of national security requires that we take all available information into account, which I believe we will be able to do in a classified session.

When the world witnessed the destructive potential of terrorism on September 11, we were reminded of the need to remain steadfast in recognizing emerging threats to our security. In Syria we see expanding WMD capabilities and continued state sponsorship of terrorism. As the president has said, we cannot allow the world's most dangerous weapons to fall into the hands of the world's most dangerous regimes, and will work tirelessly to ensure this is not the case for Syria.

Meet Hillary Clinton's Grandmother, Della Rosenberg -- The Feisty Wife of a Yiddish-Speaking Jewish Immigrant
As she embarks on her campaign to represent New York in the Senate, Hillary Rodham Clinton will be able to tap a little-known aspect of her family background -- her maternal grandmother was married to a Russian-born Jew (Sofiet) named Max Rosenberg, and Mrs. Clinton's half-aunt, Adeline Friedman, was a Jew who was interred at a Jewish mortuary.

While Mrs. Clinton has been the subject of at least three book-length biographies and numerous newspaper and magazine profiles, the colorful story of the first lady's grandmother, a feisty woman who carried the name Della Rosenberg, has until now been unknown even to many of Mrs. Clinton's closest friends. After the Forward asked about the matter this week, Mrs. Clinton said through a spokesman that she had "very fond memories" of Max Rosenberg. Two members of the Rosenberg family told the Forward this week that Mrs. Clinton remained in contact with her half-aunt Adeline until Adeline's death last year.

Forward reporter Seth Gitell, who wrote the story, also insisted the story came from a tipster, not from Clinton's team. Giuliani refused to comment on whether the report was meant to draw Jewish support, saying he had "no idea." But City Hall insiders were outraged.

"This is pandering to the nth degree," said one insider. "What's next? Hillary in front of Zabar's with a bagel and a shmeer?" Adeline Rosenberg's stepson, David Friedman, told The Post Clinton was always close with his stepmother - who attended the president's 1993 inauguration.

A recent revelation came from the man who commanded the NATO forces in Serbia and was Supreme commander in Europe, General Wesley Clark. Addressing a group of Russian Yeshiva students in Brooklyn some time ago, he proudly disclosed that he is “the oldest son of the oldest son of more than five generations of Rabbi’s from Minsk”. (Yet another Talmudic Boshevik Sofiet Infiltrator) He was raised as a Southern Baptist and converted to Roman Catholicism in adulthood, and during an interview he claimed that according to his grandmother he is a Cohen, a member of the priestly class. Obviously, he has not learned that this privilege is derived from the paternal line. Clark, who grew up in Little Rock Arkansas, said he is proud of his family, his cultural heritage and has always found kinship with the Jewish community. Who knows, he may be preparing early to enter the next presidential race where the sizable Jewish vote is much sought after. If so, he would do well to befriend one of the syndicated newspaper columnists who are sympathetic to the Jewish cause. One much respected such journalist, - Ann Landers, - reminded her readers that it’s a free world, and you don’t have to like Jews if you don’t want to, but if you are going to be an anti-Semite, you should be consistent and turn your back on the medical advances that Jews have made possible.

Booting the Mouth?: Rep. Jim Moran, the Virginia Democrat who embarrassed his party with remarks last spring claiming that the Jewish community was pushing the country into the Iraq war, is being quietly undermined by congressional Democrats, according to an aide of one of his primary opponents.

Rick Ally, campaign manager for Moran challenger Andy Rosenberg, told the Forward, "In a Democratic primary, other elected officials will sit it out. Behind closed doors, they're saying it's about time. Under the radar, folks have been helping [us]."

Ally declined to name any officials who are helping Rosenberg's campaign. He said that Rosenberg, 35, a lobbyist for the Washington powerhouse Patton Boggs, would assemble a district-wide coalition based on support from Jews, African Americans, senior citizens and others, such as those who work for "a number of federal contractors who are quite angry with the lack of representation" they've been getting from Moran.

Ally pointed to Rosenberg's experience on Capitol Hill as a staffer for Senator Ted Kennedy and said that he has the experience on district issues such as jobs, transportation, prescription drugs and taxes. Ally painted another of the primary contenders, Kate Hanley, chairwoman of the Fairfax County Board of Supervisors, as a candidate whose time has past. "Hanley is liked for her service, but she doesn't bring fresh ideas," Ally said. "That's where Andy can separate himself." He said that a recent Washington Jewish Week article reporting that Jews in the district were coalescing around Hanley was erroneous. "They're terrific people," Ally said of the Hanley supporters quoted in the piece, "and we don't want to step on their toes, but they do not represent the Jewish coalition throughout the district. They're friends of Kate Hanley."

Moran, known for having an advanced case of foot-in-mouth disease, repeatedly and profusely apologized for his remarks about the Iraq war, which caused a brouhaha when they hit the press last March. "If it were not for the strong support of the Jewish community for this war with Iraq, we wouldn't be doing this," Moran was quoted in the press as saying then. The seven-term lawmaker, who often has clashed with pro-Israel activists over Middle East issues, reportedly added: "The leaders of the Jewish community are influential enough that they could change the direction of where this is going. And I think they should."

Moran's spokesman did not supply a response by press time.

Republican Religion: In advance of the 2004 Republican National Convention in New York City, the New York Republican State Committee is planning a massive voter registration drive targeted at Latinos to coincide with the September opening of its storefront office in the heavily Latino neighborhood of Washington Heights. "We expect to make an all-out effort to reach Hispanics throughout the five boroughs who want to register to vote, and to vote Republican," the committee's executive director, Bill MaGahay, told the Forward.

A preview of the office was one of the highlights of the Republican National Committee meeting held in Manhattan last week, which plotted the convention to be held in the Big Apple in August 2004. RNC convention manager Bill Harris was one of the officials who made the trek up to the upper Manhattan office, prompting talk that President Bush would visit the venue during the convention. MaGahay declined to speculate on such a visit, saying only, "Governor [George] Pataki is a rock star in Washington Heights. George Bush, once people get to know him up there, will be very popular too."

RNC members descended on Manhattan last week like a band of evangelists filled with zeal to bring the good news of the Grand Old Party to the benighted Democratic precincts of Gotham. "This is a political mission," a committee member from Arizona, Mike Hellon, told the Forward. "We are here to recruit Democrats who really should be Republicans but don't know it."

Senate Majority Leader Bill Frist, Mayor Michael Bloomberg, former mayor Rudolph Giuliani and Pataki addressed the group, which met at the Waldorf-Astoria Hotel. Frist, in compassionate conservative mode, talked about AIDS. Bloomberg touted New York City as a destination for immigrants, saying they were ripe for the Republican message because they crave "opportunity." Giuliani told 9/11 stories. Pataki, swimming hard to climb back on the national Republican boat, gave his version of the gospel of low taxes. The RNC elected lobbyist Ed Gillespie as its new chairman, replacing former Montana governor Mark Racicot, who became chairman of the president's re-election campaign. Gillespie gave a hard-hitting speech that accused the Democratic presidential contenders of being nattering nabobs of negativism on Iraq and terrorism. "The once-proud party of Franklin Roosevelt, who courageously told us 'we have nothing to fear but fear itself,' now seems to have nothing to offer but fear itself," he said.

Gillespie also announced that he would seek to increase voter registration, unveiling an elephant-shaped trophy called the "Chairman's Cup" that will go to the state party that best meets its registration goals.

Racicot, speaking to reporters Friday after his low-key speech, called the anger some of the Democratic candidates have been venting at Bush "a reflection of a certain amount of arrogance. They don't believe someone with a set of values so crystal clear... could be so pervasively endorsed by the American people." He described the recent drop in Bush's poll numbers to "natural settling" after the bounce of the war but predicted a close election because "the country is evenly divided."

Democrats rolled their eyes at the Republican incursion. Informed that Pataki had predicted from the podium that New York would be in the GOP column in 2004, state Democratic chairman Herman "Denny" Farrell retorted, "That's why Pataki signed the [Van Cortlandt Park] filtration bill. There's something in the water they're drinking."

In one sidelight, some Republican committee members tsk-tsked in the local press about the murder at City Hall last Wednesday of New York City Councilman James Davis, which happened on the first day of their meeting. One New York Democratic operative indignantly noted the hypocrisy of such statements: "The very afternoon that there was bloodshed at City Hall, Bush was in the White House awarding [National Rifle Association poster boy] Charlton Heston the Medal of Freedom!" he said.

Westchester Winner: Former Vermont governor Howard Dean ran away with the vote in the presidential straw poll taken July 20 at the summer picnic of the Democratic Party in New York's suburban Westchester County, a state bellwether. With 188 votes cast, Dean received 77 (41%), while the next runner up, Massachusetts Senator John Kerry, polled 55 votes (29%), according to the Democrats' newsletter, NewsFlash. Tied for third, with 11 votes (6%) each, were North Carolina Senator John Edwards and retired general Wesley Clark, who is not a declared candidate. No other candidate exceeded 10 votes. Representatives of the Dean, Edwards, Kerry and Rep. Dennis Kucinich campaigns addressed the gathering, which drew politicos including county executive Andrew Spano, New York State Democratic Committee chief Farrell, and Reps. Nita Lowey and Eliot Engel.

Kerry's loss to Dean was seen locally as a snub of Kerry's New York campaign chairman, unsuccessful 2002 candidate for lieutenant governor — and former Westchester County Democratic chairman — Dennis Mehiel.

Mideast Maneuver: A number of officials of the Republican Jewish Coalition accompanied House Majority Leader Tom DeLay on his trip to Israel this week. Among them were RJC national chairman Sam Fox, past chairmen Richard Fox, Cheryl Halpern and George Klein, board members Ned Siegel, Eliot Lauer and Fred Zeidman, and executive director Matt Brooks. DeLay met Prime Minister Sharon during the trip, took a helicopter tour of Israel's borders, visited the Western Wall, Yad Vashem and Hadassah Hospital, and attended a party for children of victims of terror. "The Israelis have treated him like he's their best friend, like he's a head of state," Zeidman said by phone from Jerusalem. Congressional Democrats plan a trip in August for 29 lawmakers who have never made the jaunt, according to The Washington Post.

Crown Heights Councilman?: The murder of New York City Councilman James Davis by a political rival at City Hall last week has thrown open the political future of Crown Heights, the Brooklyn district Davis represented. The district, which encompasses the world headquarters of the Lubavitcher chasidim and was the site of the anti-Jewish riot that killed a yeshiva student in 1991, does not need a special election to fill the seat, however, since fewer than 90 days remain before the primary in what was the last year of Davis's term. Among the contenders to succeed Davis is one Orthodox Jew, Abraham Wasserman, who told the Forward that he would run on the Conservative line. He has no chance, some said. "That district is the most stratified in the city — it has Orthodox Jews, Asians, Caribbean people," said political consultant Hank Sheinkopf. "Set a Jew in that seat? No."

Westhampton Words: Connecticut Senator Joseph Lieberman spoke for about 20 minutes on the Torah portion of the week, Matot-Masei, at The Hampton Synagogue last Saturday. The presidential hopeful, spending the weekend in the posh Long Island Hamptons resort area, used the portion's discussion of vows and pledges as a springboard to talk about the vows and pledges involved in the American-Israeli friendship, according to the Orthodox synagogue's rabbi, Marc Schneier. Schneier said that Lieberman was so overwhelmed by his reception at the synagogue that he quipped that Westhampton Beach would be on the short list for any Lieberman summer White House.

Kosher Congressman: In more religion news, Rep. Peter Deutsch, the Florida Democrat who would like to succeed presidential aspirant Bob Graham as senator from the Sunshine State, is exercising his Jewish credentials. Deutsch will speak August 2 on "Observance, Kashrut & Shabbat as a Member of Congress" at Chabad of Southampton Jewish Center, another Orthodox synagogue in the Hamptons.

In 1980 the U.S. Congress legislated the establishment of an Intergovernmental Advisory Council on Education. The members of this council were appointed by President Jimmy Carter and chaired by Governor Bob Graham of Florida. The Lubavitch lobby in Capitol Hill determined that they should not miss the opportunity to be included in this program, and through the agency of influential friends such as businessman David T. Chase and Senator Joseph Lieberman, they managed to have President Carter appoint Rabbi Abraham Shemtov, who was Schneerson's liaison to the White House as a member of this council.

John Kerry is a Landsman

Presidential hopeful John Kerry is a half-Jew.

Earlier this week the Massachusetts Senator discovered that his paternal grandmother is in fact a Heeb, making him, technically speaking, a half-Jew. Kerry now joins the ranks of such celebrity and politico half-Jews as Dianne Feinstein, Barry Goldwater, and Bill Maher.

Hopefully this will give Connecticut Senator Joe Lieberman some stern competition for the overtly Jewish vote, because Lord only knows what that douche will do to this country. Then again, you may also have to consider what this will do to Kerry's chances with a liberal voting populace that's becoming increasingly anti-Israel, and thus increasingly anti-Jewish.

A few words with: Congressman Dennis Kucinich

Congressman and presidential hopeful Dennis Kucinich (D-Ohio) made several stops in Seattle July 18 and 19 to share his progressive message. The Jewish Transcript spoke with him as he toured Tent City when it was housed in the parking lot of Temple Beth Am.

Transcript: You’ve taken a position for a two-state solution for Israel and Palestine. What would you do specifically to implement it?

Kucinich: I’ve been long considered a friend of Israel. I think that that Israel, as a democratic state, ought to be supported. Its survival as a democracy is important. I also think that the key to the security and survival of Israel is to make sure that America participates in helping rebuild and restore a viable economy in what is now the Palestinian territories.

A new Palestinian state must, of course, have a functioning economy which includes providing for jobs, housing, health care, and education. The United States can help create conditions which would be conducive toward taking steps in that direction, because having a Palestinian state in name only is not sufficient.

I think it’s going to be important for the United States to help create a negotiating climate where issues such as the sharing of water rights can be resolved, where both states would pledge to the security of each other, because there has to be agreement on securing each other. I think the United States must create a positive negotiating environment, but that the parties in each state, the Palestinians and the Israelis, must come to a settlement between themselves on issues that relate to ‘Right of Return’ and boundaries.

Transcript: Do you have specific steps in mind for implementing this yourself if you were in a position to do so?

Kucinich: As president I would move quickly to create a negotiating environment to bring the parties together. That means that the United States must have an almost single-minded focus to create peace in the Middle East.

I will stop the distractions of empire and of creating policies which speak of unilateralism and preemption.

For the United States, to declare its love of peace and aspirations for peace in the Middle East, and on the other hand to have policies of preemption and unilateralism, is antithetical. Every time that we start a war in some other place in the world, we make it that much more difficult to have peace in the Middle East. I want to focus on creating a negotiating environment which provides a consistency in dedication to peace, which causes the parties to be aware that the resources of the United States will be there to support an agreement and seeks to take an approach where we recognize both the Israelis and the Palestinians as our brothers and sisters.

Transcript: What would you do to alleviate the growing economic disparity in this country?

Kucinich: Cancel the tax cuts. Create universal health care. Medicare for all. Oppose the privatization of Social Security. Bring the retirement age back to 65. Provide for universal college education where every young person could go to college — for public college to be free, to be paid for through cancellation of the tax cuts.

Provide for universal preschool so children aged 3, 4, and 5 could go to a day care program, fully funded, five days a week to learn reading skills, and enhance educational opportunities and nutrition programs. That would be a great economic benefit to those young families who are looking for economic opportunities but can’t afford day care for their children. I think that’s part of using the power of government to transform.

Transcript: How would you continue implementation of the PATRIOT Act?

Kucinich: Cancel it. Get the Justice Department involved in filing suit to nullify provisions of the PATRIOT Act, which violate numerous sections of the Bill of Rights.

Transcript: How do you feel the current administration is handling our domestic security? What would you change?

Kucinich: We look at security a number of ways. First of all, we need to have hometown security. We need to have functioning communities which can help to fund police, fire, and emergency responders. The Department of Homeland Security, with its conglomeration of 171,000 employees, will take 10 years to figure out how the department can work.

I write to you out of concern for your nominating as running mate for the upcoming Presidential elections the Orthodox Jew, Joseph Lieberman.

Allow me to begin by calling your attention to the following excerpt from the writing of Holocaust survivor and Israeli citizen, Israel Shahak:

Picking up the telephone to save a life:

I had personally witnessed an ultra-religious Jew refuse to allow his phone to be used on the Sabbath in order to call an ambulance for a non-Jew who happened to have collapsed in his Jerusalem neighbourhood.  Instead of simply publishing the incident in the press, I asked for a meeting with the members of the Rabbinical Court of Jerusalem, which is composed of rabbis nominated by the State of Israel.  I asked them whether such behaviour was consistent with their interpretation of the Jewish religion.  They answered that the Jew in question had behaved correctly, indeed piously, and backed their statement by referring me to a passage in an authoritative compendium of Talmudic laws, written in this century.  I reported the incident to the main Hebrew daily, Haaretz, whose publication of the story caused a media scandal.

The results of the scandal were, for me, rather negative.  Neither the Israeli, nor the diaspora, rabbinical authorities ever reversed their ruling that a Jew should not violate the Sabbath in order to save the life of a Gentile.  They added much sanctimonious twaddle to the effect that if the consequences of such an act puts Jews in danger, violation of the Sabbath is permitted, for their sake.

The question that the world might like to hear an answer to is the degree to which the branch of Orthodox Judaism that Joseph Lieberman subscribes to backs the seemingly unanimous judgement of all rabbinical authorities that it is forbidden to pick up a telephone on the Sabbath to save the life of a non-Jew, but permitted to do so to save the life of a Jew.  More specifically, before continuing one day longer with Joseph Lieberman as your running mate, I wonder if it is not incumbent upon you to ask Joseph Lieberman's rabbi whether he backs the judgement of the Rabbinical Court of Jerusalem described by Israel Shahak above, or elects instead to be the first Orthodox rabbi to venture to oppose it.

It would be a misuse of opportunity if having the attention of Joseph Lieberman's rabbi, you put to him only a single question when so many others press to be asked.  For example, the public might also be grateful to learn the reaction of Joseph Lieberman's rabbi to the following statements made by other Orthodox rabbis:

     Rep. John Lewis, Georgia Democrat and a senior member of the Congressional Black Caucus, says Hilliard supporters erred by bringing in the polarizing Rev. Al Sharpton from New York to campaign for the incumbent.
     "I, for one, would have never had the likes of Al Sharpton in Alabama," Mr. Lewis says. "Why would you have Al Sharpton coming from New York? In the final analysis, it's going to be the people there on the ground [who decide the election], not somebody from New York or from Detroit or from Atlanta.      Mr. Lewis says it's possible that Mr. Hilliard took his district for granted.
     "I think that could have been one of the factors," he says. "African-American members, like all members, must take care of their districts. They've got to be visible."
     Mr. Hilliard, who is considering running for mayor of Birmingham, blames the Democratic Congressional Campaign Committee for not contributing more money to his race.
     "I didn't get enough help from the DCCC," Mr. Hilliard says. "The special interest groups, basically Jews, sent hundreds of thousands of dollars to my opponent."
