Turkish president visits Syria amid U.S. unease
DAMASCUS, April 13 (Reuters) - Turkish President Ahmet Necdet Sezer landed in Syria on Wednesday on a state visit which has stirred unease in the United States and drawn criticism from some political analysts who say it sends the wrong signal.
Syria, branded by Washington as a sponsor of international terrorism, is under heavy international pressure to pull all its troops and security forces from neighbouring Lebanon. It has pledged to do so by the end of this month.
Sezer has been careful in the run-up to the visit to stress the importance of Turkey-U.S. ties -- already strained by the Iraq war and its aftermath -- and Turkish media said the president would deliver a strong message to his Syrian hosts.
"Diplomatic sources say (the president) is expected to relay a message to (Syrian President Bashar al-Assad) that he must pull his troops from Lebanon as soon as possible," the top-selling Hurriyet daily said.
Assad has publicly hailed Sezer's decision to go ahead with his trip as evidence that NATO member Turkey is ready to stand up to the United States on issues of national interest.
Syrian Prime Minister Naji al-Otari said Sezer's "insistence on this visit" embodied Turkish support for "just causes".
Turkish nationalists insist Turkey must not be seen to bow to U.S. pressure over Syria, but some Middle East experts have criticised Sezer's decision to visit Damascus.
"(Sezer's trip) seems nothing but sailing in the open seas without a compass," wrote Cengiz Candar in the conservative daily Dunden Bugune Tercuman, arguing Turkey lacks a coherent strategy for dealing with the Middle East.
Uniquely in the region, Turkey has strong security ties with Israel, Syria's mortal enemy, but under the Islamist-rooted government of Prime Minister Tayyip Erdogan has tried to build better ties with Arab countries and with Iran.
Turkey, Syria and Iran share the same concerns about the turmoil in Iraq and fear it could lead eventually to the creation of a Kurdish state in the north of the country.

ATHENS, April 13 (Reuters) - A Greek court will rule on Wednesday whether to allow sales of a cartoon book from Austria depicting Jesus Christ as a drinking buddy of Jimi Hendrix and a marijuana-smoking, naked surfer.
Cartoonist Gerhard Haderer was found guilty by a Greek court of "malicious public blasphemy" this year and received a six-month suspended prison sentence for his take on the life of Christ -- but he can only be detained if he comes to Greece.
The book went on sale in Greece briefly in 2002, but the Orthodox Church was outraged and succeeded in having it immediately withdrawn through a provisional court order.
"This should never have happened if we were living in a real democratic society," said Athina Kouri of the book's Greek publishers Oxy. "Our position is that there should be no obstacle to the freedom of speech."
Haderer's lawyer Maria Mazioti is expected to file an objection to the ruling on Wednesday on the grounds that another European Union member, Austria, refused to charge the cartoonist after complaints in his home country regarding the same book.
"The Life of Jesus" has been translated into 10 languages.
Dozens of top Greek cartoonists are backing their colleague, saying the decision has harmed the image of their country.
A 1,000-signature petition, signed by international artists, including 2004 Nobel Literature Prize winner Elfriede Jelinek, demanded the immediate lifting of the ban.
It was not clear whether Haderer, who has said he would take the case to the European Court of Human Rights, would be present at the trial.

SHIUR #5: Appointing A King

Having analyzed in previous shiurim some of the different aspects inherent in monarchy, the time has come to direct our attention to individual components of the halakhic (Law) system of government.
Which of the various possibilities for selecting a king does the Torah (Talmud Bavli, Mishnah Torah) endorse? Actually, the formulation of the Torah itself is ambiguous.
downright confusion of the dragon
On the one hand, the narrative states that the people will set a king upon themselves (Devarim 17:14 - "Ve-amarta asima alai melekh"). On the other hand, the king is described by the Torah, in the very next verse, as being chosen by God.

Their acceptance and appointment of the king establishes the monarch as deriving his authority from the people's election. The Sanhedrin do not function here in their judicial but rather in their representative capacity. By involving the Sanhedrin in addition to the prophet, the Rambam roots the monarchical powers in the will and acceptance of the nation.

Moshe's reaction is that since God Himself has made the decision, what need is there for any additional input? After all, the proper choice has certainly been made. Having concluded that the Rambam requires a mandate from the people and therefore rules that the Sanhedrin must be involved in the selection, we must now look into the role of the prophet.

If, however, Divine authority is also required, then we can only grant legitimacy by means of a prophet or the urim ve-tumim. (Other possible sources of authority for democratic functions will be discussed in future installments, b"n.
The halakhic expression of this query is the issue whether a navi is required only le-khatchila or also be-di'eved. If we support the former position that the navi is no more than a search committee, then his involvement is not crucial. If he can assist in the selection process - thank God; if not, then Beth Din (the court) will apply their own judgment.

In contrast to this Tosafot, the Rambam in his commentary on the Mishna (Keritut 1:1) raises various scenarios regarding the accession of a prospective king, including popular acclaim, use of force, appointment by a navi, the Sanhedrin or Kohen Gadol, all of which are recognized as granting him royal authority.

Two other well-known sources who address this issue are the Radvaz (Melakhim 3:8), who opines that a king may be chosen either by a prophet or by the people, and Rav Kook, who ponders this issue in a teshuva (Mishpat Kohen 144:15) and tends to accept the first option, that a navi is dispensable, thus paving his way for legitimizing the Hasmonean kingdom.
Thus, the question of the necessity of Divine involvement in the appointment of a king is the subject of a (possible) machloket between the Bavli and the Yerushalmi and between Rambam and Tosafot, and is also the subject of further discussion in Acharonim.
King of Confusion
Having presented the above mentioned opinions, we cannot yet conclude this segment without connecting them to the issues and concepts dealt with in previous shiurim. Throughout all of the above discussion, we did not disbetween different functions of royalty. However, as we explained in previous shiurim, it is obvious that not all halakhot relating to a melekh can be lumped together without analyzing their essential nature. Therefore, we must now proceed to review our conclusions in light of this. As a starting point, we may take a remark of Rav Kook's in the closing lines of the responsum cited above. Having been questioned as to the right of the Hasmoneans to wage war (a royal prerogative) and concluding that they were legitimate rulers since appointment by a navi is dispensable, he adds the following:
"Aside from this, it seems reasonable that at a time when there is no king, these privileges revert to the hands of the nation as a whole, since the prerogatives of monarchy also pertain to the general condition of the nation. In particular, it seems that every Judge who arises in Israel has the status of a king, as regards several royal prerogatives, particularly those pertaining to governance of the nation." (Mishpat Kohen, 144)
The truth of his remarks rings loud and clear. As long as we are concerned with the public weal - what we defined as issues of malkhut (government) rather than personal status - it is eminently logical that the people have the ability to grant the authority and prerequisites of power to a ruler (or, in the absence of a monarchy, to any governing administration set up by the people). To the extent that a navi is needed, it is only for matters pertaining to the king's personal status. Conversely, if we accept the claim that the Davidic kingdom confers a personal sacral status, that clearly can be authorized by Divine authorization alone.
Thus REFERENDUM....set up by the Chabad Hasidim Pharisees of Sanhedrin...see Sanhedrin Ruling on the "Road Map to Hell" that George knows for a fact will not stand. For Bush knows that Sharon, appeasing the Hasidim, will be cast out, then he thinks it is he who shall be given Jerusalem....hahahhahha but he too is to be double crossed by the Sanhedrin Chabad Lubavitchers, and they will place their Moshiach of the Abomination which makes desolate........
Thus, the sources cited above must be analyzed as to which element of monarchy they are dealing with. Since both the Bavli and Yerushalmi are discussing the issue of korban nasi (leader's sacrifice), they are obviously disagreeing; however, it is not necessarily a machloket (Law) regarding the legitimacy of the governing authority, but rather a narrower question of whether the korban is a function of personal status or abuse of power. The Radvaz makes his comment regarding the halakha of mored be-malkhut; Tosafot discuss mishpat ha-melekh (royal privileges); the Rambam deals with the halakha of anointing a king after a disputed succession; and Rav Kook is confronted by the issue of declaring war. Regarding each, a separate analysis must be made. At the moment, we will not undertake this task; however, we must point out that the issue at stake may be the understanding of each particular function and its relationship to the varying royal elements, rather than a sweeping machloket as to the need for a navi to legitimize royal power and person.
In conclusion, it is worthwhile to point out that the Ramban also claims, basing himself on the phrase, "Ve-amarta asima alai melekh," that the people's request of a king is itself part of the mitzva, a requirement which would indicate that the source of authority is rooted in the people, who must express their willingness to establish a human king over themselves.

Festering rivalry in Prague bursts into open with violence on Shabbat

PRAGUE, April 12 (JTA) — A long-simmering dispute in the Prague Jewish
community over the leadership of one of the city’s most prestigious
synagogues has resulted in a violent altercation and the shul’s temporary
closure. The rabbi of the famed Old-New Synagogue, Manis Barash, was
conducting Shabbat services Saturday and was displeased to find that Karol
Sidon, chief rabbi for the Czech Federation of Jewish Communities, was
offered an aliyah to the Torah by the synagogues’s gabbai, according to
observers. Barash, an American-born Chabad member, made his displeasure
known, pointing out that he, not Sidon — who was fired as chief rabbi of
Prague last summer — was the only person who should be conducting a Torah

The background to the incident was laid last summer. The Prague community
erupted in a furor when then-chairman Tomas Jelinek fired Sidon, claiming
the rabbi was not performing his duties properly and had misplaced
ceremonial objects. But Jelinek admitted that the larger problem was an
interpersonal conflict over the direction of the community. Sidon is an
Orthodox convert, while Jelinek is secular. Jelinek wanted to open the
community to more foreign and liberal elements, and claims Sidon was too
closed to such ideas. Sidon, for his part, claimed Jelinek wanted unfettered
power. When Jelinek dismissed Sidon he installed Barash, who is not fluent
in Czech, as the synagogue’s chief rabbi. The move was highly controversial,
since Sidon’s congregation had been worshiping at the shul with him since at
least the mid 1990s, and Chabad wasn’t part of the official Czech Jewish
Community. Sidon moved his congregation to the more contemporary High
On Saturday, however, the 30 or so worshippers who usually attended the High
Synagogue turned up at the Old-New Synagogue with Sidon in tow. It seemed
like an attempt to “take the synagogue back in some way. It was like the
army had marched in,” said Rafael Ohana, an Israeli tour guide who has lived
in Prague for five years and regularly attends Barash’s services. The
dispute turned heated when Barash refused to allow Sidon to have an aliyah.
Sidon told the congregation that they should move to the High Synagogue.
Most of the worshippers left, witnesses say. Shortly after, violence broke
out in the Old-New Synagogue’s entrance hall. A press release issued by the
Prague Jewish Community, many of whose members opposed Sidon’s firing last
summer, reported that six Barash supporters beat up two young worshippers.
The alleged victims “ended up seriously wounded, one of them tugged by his
legs on the floor after being beaten in the head, which resulted in a
concussion,” according to the release.
But Ohana had a different version of events. Barash’s wife “wanted to come
inside the synagogue. There was a Czech woman, a Sidon supporter, who told
the guards, ‘Don’t let this lady in, she does not belong here,’ ” Ohana
said. Upon hearing that, Ohana said, a Czech-Israeli woman, Tfila Yerucham,
the 19-year-old sister of the synagogue’s cantor, responded, “Anyone is
welcome here. What you are saying now is what the Nazis told my
grandmother.” The Czech woman then told her boyfriend that Yerucham had
called her a Nazi, Ohana continued. The boyfriend then “hit Tfila in the
face a few times and she fell to the floor,” Ohana said. “He beat and kicked her.”
Ohana’s version of events was reinforced by Yerucham’s father, who says the
fight was laced with political undertones about control of the synagogue.
Several Chabad House regulars entered the fight. “Everybody was fighting
everybody. There might have been 20 people going at each other,” said Ohana,
who said most of the fighters on the Chabad side were Israelis, not locals.
“I am sorry for all of this,” said Ohana, “but the ones who got hurt were on
the side that started it.”
Martin Hrehorcak, the “boyfriend” Ohana was referring to, said his
girlfriend never told guards not to admit Barash’s wife, but said Yerucham
insulted his girlfriend after she said Sidon was her rabbi. “It’s true that
I pushed and slapped the Israeli girl after she called my girlfriend a Nazi
pig,” he admitted. “But I did this to wake her up, not to hurt her. She has
a history of getting hysterical and when I was talking to her she wasn’t
answering, I thought she was going to have a fit, so I did what
psychiatrists recommend.” Hrehorcak said Ohana and other Chabad supporters
didn’t witness the event, but attacked him and others when they heard
Yerucham scream. He said he plans to press charges. “All of a sudden all of
these Chabad guys were attacking me and they injured my spine,” he said. “It
wasn’t about the girl only; this was about the conflict with Chabad and the

Jelinek was ousted as chairman last November in a community vote that was
attended mostly by Sidon supporters. He has challenged the vote and a new
community election is expected to take place next month. Two months ago, in
response to a previous request for judgement by Jelinek, a rabbinical judge
in Israel issued a ruling recognizing Barash as the official rabbi of the
Old-New Synagogue. Svab, the gabbai, said Barash must have been surprised to
see Sidon’s supporters enter the shul on Saturday. “As far as I know, the
only people who attended his services were Israelis and tourists,” he said

Russian shul takeover leads to squabble in Jewish community

MOSCOW, April 11 (JTA) — A recent takeover of a Moscow synagogue by Russia’s largest Jewish organization has again sparked tension within the country’s Jewish community. The conflict may torpedo any hope of a burgeoning alliance between the Federation of Jewish Communities of Russia and the Russian Jewish Congress, whose new leader had announced an end to bitter infighting between the two groups.
In the center of the conflict is a three-story structure on the outskirts of
Moscow. It is one of the city’s five synagogue buildings. The building is
home to Darkei Shalom, a seven-year-old unaffiliated Orthodox congregation.
Two months ago, the Federation of Jewish Communities took over the
building — and the congregation’s rabbi fought back. The federation, which is headed by one of Russia’s chief rabbis, Berel Lazar, controls most of the country’s synagogues.
The synagogue was built by a Muslim philanthropist, Ryashid Bayazitov, who sought to create a “little Jerusalem” in the Russian capital by placing an Orthodox church, a mosque and a synagogue in one compound. When the synagogue was completed and offered free to Jewish organizations, none of the major groups in the community were interested in the financial burden associated with running a new synagogue in a remote neighborhood. David Karpov, a Moscow-born Chabadnik, accepted the offer. Since then,
Karpov, now 48, has created a congregation from scratch. The synagogue now offers a variety of religious and social activities, attracting 50-60 people to its Saturday morning services. Although he is a devoted follower of the late Lubavitcher rebbe, Menachem Mendel Schneerson, Karpov never allied himself with Lazar, the politically connected rabbi who is Chabad’s chief emissary in the former Soviet Union. Instead, Karpov affiliated with Chamah, a religious and social-welfare organization that runs several charitable and educational projects in Moscow. Karpov also has been a longtime member of the presidium of the Russian Jewish Congress. The most powerful player in Russian Jewish life in the mid-1990s, the group has been at odds with the federation during the past several years.
Who’s responsible for the dispute between the federation and Karpov depends on whom you ask. Bayazitov transferred the rights for the building to the federation. Karpov said it was Chabad’s plan to take over his congregation that made Bayazitov reconsider. The federation says the issue of who should run the shul originally was raised late last year by Bayazitov, who, according to Boruch Gorin, a spokesman for the federation, told JTA he was unhappy with how the synagogue functioned. “He got complaints that there were some marginal people in the synagogue, alcoholics, bums, that the synagogue was turned into a flophouse,” Gorin said, so he presented the federation with an ultimatum. “Either we establish order in the synagogue or else he closes the synagogue down.” Karpov dismissed the accusations.
“Everything is in order in the synagogue — to the extent one can talk about order in a synagogue.” Karpov said that indeed each week some 30 people sleep over in the synagogue for Shabbat, but he said these are the members of the congregation who cannot travel on the Jewish day of rest, and not “some bums,” as Gorin suggested. Bayazitov, a 40-year-old ethnic Tatar and a prominent businessman, was not available for comment.
Karpov said the only way for his congregation to have the issue resolved
would be through a rabbinical court, but there is no rabbinical court in
Russia whose ruling would be recognized by all the community’s factions. Gorin and Karpov told JTA that Karpov was given an ultimatum — he could become a federation rabbi or he could leave the synagogue. But Karpov said this condition is unacceptable. “If I agree, as an employee of the FJC I might be removed from the synagogue at any moment,” he said. “I built this congregation and want to stay with the people who have their trust in me.” Karpov said his congregation was too weak to defend itself “unless someone stands up for us.” But the federation’s executive director, Rabbi Avraham
Berkowitz, denied the ultimatum was made. He said Karpov was asked only to follow federation guidelines, such as not allowing people to sleep in the synagogue. “No synagogue in the world has people sleeping in it,” he told JTA, adding that apartments are being offered to house anyone who might need a place to sleep on Shabbat.
The conflict has awakened tensions between the two groups, even after the new leader of the RJC, Vladimir Slutsker, said the feud would end. Last week, the RJC’s leadership called on the federation to resolve the conflict around the synagogue while retaining the shul’s independence. In response, a spokesman for the federation accused the RJC of a biased approach to the conflict and said that by making a public statement on the issue, RJC has taken upon itself “responsibility for aggravating” the situation in the Jewish community.
This week, the RJC made a public statement on the issue, criticizing the
Chabad federation over its handling of the crisis. Gorin responded by
calling RJC merely “one of the foundations in the Russian Jewish community, not even the largest one,” which “has no right to interfere in the issue.” Earlier, a group of non-Chasidic Orthodox rabbis affiliated with KEROOR, a rival group, issued a statement that said the incident around Darkei Shalom was just another in a string of similar incidents. Each time, they charged, the federation takes over religious properties and entire congregations by using its close ties with local and federal authorities.
Berkowitz denied that the government plays any role in these affairs, and
Gorin said his group sees nothing wrong about being the most successful player among Russian Jewish groups. He insisted that congregations themselves turn to the federation for support, not the other way around. “If we can run Jewish organizations better than any other organizations, we should not be shy about that,” he said. “And those congregations that are becoming part of the FJC are attracted to us by the possibility of having a strong sponsor.”
In the meantime, Karpov seems to be gearing up for a new stage in the
conflict. He said members of his congregation “are ready to take actions to defend their right to exist.” But, he added, he would prefer to resolve the issue peacefully.
